WHEREAS , to prevent prop erty owners from abu sin g the Co ncrete Utilit y and
j eo pardi zing the viabilit y of this program , an additional prov ision needs to be added to 1hc
Co ncre re Ut il ity .
NOW, THEREFORE , EE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ENGLEWOOD , THAT:

COUN(IL GOAL AND PREV IOUS COUNCIL ACTION
In May oft 997, City Council passed O rdinance No. 97-36 w hi ch crea ted the Concrete Utility in
order to pr ,idea funding mechanism to assist owners with th ei r res ponsibility in the re pair (usuall y
re moval"'" replacement) of the City's aging concrete infras tructure .
RECOM~·•ENDED ACTICN
Approve an ordi na nc e to amend Article 12-8-1 2 of the Englewood Municipal Code to m odify th e
volunta ry non -participa tion provision in the Concrete Utility.
BACKGROUND, ANALYS IS, AND : LT i:RNATIVES IDENTIF IED
Property owners in the City of Englewood are required to maintain th e cu rb , gutter, and sidewalk
adjacent to th eir property per the Municipal Code Section 11-7-1 8. When the Concret e Utility was
adopted, a voluntary "opt-out• provision was included to ensure the program being created would
function as a utility and not as a tax.
We are beginning to see at cert ain locations concrete repairs th at will extend for several hundred
feet. This means that enti re frontages of properti es will be reconstructed as early as this year. Our
concern is that once all th e concret e has been replace d in front of someone's house, there may be
a strong motivation to "opt-out" since all th e co ncrete is brand new and should last for 40 or so
years .
In orde. to try to prevent property owners from abusing th e Concret e U tili ty an d jeo pardizing the
viabi lity of this program, we recommend City Co un cil co nsider adding th e following requirement to
