AN ORDINANCE APPROV I GAN INTERGOVERNMENTAL AGREEMENT (!GA) FOR
MUTUAL AID BETWEEN FIRE DEP ARTMENTS .
\VHERE AS , thi s intergovernmental agreement to provide functions for services,
in cludin g the sharing of costs of suc h services or functions, by political su bdi vi sions of the State
ofColorndo, is speci fic all y authorized by Section 29-1-203 C.R.S; and
WHEREAS, each of th e partie s hereto maintain emergency equipment; and
WHEREAS , eme rgencies ma y arise in one or another of the jurisdictions of the parties,
resulting in greater demnnds than the personnel and equipmen t of that part y can handle , or
emergencies of such imcnsity ma y occur that the y cannot be handled by th e equipment of the
party in whose jurisdiction the emergency occurs; and
WHEREAS , it is in the be st interest of each of th e partie s th at it ma y have service to and
fr om th: other pan·ies to aid and ass ist it in th e purpose of fighting fires or re sponding to ot her
emergencie s; and
WHEREAS , other panies who provide simil ar serv ices and main tain simil ar equipment
may in the future de sire to be included in thi s agreeml!nt ; and
WHEREAS, estab lishment of a mutual aid agreement wi ll serve a public purp ose nnd
will promote th e safe ty, secu rity, and generJI we lfare of the inhabitants of the panics.
NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF E GLEWOOD , THAT :
Section I . Cit y Counci l of Englewood, Colorado , hereby approves the
Int ergo vernmenta l Agree ment for Mutual Aid Bct\Vccn Fire Depanment s, a copy of which is
attac hed hereto and incorporated herein by reference .
Section 2. The Mayor is hereby authorized to sign and the City Clerk to attes t said
agreement for and on behalf of the Ci1y of Eng lewood .

WITNESSETH THAT :

WHEREAS . intergove rnmental agreements to provide fun ctions or serv ice s,
including the sharing of costs of suc h services or functi ons, by political subdiv isions of the •
State of Colorado are spec ificall y authorized by ection 29 -1-203 C.R .S. (1986); and
WHEREAS. the panie s he reto are each aut horized to lawfull y provide , establish ,
maintain , and o perate firefighting and other emerge ncy services; and
WHEREAS, each of the panies hereto maintain emergenc y equipment; and
WHEREAS , emerge ncies may ari se in one or another of th e juri sdictio ns of the
parties, resulting in greater demands than the personnel and equipment of that pany can
handle , or emergenc ies of such intensity may occur that they cannot be handled by the
equipment of the pany in whose jurisdiction the em:rgen cy occurs; and
WHEREAS , it is in the best interest of each of the panic s that it ma y ha ve service of
and from the other parties to aid and assist it in the purpo se of fig hting fires or responding to
oth er emc;:rgencit!s: and
WHEREAS . other parties who pro vide similar services anc O',Jintain similar
equipmen t ma y in the fu tu re desire to be included in this agre ement ; and
WHEREAS . establishment of a mutual aid agreem ent will se rve . :iub 1;.; purpo se and

NOW THEREFORE , IT IS MlITUALL Y AGREED by and between each of the
partie s as fo ll ows:
I. Provis ions of Article 5, Titl e 29, the Colorado Revised Statutes, as amended,
arc inco rporated here in by th is re ferenc e. The statute shall co ntrol in the event
of u co nfli ct between the statute and this agreement.
2. It is understood and agreed that this Agreement would prov ide fo r the joint
exerci se by the partie s of the function or service pro vided herein , but wo uld
not establi sh a separate legal entity to do so , nor wou ld it co nstitute any p4rt y
ts an agent of an y other part y fo r any purpose what soever. This Agreement
shall provide only for sharing of in-kind services and costs by the panies
toward the establi shment of a com on mutual goal.
3. For and in co nsiueration of the promises of each participating party set forth ,
each agrees with each of the others that in the event that there are fi res or
Of '.•~r emergencies in the territu ry served by one party which are beyond the
c, ,r.rol of the Fire Department of th at party: whether bec ause of use of its
equipment at other places, or whethe r be ca use of the inten si ty of the
emergency or otherwise, each agrees , subject to the limitations herein set
forth. to aid and assist the other, by causing and permitting their Fire
Department and its equip ment to be used in responding to emergencies in the
territorial urea of any of the others, and the need fo r .suc h 'aid and assistance
shall be dete1111ineu by the Fire Department requesting assistance , subject
~owe ver. to tht! fo ll owing limitati ons:
An y of the agreeing ~anies shall be excused from making its equipment or
ser vice available to an y of the other , in the event of the need of the eme rgenc y
equipment o, need of the perso nnel of such party within the territorial area of
such part y or an y other part y, or their prio r use at any plac e, or in the event
that the 1e1111s of the UJ,icle seven apply , which decision of availability shall be
mad e by the Fire Depo.rtment requeste I to give mutual aid , in the exerc ise of
its sole discretion . wh ic h decision shall be final and conclusive.
b. It is unde rstood and agreed that each :,arty's performance shall be subject to
Jppropriation of funds by its City Col'ncil or other le gisla ti ve body , and
pa yment of such fu nd s int o the treas ury of suc h party .
c. Mutual aiJ response by an y part y be yond the political boundary ~-f the
responding pa rty is hereb y deemed to be app roved by the respecuve ;: .o.utive
and Legi slati ve go verning bodie s and Fire Chiefs of the panies, ar.d suc h
re spons ,, shall re4uire no further appro val by respons ible o ffl ci als of an y

