WHEREAS . the Environme nta l Protection Age ncy (EPA) Federal Industri al Pretreatm ent regulations and the Little/Engle wood Wastewater Treatment Plant CD PS permit iss ued by the State of Co lorado required the Little/E ngl ewood Wastewater Treatment Pl a nt program to re-eva lu ate the industrial discharge local limits by the end of February 2002 ; a nd WHEREAS , the technical eva luation was required to dete rmine if th e existing limits we.re protecti e a .. the plant operations, receiving stream {Platte River), bioeo lid s a nd worker health and •;afety; a nd WHEREAS , t he ~,,j<',ct was comp leted and s ubm itted to EPA for approval ; and WHEREAS , the EPA res ponded t ha t the nu 'll ~ers are technica ll y so und and were officia lly effe ctive May 31, 2002; a, WHEREAS , some of the ne w limits are less re s trictive while othe rs are more restrictive ; and WHEREAS , The Englewood Municipal Code Wastewater Utili ty Ordinance nee ds to be amend e d to re fl ect the new limitations; NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNC IL OF THE CITY OF ENGLEWOOD . The City Council of the City of Englewood hereby a pproves amending Title 12, Chapter 2, Section 7, Subsection B of the En glewood Municipal Code 2000 , whi ch s hall read as follows : B. Spec ial Co11d itio11 s Ma y Be Gra11ted: Industri al a llocations may be approved under speci al co nditions as determined by the City Manager or de signee. The maximum daily allowable industria l lo ading shall be allocated through significant ind ustrial user permits. The total loading to all permitted industrial users shall not exceed the level s pecifie d below . Changes in local limits due to increa sed or decreased loading in the service area may cause a change in allocations granted under these s pecial conditions. Indus trial users s hall monitor and report daily flows as required by the wastewater contribution pe rmit. Allocations may be revo ked by the City and shall not be considered prop erty rights . Organic Compounds: Volatile organic compound semi-volatile organic compounds shn.ll be determined on a case by cu a~ basis using the Littleton/Englewood policy for local limits for volatile and semi-volatile compounds . The Littleton/Englewood policy shall re4oct EPA guidance on Development And lmplementation 0£ Local Discharge Limitations Under Th• Pretreatment Program and Best Available Treatment Technologies \BAT). E. Compliance \Vith Federal Act: When nece caary for compliance with the Federal Act for the achievement of technology-based offiuent limitations, the City Manager or his/her designee may exercise Best Profesaional Judgment (BPJ) in establishing effiuent limitations on a case-by-case basis for individual permits granted pursuant to Section 12-2-3. Technology-based effluent limitations based on Best Professional Judgment (BPJ) shall be made only for good cause and in the absence of Fcderb.lly promulgated pretreatment standards or local limjtations on di schat'!l:C, F. Effluent Limitaticns: Effluent limitations established through the exercise of Beat Professional Judgment (BPJ) shall be made after considering the availability of appropriate technology, its economic reasonableness, the age of equipment and facilities involved, the process employed, and any increase in water or energy consumption. -4- • • • • • • G. Safety Clauses The City Council here by find s, determines, aud dec la r es t hat this Ordinance is promulga te d under t he general police power of t he City of Englewood, t hat it is promul gated for the hea lt h, safety, a nd welfare of the public, and tha t t hi s Ordinance is necesoary for the prese rvstion of hea lth and safety ond for the protectio n of publi c co nveni ence and welfare . BACKGROUND , ANALYSIS, AND ALTERNATIVES IDENTIFIED The Environmental Pro tec ti on Agency federa l Industria l Pr etreatment regulations and the L/E W'NTP COPS p,,rmil issued by th e sl ate of Colorado required th e loca l Pr etr ea tm ent program to re- eva lu ate th e ind11slrial discharge loca l lim its by th e end of Febr ua ry 2002. The te chnical evalua tion was required 10 determ ine if th e existing limits were prot ec t ive of the plant operations, receiv ing stream (Platte Ri ve r), bi osolids and worker hea lth and safely. The proj ect w as complet ed and submilted 10 EP A for approval. The attached leller from EPA indicates lhe numbers ar e technically so und. Th ey were officially effecti ve May 3 1, 2002. All indust ri es that will be affected by th e changes were not,fi ~d in April 2002 . Th ey we re provided with the proposed chan fss and given 60 days Iv comm ent. No comments we re received. Th e new limitations mu st now be amended in lh e Wastewater Uli,ily Ordinan,e.
