ENTITLED "PERMANENT TRANSIT EASEMENT' BETWEEN THE REGIONAL
TRANSPORTATIO N DISTR ICT (RTD ), THE ENGLEWOOD ENVIRONMENTA L
FO UNDAT ION , INC . AND THE CIT Y OF ENGLEWOOD , CO LORADO.
WHEREAS, the City Coun cil of the City of Englewoc d, Colorado passed Ordinance
No. 1, S e ri es of 19 97 which a uthori ze d th e interg ove rnm e ntal agreeme nt with RTD
for th e t rans it re lated improve ments, including parking spaces for 670 a utomobiles,
an e ight bay bu s tra ns fer fa cility, pedestri a n access fro m the pa rking facilities to th e
s tation platform , la nd fo r RTD Light Rail tractio n power sub stati on and easements
as re quired to ope ri,t"" a nd maintain RTD facili ties a t the CityCenter Engle wood
proj ect; and
WHERE .\>' , Lnglewood City Co uncil passed Ordinance No. 42 , Series of 1999,
authori zi ng un 1wl!ndm e nt to the intergove rnm e ntal agreeme nt with RTD for
cons truction a nd funding of the transit facilities and parking spaces at CityCe nter
En glewood; und
WHEREAS , the amendment addressed changes in RTD funding for the project
including the addition of a pedest ri an br idge , an increased num be r of parking spa ces,
re vised comp leti on a nd acceptance dates; and
WH E REAS . the amendment a lso set forth RTD 's retainage of an optio n to increase
a utomobile pa rking s paces by 500 on or before July 31 , 2003; a nd
WHEREAS , RTD will be responsibl e fo r the full cos t of co ns tructing these p arking
spaces unless th e City requires additio na l par kin g to meet the needs of its CityCe nter
En gle wood project in which C8 -lt! each of the parties will s hare t he costs based on the ir
proportiona l usage of the parkin-e. s paces ; a nd
WH EREAS , the a mendm en t in creased RTD grant fu ndi ng fr om $2,7 00,000 to
$5 ,700 ,000 fo r projec t related cos ts; nnd
WH EREAS , it is be li eved t ha t the in co rp oratio n of th e transit improv ements with
the Co mm e rcial Redeve lopm e nt Pr ope rty is benefi cinl to both the rede ve lopm ent and
the light rail sys tem;

Di stri ct (RTD), the City of Englewood, Colorado and the Englewood Environmental
Foundation, Inc. attached hereto as "Attachment I ," is hereby accepted and approved
by the Englewood City Council.
~-The Mayor is authorized to execute a nd the City Clerk to attest and
seal the Intergovernmental Agreeme nt for and on behalf of the City of Englewood,
Colorado.

system is for the benefit of Granter 3nd all Grantor's heirs , 5uccessors. assigns. and any
person or e ntity acqu1nng property from Granter in t he vicinity of the tran sit ~asement
herein granted.
