Section 7. Effect ofrepenJ or modificatjon Thn repeal or modification of any provision
of the Code of the City of Englewood by this Ordinance sha ll not release . extinguish . niter,
modify , or change in whole ot in part any penalty , forfeiture , or liab ility , either civil or criminal,
which shall have been incurred under such provision, and ,:nc h provision shall be :rented nnd held
as still remaining in force for the purposes of sustainin g any and all proper actions , su its ,
proceedings, nnd prosecution s for the enforcement of the penalty, forfeilllre, or liability , as well
ns for the purpose of sus taining any judgment , dec ree , or order which can or may be rendered ,
entered , or made in such actions, suits , proceeding s, or prosecutions .
Section 8. Penalty . The Penalty Provis io n of Section 1-4-1 EMC shall apply 10 each and
every violation of this Ordinance .

the cla rity of th e lang uag e in the proposed Ordina nce rev ision specific to th e multiple way, the
lan~uage could be interpreted . The Pl anning and Zon in g Commiss io n voic ed the ir apprnhension
due to the restr ic ti ve na ture of the proposed definition of "F amil y/Househ old" w hich will allow only
thre e (3) un related peo pl e to li ve toge th er as opposed to th e current definition of "H ouse hold "
w hich Jll ows eight (8). Comments were derive d on a poten ti al li ving con dit io n that may include
ind ividual ·'g roups" oi people that include two or more pe ople unrelated by blood , marriage,
adoption, or lega l guardia nshi p, including foster children li vi ng tog ether in a singl e uni t dwelling.

BACKGROUND
The number of unrelated people allowed to live toge th er in a house hold was establis hed in 1999 to
co incide with the number oi unrelated people allowed to Ii e together in a group li vi ng faci lity. The
ct:rrent defi nition of Hous ehcld addresses thre e ca tego rie s oi living arrangements : (1) rela ted
peo ple, (~) unrela ted people. and (3) unrelated people and their ch ildren :
Existing Definition :
A househo ld includes ( 1) or more pers on1 relat ed by bl ood, ma rriage , adopti on, or
legal guardia nship, including foster chilJren, toge ther in a dwelling unit: or (2) a
group of not more than eight persons not related by bl ocd, marriage , adopti on, o r
legal guardians hip li ving toge the r in a dw elling unit, provi ded that such group does
not me et th e definition of do rmit ory; or (3 ) two unrelated persons and the ir children
livi ng together in a dwelling unit.

During discussion , it was noted tha t the ave rage number of unrelated peopl~ allowP d to li ve
toget her in jurisdictions th roughou t th e metro area and co mparable populated cities w ithin th e sta te
is 3.38 . This average numb er excl ud ed th e City of Englewood , which currently all ows eig ht (8 )

unrelat d people to occupy a residence, the City of Westminst er, which has no se t lim itati on, and •
th e City of Lakewood . w hi ch all ows one ( 1) per habitable room.
After review of the findings , Counci l defined two objec ti ves. The fi rst objective is to update th e
defi niti on of "Household" to "Far.1i ly/Househ ol d", and crea te co nsistent langu age w ithin ntle 9
Housi ng Regu lations, Title I 6 Zor.ing Regulati ons, and th e 1997 Uniform Bu ilding Code Section
207-F. Th e second objective is to revise the exis tin g lan guage that restricts the number of unre lated
people living in a dwelling uni t fro m eigh t (8) pe ople to three (3) peo ple. Co un cil reques ted th at
th e number of unrelated peop le all owed to li ve toge th er in a dwelling unit be ba sed on th e average
number of 3.38 to be co nsisten t w ith the me tro area ; and be estab li shed at a max imum of three (3).
During discussions of the proposed amend ment , concerns we re exp ressed abo ut the poten ti al
impact that th e proposed change woul d have on Group Living facili ti es . It sh oul d be noted tha t
alth ough the term Househ old is proposed tc · e amended to Family/Household, Gro up Li vi ng
Facility us es are excl uded from the proposed detir,i tion . Gro up Living Facilities are regu lated by 16-
4-23-1 oi the Co mprehen si ve Zoning Ordinance, and must ad here to those prov isi ons .
During th e Nove mb er 4, ~00~. City Co un cil stud y ses sion discussion rega rdi ng the proposed
re visions , memb ers of City Council exp ressed concerns with the number of unr ela ted people
allowed to live in a si ngle-familv unit. Coun cil noted that the Planning and Zoni ng Commission
amended staff's recom mended numb er of unr ela ted people allowed to live toge th er in a si ngle-
famil y uni t. The change was from ( 1) one or more persons re lated by blood, marriage, adoption, or
lega l gua rd ia nship, in cludi ng fo;ter children, together in a dwelling unit; or (2) a gro up of not more
th an three persons not related by blood, marriage, adopti on, or legal gua rdian ship living together in
a dwell in g un it, provided that such group does no t meet the de fi niti on of dorm itory, to th e •

