Z3 INTRODUCED BY COUNCIL MEMBER ORAZULIS AN ORDINANCE AMENDING TITLE 1, CHAPTER 4, SECTION 1, SUBSECTION B, OF THE ENGLEWOOD MUNICIPAL CODE 2000, PERTAINING TO GENERAL PENALTY -NO JAIL SENTENCE FOR JUVENILES. WHEREAS, the Englewood Municipal Court doe s not have the jurisdiction under the State Constitution and Statutes to imprison defendants under the age of 18 years who are co nvicted of violating the Englewood Municipal Code; and WHEREAS, the Englewood Municipal Court doe s not have jurisdiction to sentence juveniles to imprisonment for violations of other Municipal Code violations, it therefore, cannot imprison those same juveniles for violations assoc1 ated with the op e ration of a motor vehicle; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: ~-The City Council of the City of Englewood, Colorado hereby amends Title 1, Chapter 4, Section 1, Subsection B, of the Englewood Municipal Code 2000, to read as follows: 1-4-1: General Penalty, A. Fine; lmpriso,iment: It shall be unlawful for any person to violate, disobey, omit, neglect, refuse or fail to comply with or resist the enforcement of any provision of this Code or any secondary code adopted herein. Except as otherwise specifically provided for in this Code, the violation of any provisions of this Code or of any secondary code adopted herein shall be punished by a fine not e xceeding five hundred dollars ($600.00) or imprisonment for a term not exceeding one hundred eighty (130) days or by both such fine and impriconment. The imposition of one penalty shall not excuse any violation nor permit it to continue. Unless otherwise indicated, a separate offense s hall be deemed committed upon each day or portion thereof during or on which any violation of any provision of this Code• or any secondary code adopted he rein occurs or continues. D. Every person co nvicted of a vio lation of any provision stated or adopted which is de signated as a "t rnffic infract ion " and fo r whic h n pe nalty is paid or payable at the "Traffic Violations Burea u" s ha ll be punished by a penalty not exceeding one thousand dollars ($1,000 .00). There sha ll be no imprisonment for traffic infractio ns. ~-Safety C)auses The City Council hereby finds, determines, and declares that this Ordinance is promulgated unde r the ge neral police power of the City of Englewood, t hat it is prcmu.l.goted for the healt h, safety, and welfa re of the public, and that this Ordinance is necessary for the preservation of hea lth and safety and for the protection of public co nvenience and we lfare . The City Cou ncil furth er determines that the Ordin ance bears a rational relation to the proper legislative object sought to be obtained. ~-Seve rabilitv If any clause, se ntence , paragraph, or part of this Ordinance or the application thereof to any person or cu-c um stances shall for any ren i:i nn be adj udged by n co urt of co mpete nt jurisdiction invalid, s uch judgment shell not affect impair or invalidate the remaind e r of this Ordinance or its application to other perso ns , ,r circ um stances. ~ In co nsistent Ordinances All oth er 0l'd.inances or po rtio ns thereof in co nsiste nt or conllicting with this Ordinance or any portion hereof are hereby repeal ed to the extent of s uch inconsistency or conflict . .5.es:tianJi Effect of repea l or modification The repeal or modific atio n of any provision of the Code of the City of Englewood by this Ordinance s hall not release , exting\l.i sh, alter, modify , or change in whole or in port any penal ty, forfeiture, or liability, either civil or crimi nal , which shall have been incurred und e r such provi sion, a nd each previs ion s hall be treate d a nd held as s till remaining in fo rce fo r the purposes of sustaining any and all proper actions, suits, proceedings, and prosecut ions for the e nforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustainin g any judgment, decree, or ord er which ca n or may be rend e red, entered, or made in s uch actions, s uits, proceedings, or prosecutions. ~ &nal.l,x.
