IMPLEMENTATION The proposed stand ard s app ly to new automo ti ve sa les and rental busi nesses, new parking lots and parking stru ctur es. Prop erti es where au tomoti ve sa les or rental uses were lice nsed to operat e be- twee n January 1, 19 95 and Janu ary 1, 2005 are exe mpt from th e minimum frontag e requirem ent. Agreement on th e proposed Co mmittee ve rsion of th e ordi nance was reac hed by th e Au t o Use Committee wh ose members w ere appoin ted by Ci ty Council. The committee includes represe nta- tive s of automoti ve sa les businesse s and prop erty own ers, staff and Council. The recommended implem entation schedule tak es into considera ti on th e business cycl es that temporarily reduce th e demand for au to sa les and ren tal busin esses as well as th ei r investment in property and improve- ments . The schedu le is a compromise th at th e co mmittee b eli eves is fair and accep table to existing autom otive sa les and rental busin esses and property owners . FINANCIAL IMPACT Th e proposed ordin anc e does no t have any direc t financia l impact on th e City. Place of business for dealers must sat .;fy the following requirements : • Permanent enclosed office with electrical serv ice and restroom . • Space to dis play on e or more vehicles . • Open to public a minimum of 12 hours a week. • In compliance with local zoning . • Used exclusively for the dealer business or inc ide ntal businesses , such as parts , repair, etc . • Sharing the site with another business owned by another person is NOT permitted . • A permanent sign displaying business name, clearly visible from the street. • Premises owned or leased by dealer. Wholesa le rs are not requ ired to meet the place of business requirements , but must ma inta in an office in which all veh icle records are maintained . Written examination : Mastery faJm -Must score 100% on open-book exam . Ea ch owner or corporate member must have completed and submitted the "Mas tery Test" or they must be currently licensed as a dealer or salesperson . Business Documents : If filing as a corporation or an LLC a copy of the stamped articles of incorporation/LLC filed with the Colorado Secretary of Slate must be subm itted . If the corporation i~ out-of-state a copy of the Certificate of Authority is requ ired . If fil ing as a partnership a signed copy of the µartnersh ip agreement is required .