Members of Ci ty Co uncil, after contact with ci tizens in th ei r res )ecti ve distric ts , noted additi onal
concerns wi th parking and the number of vehicles on th e street. Additi onally, Ci ty Counci l vo ice d
concerns abou t the poten tial of "fo r rent rooms" in the R-1 Single -Famil y Re si dence Districts w hich
arc prohib ited per th e zo ning reg ulations. During this discuss ion, City Council , by co nsens us stated
the y would prefer to limit the nu mb er of unrelated people allowed to live in a sing le-fami ly unit to
no more th an two (2 ) pe opl e and th eir chi ldren . To help mitiga te the growi ng co mmunity concerns
regardin g occupa ncy li mits, Counc il set th e 1" Rea din g on th e proposed amendments for
N ovember 18, 2002 .
ANALYS IS :
The first Council obj ective was to un ify and pr ov id e cons iste ncy between th e definition of
Fa m il y/Househo ld thro ugh o ut Title 9 H ousi ng Reg ulati ons , Titl e 16 Zo nin g Regulations, and th e
199 i Uniform Building Co de Section 207-F. Staff believes that this o bj ec ti ve w ill be met regardles s
of th e lega l occupancy limits o f unrel at ed peo pl e in a si ngle unit dwelling.
Th e seco nd objec ti ve was to brin g the Ci ty of Englewood co nsist ent with other jurisdictions in tl,e
metro area and si milarl y sized ci ti es in the state w ith regar ds to the number of unrelated people th at
ll'ay occupy a dwelling unit. Staff believes the ori gi nal recomme ndati on of all owing not more than
three (3) unrelated peop le to li ve in a single unit dwe llin g accomp lishes that goal.

8 , 2002, in the City Council Chambers of the Englewood City Hall.

Testimor.v was received from staff. The Commission received notice of Public H ear-
ing, and the Staff Re port, which were incorporated into an d made a part of the re-
cord of the P ublic Hearin g.
Afte r considering the statements of the witnesses, and reviewing the pertinent
documents, the members of the City Planning and Zoni ng Commission made the
following Findings and Concl usio ns .
FINDINGS OF FACT
1. THAT the public h earing on the prop ose d amendmen t of th e Englewood Mu-
nici pal Code , T itle 16-8-1 , was bro ught before the Commission as a di r2 ctive
of the City Attorney's Office.
2. THAT notice of the Public Hearing was pu blished in t he Englewood Herald
on September 20 , 2002 .
3. THAT the request is t o amend the definition of •Ho usehold' to include •}'aru-
il y/Household", and to reduce the number of unrelated persons allowed to live
together a s a "family' or "household" from eight individuals to no more than
three.
CONCLUSIONS
1. THAT the proposed amendment to Title 16-8-1 of the Englewood Municipal
Code was initiated by the City of Englewood.
2. THAT proper notice of the Public Hearing was given by publication in the
Englewood Herald on September 20 , 2002.
THEREFORE, it is the decision of the City Planning and Zoning Commission that
Title 16-8-1 of the Englewood Municipal Code should be amended by modification of
the definition of "Household" and reduction of the number of unrelated persons al-
lowed to li ve together a. a "household'.
The decision was reached upon a vote on a motion made at the meeting of the City
Planning and Zoning Commission on October 8, :.>002 , by Mr. Welker, seconded by
Ms . Lathram, which motion states:

po pulated ci ti es w ith in the state is 3.38 . This ave rage numbe r excl uded th e City of
Engl ewood, whic h curren tl y all ows eight (8) unrelated p eo ple to occ up y a re side nce,
the Ci ty of Wes tmin ster , w hi ch has no set limi tation , and th e City of Lakewood,
wh ich all ows o ne ( 1) per habitab le room.
After review of th e findi ngs , Counci l defi ned two objec ti ve s. The first obj ec tiv e is to
updat e th e defi nitio n of "Househo ld " to "Fami ly/Hou seho ld", and crea te consi sten t
language w ithin Titl e 9 Hous in g Re gulations, Titl e 16 Zo nin g Reg ul at io ns, and th e
19 97 U ni form Building Code Sec tio n 20 7-F . The second o bj ective is to rev ise th e
exis tin g lang uage th at restri cts the number of unrelated peop le livin g in a dwe llin g
un it from eig ht (8) pe op le to thr ee (3) peop le. Coun cil req ues ted th at th e number
of unrelated peop le all owe d to li ve toge th er in a dwell ing unit be base d on th e
ave rage numb er of 3.38 to be consistent wi th th e metro area; and be es tabli shed at
a maximum of thr ee (3).

facili ties. It shoul d be noted th at alth ough the term Househo ld is proposed to be
ame nded to Family/Hous ehold, Group Li vin g uses are excl uded fro m th e proposed
defini tio n. Gro up Living Faci liti es are reg ulated by 16-4-23 -1 of the Comprehensi ve
Zo nin g Ordinance, and must adhe re to tho se provisions .
ORDINANCE PROPOSAL :
As proposed , th e amendme nt repla ces the term "Hou seho ld" with
"Famil v/House hold " red uci ng the numb er of unrelated peop le li ving together from
eig ht (8) to th ree (3) and elim inating the 3'' ca tego ry of two unrelated peop le and
th ei r ch ildren. Th e effect of the amendme nt is no more th an three unrelated peop le,
whe ther adul t or chil d ma y live to ge th er in a dwell in g unit.
SUMMARY :
Th e proposed Ordinance amendmen t p ro ides a consist ent defi nition of
Famil y/H ouseho ld throughout Tit le 9 Hou si ng Re gul ati o ns, Titl e 16 Zo nin g
Reg ulations, and th e 199 7 Uni fo rm Buil din g Code Sec tion ~0 7-F. Further, it b rin gs
th e City of Englewood consistent w ith othe r j uri sdictions in the metro area and •
simi larl y sized cities in th e state w ith regards to the allowed numbe r of unrelated
peo ple that ma y occupy a dwelling unit.
