AN EMERGENCY ORDINANCE ESTABLISHING A TEMPORARY SUSPENSION OR
MORATORIUM ON THE ISSUANCE OF PERMITS FOR NEW SINGLE FAMILY
ATTACHED AND MULTI.FAMILY RE S IDENTIAL CONSTRUC1ION, OR ANY
HOUSING REQUIRING THE SUBDIVISION OF PROPERTY, IN THE AREA
LOCATED BETWEEN WEST EVANS AVENUE ON THE NORTH, WEST VASSAR
AVENUE ON THE SOUTH, SOUTH TEJON STREET ON THE EAST AND SOUTH
ZUNI STREET ON THE WEST, FOR A PERIOD OF SIX MONTHS .
WHEREAS , constituents brought to the City Council's attendon a co ncern regarding
design standards in the area located between west Evans Avenue on the north, west
Vassar Avenue on the south, south Tejon Street on the east and south Zuni Street on
t he west; a nd
WHEREAS, City Co uncil has reviewed that co ncern and found that the de sign
standards in the area located be tw ee n west Evans Ave nue on the north, west Vassar
Avenue on the oo uth , south Tejon Street on the east and south Zuni Street on the west
need to be updated ; and
WHEREAS , the design standards currently permit substandard housi ng in this
area; and
WHEREAS , control of the permitting a nd zo ning of these facilities a re legitim •te
exercises of local police power; a nd
WHEREAS, a morato rium on the issuance of permits for new s ingle family attached
and multi.family residential co nstruction or any housing requiring the subdivisio·n of
property, in t he area located between west Evans Avenue on the north , west Vassar
Avenue on the south, south Tejon Street on the east and south Zuni Street on the west
will give the City staff time to collect information and work clo sely with the Englewood
co mmunity to revise zoning regulations that protect the interests of t he co mmunity;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO, THAT :
~-The City Co uncil finds t he provis ions of this Emergency Ordinance a re
temporary in nature and are intended to be replaced by s ub seq ue nt legislative
e nactme nt. The temporary s uspension of permits for ne w single family attached and
multi-family residential co nstruction, or a ny hous ing requiring the subdivision of
property, in t he area located betwee:.1 west Evans Avenue on the north , west Vessar
Avenue on the south , south Tejon Street on the east and south Zuni Street on the west
s hall terminate on Novem ber 24, 2002 .

~-The temporary s uspension of pe rmits s hall not apply to permi ts for
s ingle family detached houses, remodels, and accessory structures, but will app ly if the
residence is entire~v demolished.
Sl:l:t.iwlJl , The Enclewood City Co uncil directs City staff to develop appropriate
recomm e ndations to Co uncil, to be consistent with thi s Emergency Ordinance and to
coll ect informatio n and work closely with the Englewood com munity to revise zoning
regulations, which protect t.he interests of the comm unity .

Ordinance by reason of inadequate design standards in the area located between west

Bill for Ordinance is necessary for the immediate preservation of public property,

BACKGROUND :
At a City Council Open Forum on March 25 , 2002, a community member expressed concerns
rega rding the quality of reside ntial structures being built in no rth west Engle wood. City Council
discussed the conc erns at the April 8, 2002 st ud y sessio n in re lati o n to th e Comprehensive Zoning
Ordinance.
Currentl y, no design standards are identified for the area located between West Wes le y Ave nue on
th e no rth , West Vassa r Ave nu e on the so uth, South Tejon St ree t on the eas t and South Zu ni Street
on th e wes t. Coun ci l determined that estab li shm ent of design stand ards is necessary to pro tect the
via bility of th e r eig hbo rh ood and the interests of th e co mmun ity.
Council directed City staff to continue preparati on of th e Unified D eve lopme nt Code (U D C), the
update of exis tin g land us e an d zo ning regulat ions . The requested moratori um is a temporary
measure to all ow staff to develop reg ulations , including appropriate design standards , base d on
council direction and citizen input. n,e mo ratori um is lim ite d to new construction and exempts
permits fo r rem odels and accessory structures. This mo ratorium is sp ecific to the area located
between West Wesley Ave nue o n the north, West Vassa r Ave nue on th e south, Sou th Tejon Stree t
on th e eas t and Sou th Zun i Street on the wes t. This six-mon th moratorium shall terminate on
Nove mber 10, 2002 .
FINANCIAL IMPACT:
Buildin g permit fees fo r new const ruction will no t be coll ected durin g !he moratoriu m. No
additional financia l imp acts ha ve b ee n iden tified.
