AN ORDINANCE AMENDING TITLE 16, CHAPTE R 9, SECTION I . OF THE
ENGLEWOOD MUNIC IPAL CODE 2000, PERTAINING TO HOBBY VEHICLE
LI CENS I NG .
WHEREAS , the Englewood City Co uncil adopted regulation of der elict and hobby
vehicles by t he passage of Ordinance No. 11 , Series of J 991 ; and
WHEREAS, the Englewood City Council adopted regis tration and permitting of
derelict and hobby vehicles by t he passage of Ordinance No. 63 , Series 1991 ; and
WHEREAS , the Englewood Code Enforcement Advisory Co mmi ttee recom mended
approval of amending Title 15. Chapter 9 , Section I , removal of the permit and the
$100 licensing fe e fo r the ho b by/derelict vehicle permit at its May rn, 2002 meeting;
NOW, THEREFOR E, BE IT ORDAJNED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO , AS FOLLOWS:

15-9-1 : Vehicles; Derelict and Hobby.
It sha ll he unla wful and co nsidered a nui sance for a ny person to s tore ,
maintain or keep a ny derelict or hobby ve hi cle. as defined by this Title, on a ny real
property or adj acent public right-o f-way in the City except a s follows:
A. Vehides in Residential Zones.
I . There s hall be no more than one hobby or derelict vehicle
maintained or s tored on th e prop erty of any residence in a
re sidentially zoned district, which ve hicle shall be stored in a
fully e nclooed garage or similar structure. A person may store
the vehicl e in a carport or ope n area ~ li e ve hicle and its
parts nre kept e ntire ly covered with &. .!-d ow n canvas or
other opaque cov ering. Storage or cove ring is not required
when the vehicle is actually being worked on .

2. No person shell store ar work on any hobby or derelict vehi cle
within (he required front yard setback or in or on any public
property or right-t'f-way.
3 . The owner of a derelict or hobby vehicle as well as the
occupant and owner of the property shall be responsibl e for
the maintenance or storage of suc h vehicle in compliance with
this Chapter.
4. The owner of a hobby vehicle or derelict vehicl e stored in a
residentially zoned district s hall register t he vehicle with t he

5 . No person s hall store on a residentially zoned property a
hobby or derelict vehicle n ithottt a permit er in violation of
the manner set forth in this s ubsectio n six (6). Failure to
co mply shall be a violation of this Code.
6. Any single vehicle stored on the property that is covered with
a tit. ~ow n canvas or othe r opaque co ve ring, is stored on a

hard surface and has four (4) fully inflated tires is presumed
to be fully licensed , insw,,d and State inspected and not a
derelict or hob by vehicle. lt more than one vehicle is covered
and stored on any one property, this presumption shall not
exist and it shall be the duty of the City to determine
whether the vehicle s are derelict or hobby as defined by this
Section and to take such measures a.s are authorized by this
Section .

1. No person shall kee p a hobby or derelict vehicle in a business
zoned district unless such vehicle u stored in a fully enclosed
structure in an area screened from · ew of adjacent properties
and public rights-of-way.
2. No person who resides in a business or industrial zoned
district shall keep more than one hobby or derelict vehicle on
the property.
3. The owner of a derelict or hobby vehicle as well as the
occupant and owner of the property shall be responsible for
the maintenance or storage of such vehicle iu compliance with
this Chapter.
4 . The owner of a hobby vehicle or derelict vehicle stored in a
business zo ned distl.ict shall register the vehicle with the

5 . No person shall store on a bu siness-zoned property a hobb y

s hall be a violation of thia Code .
6 . The provisions of this s ubsection six (6) shall not apply to
property that has as a permitted use an a uto r epair
business .
lll:s;!~. Safety Clauses The City Council hereby finds, determines, and
declares that this Ordinance is promulgated under the general police power of the
City of Englewood , that it is promulgated for the hea lth, safety, and welfare of the
public, anlt that this Ordinance is necessary for the preservation of health and safety
a nd for the protection of public co nvenience and welfare. The City Co uncil ~-ther
determ.ines that the Ordinance bears a r ational relation to the proper legisiat.i.ve
object sought to be obtained .
~-Severabjlity If any clause, sentence, paragraph, or part of this
Ordinance or the application thereof to a ny person or circum1-:t.ances s hall for any
re ason be adjudged by a court of competent jurisdiction invalid , s uch judgment s h all
not affect impair or invalidate the remainder of this Orciin a:,_ce or its app li cation to
other persons or circums'..ances.
~ Inconsistent Ordinances All other Ordinances or portions thereof
inconaistent or conflicting with thi s Ordinance or any portion hereof are hereby
repeal e<' to the extent of such inco nsistency or co nllict.
5.e.ctw.n....6. Effect of repeal or modification The repeal or rr.~•dification of any
provision of the Code of the City of Englewood by this Ordinance shall not r elease,
extinguish, alter, mod ify , or change in whole or in part any penalty, forfeiture , or
liability, either civil 11r criminal, which s hall h:1.ve been incurred under s uch provision,
and Pach provision s hall be treated a nd held as still remaining in force for the
purposes of sustr.ining a ny and all proper actions, suits, proceedings, a nd
proce-::utions for the enforcement of the penalty, forfeiture, or liability, as well as for
the pnrpose of suH taining any judgment, de cree , or orde r which can or may be
rendernd, e ntered , or mad e in such actions, suits, proce edings, or prosecutions.
~ ~ Th e Penalty Provision of Section 1-4-1 EMC s h a ll apply to
each and 12 very violation of this Ordinance.

In February of 1991, City Council adop ted Ordinance o. 11 , pertaining to en vironmental and Nuisance
Issues, including regulation of de relict and hobby veh icles . In November of 19 9 1, City Coun ci l app roved
Ordinance No. 63 , pertaining to regis tration and per mi tt ing of derelict and hobby veh icles. City Counci l
bri efl y dis cussed the iss ue of de relict and hobby ve hicles during the City Council mee ti ng on May 20, 2002 .

BACKGROUND, ANALYSIS , AND ALTERNATIVES IDENTIFIED
The CocJe Eniorcement Advisory Co mm ittee discussed ho bby and derelict vehicle regu latio ns at its May 1 5,
2002 meeting . A t staffs request, th e co mmitte e re co mmended re m ova l of hie $100 li ce ns ing fee fo r the
hobby/dereHct vehicle permit fr om the Englewood M uni cipal Code . The attached ordi nance addresses this
co nce rn by rem ovi ng the permitting requirements from Title 15, Chapter 9, Sec ti o n 1 of the Code.
FINANCIAL IMPACT
There is no financial impact ass ociate d w ith ad option of this ordinance, as the hobby/derelict ve hicle
licensin g iee section of th e Co de is no t currently b eing enfo rced.
