AN ORDINANCE AMENDJ:.O TITLE 7, CHAPTER 6F, SECTION 6 , BY THE
DELETION m• SUBSECTION C, AND TITLE 15, OF THE ENGLEWOOD
MUNICIPAL CODE 2000 \i'ITH THE ADDITION OF A NEW CHAPTER 16,
PERTAINING TO GAR~.GE SAi.BS.
WHEREAS , because of the periodic nature of garage sales, it is determined that a
sales tax license and the duty to collect sal es tax on such garage s ales ie a burden to
the citizens of Englewood; and
WHEREAS , restricting t he number and duration of garage sales will prevent ouch
sales from becoming a commercial sales event in a residential area;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO, AS FOLLOWS:
Sl:s:tianJ.. The City Council of the City of Englewood hereby approves amending
Title 15, of the Englewood Municipal Code 2000, by adding a new Chapter 16 -
Garage Sales, Section 1, entitled Definitions, which shall read as follows :
ll::l.6: GARAGE SALES.
15-16-l i Definitions· For the purpose of this Chapter the following tmnuh.nll
hove the meanings indicated:
GARAGE SALE : Includes all sa les entitled "garage sale" "'lawn ssl~
sale" "rummaG. q.ale" "estate sale .. or similar sale of tangible
personal property which is advertioed to the public et large
Shall onlv include an individ ual who owns real prooertv · rents
or maintains a lease of reel nroo ertv· or holde the position of
property manager of the real nropertv where the sale is
occurring .
~-The City Council of the City of Englewood , Colorado hereby amends
Title 15, by adding a new Chapter 16, Section 2, of the Englewood Municipal Code
2000 , to read as follows:
16·16·2 · Restrictions · The following restrictions apply to an persons holding a

Title 15 , by adding a new Chapter 16, Section 3, of the Englewood Murucipal Code
2000 , to read as follow s:
15-16-8: Signs; S~gos are permitted in the oubJic right-of-way to advertise garage
sales provided the following provisions ere m~
~. No gnragt: sale shm shall exceed eighteen inches by eig hte en inches (18" x 18")
~. All garage sale signs shall bear the addresR of the nerson holding the garage sRle
and dnte of sole .

~-The City Council of the City of Englewood, Colorado hereby amends
Title 7, Chapter 6F, Sectio n 6, by the deletion of Subsectioi. C, in its entirety, of the
Englewoo,I Municipal Code 2000 , to read as follows:
7-6F-6 : Posters, Posting and Destruction.
A. Any handbill , poster, pla ca rd • .,. painted or printed matte r ~ which
shalJ be s tuck , posted or pasted upon any publi c or private hou se , store or
other buildings, or upon any fence, pow er pole, telephone pole or other
structure, without the permission of the owner, agent or occupant, shall be

~-Safety Clauses The City Council hereby finds , determines, and
declare& that this Ordinance is promulgated wider the general police power of the
City of Englewood , that it is promulgated for the health, safety, and welfare of the
public. and t hat this Ordinance is necessnfy for the preservation of health and sa ety
nnd for the protection of public convenience and welfare . The City Council further
determines that the Ordinance bears a ratioual rel ation to the proper legis lative
object so ught to he obtained.
~-· Severabilitv lf any clause, sentence , paragraph , or part of this
Ordinance or the application thereof to any person or circ umstances shall for any
r eason be adjudged by a court of co mp etent jurisdiction invalid, such judgment shall
not affect impa ir or invalid1t r-t;he remainder of this Ordinance or its a pplication to
other persons or circumstances .
~ Inconsi stent Ordinances All other Ordinances or portio ns thereof
incon sistent or conflicting wi t h this Ordinance or any portion hereof ore hereby
r epealed to the extent of s uch inco nsistency or conflict.
~. Effect of repeal or modification The rep eal or modifica tion of any
provision of the Code of the City of Englewood by this Ordinance s hall not release,
extinguis h , a lter, modify. or cha nge in whole or in part any penalty, forfeiture , or
liability, either civil or criminal, which shall have been incurred under s uch provision,
and each provision s hall be treated and held as still remaining in force for the
purposes of s ustaining any and all proper actions , suits, proceedings, and
prosecutions for the enforcement of the pena lty, forfeiture , or liability, as well as for
the p urpose of s ustaining any judgment, de cree , or order which cnn or may be
rendered, entered, or made in such actions, s uits. proceedings, or prosecutions.

~ ~ The Penalty Provi•ion of Section 1-4-1 EMC shall apply to
each and every vio lation of this Ordinance .
