HomeMy WebLinkAbout2002 Ordinance No. 051• • • ORDINANCE No.5/_ SERIES OF 2002 BY AUTHORITY COUNCIL BILL NO. 45 INTRODUCED BY COUNCIL MEMBER WOLOSYN AN ORDINANCE AMENDING TITLE 12, CHAPTER 2, SECTION 3, PARAGRAPH B, SUBSECTION 8, OF THE ENGLEWOOD MUNICIPAL CODE 2000, ESTABLISHING AN INCREASE IN SEWER RATES AS RECOMMENDED BY THE ENGLEWOOD WATER AND SEWER BOARD . WHEREAS, the Stale Health Depa rtment and Water Quality Control Cc.mmission have increa sed the re quirements for discharge into the South Platte River; and WHEREAS , th ere has been a growth of population in the area , ,rved by the Wastewater Treatment Plant that is nearly double growth proj , ,tions and which requir es an expansion of the Plant ; and WHEREAS, Englewood 's share of the cos t o { these improvements is fifty -five percent (55 %) of 110 million dollars ; and WHEREAS, in reviewi ng th e financing alternatives, it was detennined that a twent y percent (20%) rate increase is needed to cover existing debt so that new bond s can be issued to cover the cost of the expansion ; and WHEREAS, at their September 10, 2002 meeting , the Water an d Sewe r Board re com mended a twenty percent (20%) increase in sewe r services charges to cover the i:ost, effective January I, 2003 . NOW , THEREFORE , BE 'T ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORA DO, AS FOLLOWS: ~aJ. Title 12, Chapter 2, Secti0n 3, Paragraph B, Subsection 8 of the Englewood Municipal Code 2000 sho!I he,eby be amended to read: 12-2-3-B-8: Fees and Chnrg.-;. (B) (8) The rates on Exhibit A attached heret o and incorpor ated herein by reference shall become elTective January I , 2003 . ~2. Safety Clau ses . The City Council hereb y finds, determines, and declares th at this Ordinance is promulgated under th e general police power of the City of Englewood , th at it is promulgated for th e health , safe ty , and welfare of the public , anu that this Ordinance is ne cessary for the pre scl'.'v~tion of health and safety and for th e protecti on of public co nvc nie,1 cc and welfare . The C ity Counc il funher determine s that th e Ordinan ce bears a rational rel ati on 10 th e prop er le gisl ativ e objec t sought to be ob tained . -1- 11 bi ~ SeverabiJjty If any clause, sente nce, paragrapb, or pan of this Ordinance or the applicatio n thereof to an y person or circums tance s shall for any rea son be adjudged by a court of competent juri sdiction invalid , such judgment shall not affect , impair or invalid ate the remainder of this Ordinance or it application to other persons or circums tance s. ~-Inconsistent Ordinances , All other Ordinances or portions thereof inconsistent or conflic ting with thi s OrdinRnce or any portion hereof arc hereb y repealed to th e e,tent of such inconsi stency or conflict . ~-Effect of repeat or modification , The repeal or mod ification of any provision of the Code of the City of Englewood by thi s Ordinance sha ll not rele ase, extinguish , alter, modify, or cha nge in whole or in part any penalty, forfeiture , or liability , either civil or crimina l, which shall have been incurred under such provision , and each provision sha ll be treated and held as still remaining in force for the purposes of sustaining any and all proper actions , sui ts, proceeding s, and prosecutions for the enforcement of the penalty , forfeit ure, or liability , as well as for the purpose of sustaining any judgment, decree, or order which ca n or may be rendered , entered, or made in such actions , sui ts, proceedings, or prosec uti ons . ~-.f.enl!l!y. Fonda, Director of U til ities COUNCIL GOAL AND PREVIOUS COUNCIL ACTION Th e last sewer ra te increase was es tabli shed in 1982 by Counci l Bill #56. The proposed in crease provides reven u es to build faci liti es needed to mee t Fede ral requirem ents and provide additional plant capacity. RECOMMENDED ACTION Th e Engl ewood Water and Sewer Board re commended, at their Sep tember 10, 2002 m ee ting, Coun ci l app rova l of the proposed ordinance. The in crease in sewer services charges will be 20% effecti ve January 1, 2003. Staff recommends that Council sched ul e a Pub lic Hearing for October 7, 2002 to gather in put o n th is proposed ordina nce . BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED The Bi-City Wastewater Tr ea tment Plant will requ ire a major expans ion of th e existin g facil ities and construction of add it ional treatm ent processes. The proposed ra te in crease w ill pay for in c reased costs resulting from th ese requirem ents . The new cons truction is necessary lo accommodate rece nt denitrification req uirements impo,:~ by th e State H ea lth D epartment. Additi onall y, the So uth Platte River has recently been ret 1assified as a Recreational Class I ri ver which req ui res inc reased pathogen destru ct ion. Th e plant expan sion ~ortion of th e projec t is th e resu lt of rapid growth in th e area served by th e plant. Growth has been nearly doubl e th e projecti ons used in plan ning th e last expansion . The project is currently bei ng designed by Brown & Cauldwell Consu lting Engineers . It is estimated that the total cos t of th e project w ill be $110 million, of w hi ch Englewood will be re sponsible for 55%. Design sho ul d be completed by the first quarter of 2004, and at th at time bids should be re ceive d for constru ction. Constructi on is expected to take about th re e years to complete . FINANCIAL IMPACT In order to finance th is const ruc tion, th e firm of Black & Veatch was retai ned to analyze financing alternatives . It was determined that a bond issue in the range of $55 to 60 million dollars would need to be iss ued. It is proposed that th is issue b e concurrent with the receipt of the bid. Sewer rates will need to be increased to pay th e p rincipal and interest o n the n ew bonds. Bla ck & Veatch is c urrentlv ~•'ljecting th at a rate in crease of 20% is c urrently needed to show adequate cove rage on our existing dabt prior to the issuance of th e new bonds. Upon issu ance of th e new bonds, th ey are projec ting rate increases of about 13 % to 15 Yo for the next four years to meet coverage requirem ents of the bond issue . This is shown in the cash flow attac hed to th is c ounci l c ommunication. Council will be approached for subsequent rat e in creases al the time the bonds are issued in 2004 when th e exact cos t of th e project is known.
