WHEREAS. the Auto Use Committe e has re co mmended a phased approach to im plem entation
of the se standa rd s fo r new aut omo ti ve sa le s and rental uses; and
WHEREAS, the Englewood Pl annin g and Zonin g Comm iss i!ln reviewed a draft based on the
Conmittee · s recommendatio ns ant.I. after :i Publi c Hearing on September 21. 2004 reco mmended
the Ordinance with ccnain ame ndments: and

Co de (UDC). Th e exce ption is th e Si te Plan requirement w hi ch th e Commission added.
The Aut o Use Co mmitte e co ntinu ed mee ting after th e Pl annin g Co mmis sion pub li c hea ring and has
reco mm end ed furth er modi fi ca ti on to th e Au tomoti ve Sa les and Rent al ordinan ce (V ersi on 2,
11 /12/2004 ). The Committee has provid ed a second ve rsion of Council Bill 44 titled "Auto Use
Committee Version" whi ch is includ ed for yo ur co nsid erati on. Some re-o rd ering and re-numb ering
has occurred. Standards ( 11) l ol Front age and ( 12) Buildings corresp ond to standards "d" and "e"
in th e Commis sion ve rsion, two of th e balded "Wh erea s" statements, tha t appea r in the 1.ommis-
sion ve rsion, rega rding th e "limited use" provisions of th e U.D.C. were deleted in the Committee
ve rsion . The Committee versi on also incl udes staff-reco mm en ded te xt re visions on standar ds (1 ),
(2), (4) and (9). The Site Pl an requirement has bee n elim inated.

IMPLEMENTATION
The proposed stand ard s app ly to new automo ti ve sa les and rental busi nesses, new parking lots and
parking stru ctur es. Prop erti es where au tomoti ve sa les or rental uses were lice nsed to operat e be-
twee n January 1, 19 95 and Janu ary 1, 2005 are exe mpt from th e minimum frontag e requirem ent.
Agreement on th e proposed Co mmittee ve rsion of th e ordi nance was reac hed by th e Au t o Use
Committee wh ose members w ere appoin ted by Ci ty Council. The committee includes represe nta-
tive s of automoti ve sa les businesse s and prop erty own ers, staff and Council. The recommended
implem entation schedule tak es into considera ti on th e business cycl es that temporarily reduce th e
demand for au to sa les and ren tal busin esses as well as th ei r investment in property and improve-
ments . The schedu le is a compromise th at th e co mmittee b eli eves is fair and accep table to existing
autom otive sa les and rental busin esses and property owners .
FINANCIAL IMPACT
Th e proposed ordin anc e does no t have any direc t financia l impact on th e City.

Application : Submit original appl ication and addendum . All requested information must be provided including all
boxes marked "yes" or "no". All "yes" answers require an explanation . Application must be signed by owner,
corporate officer or LLC member.
Financial statement: Current , accurate informst;~r. is raq uired . r ollow instn. :Iona carefully . The Deale, Board
requires a net worth of at least $50,.000.
Credit Bureau report : A credit bureau report will be obtained on averv applicant. Th is report is an indicator of an
appl icant's financ ial fitness . The Dealer Board requires an empiri•:. sm rr at least 600. It is suggested that if
you are not sure of your score that you contact T•ans Union to run f ,,.., • n credit report . if derogatory
information appears, ii must be resolved or exp la ,,.J ,nan alt ·cl!m< 1110 y0ur appl icati on .
Backg round check: A background check will be done on ovcry applicant. If the applicant has ever been
anested , charged with , convicted of or pied no contest to an y felony or misdemean or crime in the past ten years ,
excluding traffic violations , supporting court documents must be included with the application .
Place of business affidavit: Complete the appropriate sectio n and sign . Place of business for dealers must
sat .;fy the following requirements :
• Permanent enclosed office with electrical serv ice and restroom .
• Space to dis play on e or more vehicles .
• Open to public a minimum of 12 hours a week.
• In compliance with local zoning .
• Used exclusively for the dealer business or inc ide ntal businesses , such as parts , repair, etc .
• Sharing the site with another business owned by another person is NOT permitted .
• A permanent sign displaying business name, clearly visible from the street.
• Premises owned or leased by dealer.
Wholesa le rs are not requ ired to meet the place of business requirements , but must ma inta in an office in which all
veh icle records are maintained .

must have completed and submitted the "Mas tery Test" or they must be currently licensed as a dealer or
salesperson .
Business Documents : If filing as a corporation or an LLC a copy of the stamped articles of incorporation/LLC
filed with the Colorado Secretary of Slate must be subm itted . If the corporation i~ out-of-state a copy of the
Certificate of Authority is requ ired . If fil ing as a partnership a signed copy of the µartnersh ip agreement is
required .
Franchise agreement: If applying as a franch ised dealer please ensure that the manufacturer is licensed lo do
business in Colorado . You may ask for a copy of their license or contact our office . If the manufacturer is licensed
you will need to obtain a letter from them staling that you are authori ze d to sell their product lin e.
Dealer plate affidavit: Application for dealer demonstration and full-use plates must be co n plete~ and signed .

Colorado Sale s Tax Lice nse: (Co lorado Bus iness Form). Copy of the sales tax license or a copy of the sales
lax application stamped with Dept of Revenue's "rece ived" stamp as well as proof of trade name registrat ion .
Fee: Check payable to Department of Revenue . See fee schedule .
Bond : $30 ,000 surety bond in legal name and D.B.A Bond must be signed by owner or partner, corporate officer
of LLC membe r.