4. Eac h part y shall, at all times . be responsib le fo r its ow n costs incurred in the
perfo rmanc e of thi s Agreement. and shall not recei ve any reimb ursement From
any oth er part y, except fo r third part y rei mbursement un der Article 9.
5. The extent of the mutu al aid period. (as measured Fro m th e tim e of dispatch
for reque st of mutual aid) will be 12 hours unless exte nded by an addi tional
agreement between parties.
6. Each party ro the extent pe nnitred by law , waives all claim s and cau ses of
acti on ag ainst all of the other part ies fo r compensa tion (excep t as set forth in
Article 9. below ), damages. perso nal injury or dea th oc curring rs a
con seq ue nce , direct or indirect, of the perfo nn ance of this Agree ment.
7. Each part y shall be ex pected to maintain its eq uipment and orga nize its
emergenc y resp onse method wit h both pe rson nel and eq ui pment to the degree
necessary to cope with the ordinary and routine e me rgen cies arising wi thin its
boundari es and for which the part y is organi zed. No party shall expect any
othe r to respo nd to emerge ncy cal ls where the emergenc y ari ses due to a
failure to organize avai lable personn e l or mai ntain equipment in pro per
wo rki ng order an d in suffici ent qua nt ity to meet the res pecti ve demands of the
person s and propert y within each of the parties · re spective jurisdicti ons.
8. Eac h part y .,grees to all ow any other munic ipa l or quasi-muni cipal fire
departm ent to joi n in this Mutual Aid Agreeme nt afte r fo rmal approva l by its
governing bod y and notificat io n of such action to ench of the Other parties to
th is Agree ment. Each part y sh all exec ut e suc h amendme nts, as may be
necessar y in the future to acc ommodate the joining of ne w partie s to the
Ag reement. without change of any other terms or con dit ions of th e
Agreement.
9. Each part y agrees that , for each call occurri ng withi n its jurisdictio n, for
wh ich it has reque sted mu tu al aid. it will re aso nab ly pu rsue any and all legal
reimbursement possibie , purs uant to state or fei >ol law s, incbding but not
li mited to re imbursement fo r ha zardo us materials inci dent s, oc curring within
its jurisdictio n. on beha lf of all part ie s respo nding and, UJO<i full or partial
pa yment by th e responsib le entit v, will distribute the re imb ursement received
in a fair and equitable manner 10 assis ting parties based on th ei r re lat ive
docume nte d expen ses for the involved incident .
10. Nothing cont ained in th is Agreemen t, and no performa nce under th is
Agreement by perso nn el of the parti es he reto shall in any respecr alter or
modify the status or offi cers . age nts. or emplo ye es of the re spe cti ve parties for
purpose s of wo rkers· co mpe ns at io n or their benefits or ent it le men ts . pen sio n,
levels or types or trair ing. inrem "I discipl ine . cem tic auon. or ran k proc edure s.

employmenc. Work ers ' Compensation Coverage shall be as structured in
C.R.S . 29---I09 .
It is unde rs 1ood and agreed by the partie s hereto that if any part , term or
provisi on of chi s Agreement is by 1he courtS held 10 be illegal or in conflict
with an y law of lhe Smee of Colorado. 1he validi 1y of the remaining portions
or pro visio ns shall not be affected, and the rights and obligacions of 1he parties
shall be co nslrued and enforced as if 1he Agreemem did not contain the
particular part , 1erm, or prov isio n held to be invalid.
Each and every lerm , prov is io n, or co ndi1ion herein is subject to and shall be
construed in accordance wi1h 1he provisions of Colorado law, the Charters of
the vario us parties , and 1he ordinances and regulations enacted pursuant
thero ~o.
13 . T'-,i, Agreemem shall be binding upon the succ~ssors and assigns of each of
::,. parties here10, except tha1 no part y may assign any of its rights or

14. It is exp.,,ssly unders 1ood and agreed that enfoxement of the terms and
condi 1ions of chi s Agreement, and all rights of action •relating to such
enforcemem, shall be strict! y reserved to the named parties hete10 , and
nothing co ntained in this Agreement shall give or allow any such claim or
right of ac1 ion by an y ocher or 1hird person on such Agreement. It is the
express imemion of 1he named' part:es that any person other 1han the named
part ies receiving service s or benefi1s under chis Agreement shall te deemed to
be an inciden tal beneficiary onl y.

16 . Thi s Agreemenl shall be execu1ed in fif1y-1hr ee (53) counlerparts, each of

17. V1riou s part ies to chis Agreement may be parties to previously existing
Mutual Aid Agreemen1s whic h are more detailed and specific lhan this
Agreement . In su.:h an event . an y pre -existing Mutual Aid Agreements and
the 1erms !hereof, between any of 1hese partie s shall be considered the prim ary
agreemem be1ween 1:10se partie s and shall have pri ority o, er chi s Agreement.

CO UN CIL GOAL ANO PREVIOUS COUNCIL ACTION
City Co un ci l des ires to seek regio nal coopera tion w heneve r possible, especia lly in the Denver
metropolitan area. In 1990, Co un ci l ap proved a simi lar agreemen t between a number of area fire
departments for mutual and cooperati ve aid ; an agreement that is currently still in effect.
RECOMMENDED ACT ION
It is recommended that Council approve an updated inte rgovern mental ag ree ment between
Englewood and a mul titud e of oth er metropolitan and regiona l fire departments, for th e pu rp oses of
efficiency, cos t effectiveness and rapid cooperati o n in respons e to natural and/o r ma n-made
disasters or acts of te rro ri sm.
BACKGROU ND, ANA LYSIS, AN O ALTER NATIVES ID ENTIFIED
All pre vious safeguards remain , especiall y in the areas of c.:,st shar in g, liab ility, ad indi vi dual fire
department operati o nal standa rds. This updated agreement primarily is in tende d to reflect d,an ges
in th e structura l components of many of the agencies involved, as well as a desire to reinforce
cooperati ve effo rts in an era of increased homeland security needs.
