MANAGEMENT AGKEEMENT
THIS AGREEMENT is made and entered in,o this ___ day of _____ ~ 2002
by and between the City of Englewood. Co lorado , ilereinafte r ca lled the "City" and the
Englewood Housing Authority, hereinafier ca lled the "Authority".
WHEREAS, the Authority has a commirment to provide housing to low and moderate
income families within the City of Englewood ; and
WHEREAS , as par. of its normal functions and operations , the Authority has the
capabili i y of providing property management services fo: a variety of rental hou sing pro grams ;
and
WHEREAS , the City wo uld like the Authority to manage certai n properties owned and
currentl y rented by the City, namel y. 29 31 South Franklin rreet , 235 7 West Wesley Avenue, and
23 99 West Wesley Avenue, Englewood , CO 80110 .
NOW , THEREFORE , in consideration of th lt~.I terms , co ndit ions, covenants and
provisions hereinafter se t forth , the City and the Au th e, ny agree as follows:
I. The Authority shall assume the re sponsibility for managing the properties held
by the City . These responsibilities sha ll include :
a. Tl!nant screenin g (c redit and crimi nal) und sele ction :
b. Esmb li shin g security deposit , pet deposit and rental amounts , as nec essa ry
in cooperation wit h the City ;
c. Si gning leases , collecting rent s and forwardi ng ren tal payments to the City;
d. Enforcing lease provi sions and taking necessary actions for lease vio lations ,
provided that any nl!cessary legal actions in excess ofSS00 1vill re~uire
consultation with and appro val by designated City representatives in order to
proceed with said le gal actions ;
e. Providing maintenance and repair on property as necessary, provided th at
any wo rk items in ~xce ss of SS00 per month will require consultation with
and approval by desig nat ed Ciry representatives in order to proceed with said
mainten ance and/or repair :

2. Manageml!nt rcpons will be submitted on a regular basis from the Aut hority to
the City .
3. In rerum fo r management service s provided 10 the City by the Authori ty, the
Authorit y sh:1II recei v~ :is it s compensati on a month ly fee to be determined by
murual agreement of the City Mar.ager and the Ex<cu ti ve Director of the
Englewood Housing Authority (currently S30 per unit per month}, plus the ac raal
time and mntcri o.1s cos ts as socia ted with lh e mana ge ment of said propertie s, ns
detailed in Section I.a ., l.d., and l.e of this Agreement, to be bi lled on a
monthl y basis .
4. This Agreement shall be a contrJC' unde r the law s of the St ate of Colorado and
shall be binding upon and sha ll in u, e to th e benefit of the City and the Authority .
5. No waiver of any of the provisions of the Agreement shall be deemed or
con stirute a waive r of any other provision herein, nor sha ll such waiver constitute
a conti nu ing waiver of default hereunder or dee med a waiver of any subsequent
defa ult hereunder.
6. Thi s Agreement may be terminated by either party with a 30-day wrinen notice,
in which case the Authority will provide to the City a fi nal billing for time and
material s or other related ex penses within 30 days of the termination date of this
Agreement.

West Wesley Avenu e.
BACKGROUND
The Park s and Rec rea tion D epartment acq uired the 293 1 South Frank lin property in September of
1991 through a donation from a p rivate citizen . Rent recei ve d on this property is prese ntl y
$1 ,000/m on th . Th e En glewood H ousing Authori ty curr entl y provides management services for the
Frank lin pruper • but no formal agr eement is in plac e for th ese serv ices. Th is agre ~ment will
formali ze EHA ·, ag ree ment o n th e Franklin prope rty, and add th e managemen t of th e West Wes ley
properti es .
Through th e H ousing Rehabili tati o n Fund (HRF ), th e City ac quired thre e residen ti al properties on
2357, 2357½ and 2399 West W esl ey Ave nu e in November of 2000 fo r eve ntual resi dential
rede ve lo pment. Th e home at 2399 West Wes ley is currently occupi ed, 2357 is vaca nt and 2357 1/,
West W es ley is vacan t and in habitabl e due to maj or di srepa ir an d code vio lati ons . Th e HRF
receives reve nu e in th e amount of S 1000/month for rent fo r th e 2399 W est Wesley prope rty.
ANALYSIS
Si nce acquiring th e W es ley prope rt ies, sup erv ision of th e property ha s been m nage d by
Commu nity Deve lopm ent staff. While thi s manag ement has bee n adequate, CD staff is not
professionall y train ed, nor do th ey have th e necessary res ource s to properl y manage these homes.
EHA has professional staff and man agement in place to assume this responsib ili ty and is cu rr ently
managi ng th e Franklin prope rty to th e City's stand ard s. Sinc e EH A is bett er equipped to handle
pro perty manageme nt services, it is th e desi,e of th e Commu nity D eve lop ment departm ent to
transfe r manag ement of these properties to EHA per the att ac hed contrac t.
FINANCIAL IMPACT
Thi s ag reement calls for EHA to receive $30/per month per property fo r management services . Any
additional repa irs or improvements to the homes 'NO uld be the financial responsibility of the City, as
Is currently the case. It is anticipated that two of th e thr ee Wesley properties, and th e Franklin Street
pr operty will continue to generat e reve nu e. The sm all er 2357 ½ West W esley house will be left
vaca nt, pend ing a redevelopment decisi on o n th e W es ley properti es as a whole. The 2003
Community Development and Parks and Re creation budge ts in cl ude funding for th ese manage ment
and maintenance fees .
