RECOMMENDED ACTI ON Staff recomm ends th at Coun ci l app rove th e amend ed proposa l fo r th e U ni ve rsity Ho mes Plan ned Unit D eve l~pm ent w ith th e fo ll owing conditions: 1. A Homeowner Assoc iation shall b~ fo rme d and docum ents pertainin g to th e Associa tion be file d agains t all p roperti es w ith th e A rapa hoe Co unty Clerk. 2. A recorded copy of th e H omeowner Assoc iatio n document sha ll be provided to th e Ci ty. CRITERIA FOR APPROVAL In approvi ng a Plann ed U nit Deve lop men t, Ci ty Counr.i l r.1u st fi nd th at th e proposed PU D m ee ts five criteria. Th e crit er;a and fin dings fo ll ow: I . The PUD Dis trict Pla n is, or is no~ in conforma nce with th e D istrict Pla n require ments an d th e Comp rehensive Pla n. The pro pose d U niversi ty H omes PUD is in conformance wi:h th e ap pli ca bl e ,quirem ents se t fo rth in Sectio n 16-4-15: E 3 e PU D Distric t Plan. Furth er, ii is co nsist ent w ith th e 1979 Comprehensive Pl an, wh ich identifies th e subj ec t prop erty as low density res id enti al. A cours e of ac ti on stated in th e Pl an sugges ts th at w ithin res ide ntia l neighb orh oods "The lot area, lot coverage and se tback requirement s should be made mo re fl ex ibl e to permit m ore in novative deve lopm ent and bett er use of the land." 2. All required documents, drawings, referrals, recommen da1ions, ancl approvals have be ?n received. All appropriate docume nts concerning th e proposed University Homes PUD ha ve been received and approved. 3. The PUD District Plan is consistent with adop ted and generally accep ted standards of development in the City of Englewood. The proposed PUD District Plan is consis tent with accepted deve lop ment standards estab li shed by th e City of Englewood as outlined during the pubi c hearin g. 4. The PUD District Plan is substantially consistent with the goals, objectives, design guidelines, policie s and any other ordinance, law or requirem ent of th e City. Th e proposed University Homes PUD District Pl an is in co nforma nce wi th all oth er ordinances, laws and req uir emen ts of th e City. 5. When the PUD Dislrict Plan is within th e Englewood Downtown Development Auth ority (EDDA) area , the Plan is co nsistent with th e EDDA approved designs, policies and plans. This criterion is no longe r applicable to PUD cons id eration . FINANCIAL IMPACT: The City would realize in creased property tax revenue based on the assessed va lu e of fo ur new homes compared to th e val ue of th e vac~nt parcel. Es tabl ish in g a maxi mum build ing height by the number of "st ories", could all ow the hei ght in the PU D to vary grea tl y. Th e term "story" does not defin e the ce ili ng height in fee t and there fo re th e story could ha ve an unlimited ce iling he ight. Usin g a specified number va lu e to establish a maximum building heig ht set, th e upper limit of th e stru ctur e no matter the how man y "stori es" are contain ed wi thin th e building.
