AN ORDINANCE AUTHORIZING AN EXCHANGE OF REAL ESTATE ON THE
BROWN DITCH BETWEEN JACK R. LILIENTHAL AND THE CITY OF
ENGLEWOOD , COLORADO.
WHEREAS , Jack R. Lilienthal plans to develop the real estate parcel in an area
bisected by the Brown Ditch: and
WHEREAS , Jack R. Lilienthal ;,as proposed a n exchange of real estate to allow the
reloca tion of t he Brown Ditch as a part of the planned development ; and
WHEREAS, the Englewood Water and Sewer Board recommended approval of ·•e
rea l estate exchange at the April 9, 2002 meeting;
NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY C ,
ENGLEWOOD, COLORADO, AS FOLLOWS:
~-The exchange of rea: estate by Quit Claim deeds is hereby accepted and
approved by the En"le wood c;_ty Council. A copy of said Quit Claim Deeds with maps
showing the properties to be exchanged are attached hereto as "Attachment l " and
incorporated herein by reference .
Si:i.li.wl.2 -The Mayor and City Clerk are hereby authorized to sign and aetest,
respectively , the said documents for and on behalf of the City Courcil and the City of
Englewood, Colorado. ·
Introduced , read in full, and passed on first reading on the 15th day of April, 2002 .
Published as a Bill for an Ordinance on the 19th day of April, 2002.
Read by title and passed on final reading on the 6th day of May, 2002 .
Published by title as Ordinance No. fl. Series of 2002, on the 10th day of May ,

RECOMMENDED ACTION
The Engle wood Water and Sewer Board, at their Ap ril 9, 2002 meeting, recommended Council approva l of
th e two r,uit claim deeds exchanging p roperty on the Brown Ditch at Columbine Valley Estates.
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
TI1 e Br own Ditch right-of-way is being realigned to accom modate residential ' •velopment on Pebble Beac h
C.our t along th e Brown Ditch. Pebble Beach Court is located one block , . 0 f Federal and south of
Bowles, north of Columbine Country Club.
The City rese rves the right to make full use of the property nec e,;ary in the operatio n of the Br own Ditch.
The City retai ns all rights to operate, maintain , in stall, repair, re ··.,ove or relo cate an y of its ' facilities located
with the City's right-of-way.
