WHEREAS . the Englewood Urban Renewal Authority ini t iated a Conditions Sw-vey and accepted the docll!Dentation of blig h t in the North Englewood Induatrial Redevelopment Area Conditions Survey , dated No vember, 2000 , conaiating of twenty- foW" pages and three exhibits a s presented to the City Co uncil : and WH EREAS, the Englewood Urban Renewal Authority initiated the North Englewood Industrial Re developm ent Plan. October, 2000, COllllisting of ten pagea , the "Plan", and accepted the recommendations to alleviate blighting conditions preaented to the City Council as part of the public hearing on the proposed Plan; and WHEREAS, the Englewood Urban Re new al Authority recommends t hat the Englewood City Council mnke a finding of blig ht based on t he Co nditiona Survey and approve the proposed P lan for t he W"ban renewal area described therein; and WHEREAS. Col orado State Statute provides that a City Council may approve the Plan if ii finds that t h e urban re newal area described in the Plan is a "blighted area" as defined in the Col orado Urban Renewal Law ; and WHEREAS, the City of Englewood has provided notice at least 30 days in a dvance of the Public Hearing by mail to all property ownen, residents, and ow ne rs of bll8ine u conce rns in tb e proposed urban renewal area de scribed in the Plan; and WHE REAS. the City of Englewood hall publis hed legal notice of the P ublic hearing at lea st 30 days in a dv ance of the Publi c '!earing; and WHEREAS, the Plan is consiste nt with Resolution 'o. 92, Series of 1999 ; OW, THEREF ORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EN GLE WOOD , COLORADO , AS FOLLOWS : ~-The City Counc.l of the City of Englewood , Co lo rado has reviewed the Co ndiaons Sur"ey the provisions of which are incorporated here in in their entirety, and the e,>i dence contained therein as pre sented at t he public hearing, and, based on such evidence. hereby finds and decla res that the proposed urban renewal area as deacnbed m the Pl un 1s a "blig hted a rea .. a s that term 1s defined in the Colorado Urb an Rene wal Law . • I - ~-The Englew City Council t,ereby approves the Plan and establishes an Urban Renewal Area for the purp011e of authorizing the Englewood Urban Rene al Authority to implement the Plan. ~-The Plan and a report containing the information required by Section 31-25-107(3.6) of the Colorado Urban Renewal Law was aubmitted to the Board of County Commissioners of the County of Ar apa.hoe prior to approval of the Plan. Sl:l:1i.lm...:1 -The boundaries of the urban renewal area described in the Plan have drawn as narrowly as feasible to accomplish the planning and development objectives of the urban renewal proJect described in the Pla.n. ~-It is not anticipated that any families and individuals will be displaced by t.he Urban Renewal Project, but if such displacement occurs, a feasible method emts for the relocation of indlviduals and families who may be displaced by the urban renewal proJect in decent. safe, and sanitary dwelling within their means and without undue hardship to s uch individuals and families . ~-It is not anticipated that any busineBS concerns will be displaced by the Urbil.ll Renewal Project, but if such displacement OCC\11'8, a feSBible method eriste £or the relocation of businesa concerns that may be displaced by the urban renewal project in the urban renewal area or in other areas that are not generally less de irable with respect to public utilities and public and commercial facilities . ~-The City Council has taken reasonable efforts to provide written notice of the public hearing required by the Urban Renewal Law to all property owners, residents , and owne rs of business concerns in the propose d urban renewa1 area at their last known address of record at least thirty days prior to such bearing. ~-No more than one hundred twenty days have pa88ed siuce the commencemer.: of the first pu bl c he aring on the Plan. ~-The Plan does no t contain property that was included in a previously au~mitred urban renews] plan that the City Council failed to approve. Section 10. The Plan conforms to the Comprehensive Plan of the City of Englewood. Section 11. The Plan affo rd s ma:rimum opportunity, consiste nt with the sound needs of the municipality a s a whole , for the rehabilitation or redevelopment of the urban renewal area by privat e enterprise. Sgctjon 12. Council adopted Resolution 92 , Series of 1999, acknowledging the affects of the transportation improvements on the land uses in the Santa Fe Corridor . RECOMMENDED ACTION: Community Development requests that Council schedule a publ ic hearing on Decembe r 1 B, 2000 to consider the Conditions Survey nd the Englewood Industrial Redevelopment Plan . Based on the Condition Surve y, staff requests that Council make a finding of "Bli ght." then adopt the Pla n, and establ ish an Urban Ren ewal Area for th e purpose of authorizi ng the Englewood Urban Renewal Autho rity to implement the Plan. • BACKGROUND : • After staff completed a study of the South Broadway corridor in March 1997 , our attention turned to the Light Rail and South Pia River Corridor . The General Iron Works site, which was posted for sa le at the time , re'.)resented a large redevelopme nt opportunity on the corridor. A series of public meetings were held in north Englewood with area businesses and res idents. Res idents discussed neighborhood traffic and land use issues. A brief moratorium was pla.ced on in dustrial developmen t In the area while the community considered redevelopment options and land uses . Environme ntal assessments were initiated in 199B, but rede velopm ent Issues were shelved at the time In favor of addressing the ne ighborhood's higher priority traffic issue. A dozen or more residents attended the community mee tings discussing traffic issues. Po lice Patrol Division, Pub lic Works Traffic Division and Commun ity Development staff were rep res ented at a ser ies of meetings discuss in g education , engineering and enforcement stra1egies for traffic problems . The Traffic Division conducted a sltidy of traffic volume and type for the area . Neighbors expressed concerns about safety and nuisances of commercial trucks driving north and south thro ug h the neighborhood. Various alternatives were considered and the group agreed to begin by addressing issues related to speeding and stu den ts cross in g Dartmouth to and from school . Spec ific commitments were made to extend the sch ool zone along W. Dartmouth Ave. by installing a second set of flashing school zone signals, and upgrading school crossing signage The land use and redevelopment issues were the focus of many of the community meetings . Broadway business owners were keenly in terestad in redevel opm e I issues and supportive of new residenlla' development that could potentially expand their cu .• ,mer base . The neighborhood expressed support for sen ior housing and reservations about continued industrial uses. Generally, when redevelopm en t was focused on industrial areas rather then residential areas it was welcomed . After the General Iron Works property was sold to an Industrial user, • efforts to market th e prop erty lor re si den tleVcomm ercial redevelopment were discontinued. The Pla nning and Zon ing Commission continued to discuss land use issues related to the substantial public investment in transportation in the Santa Fe corri dor. Englewood's Comprehensive Plan was amende d to include a reco gnition that the long planned multi -modal transportation cente r has been estab li shed In the Santa Fe Corridor , and further, that the public invest ment in tr ansportation infrastructure in the Co rrid or changed earlier assumptions about land use . Met roVis ion 2020 was adopted by Council as the regional element to Englewood's Compre hens ive Plan on th e recommendation of the Plann ing and Zoning Commis sion . The Mile High Compact, adopte d by Council in 2000 , directs th at comprehensive plans be con sistent wit h MetroVision 2020 . The Co re Elements of Metro Vision 2020 support development pattern s th at tak e advantage of existing serv ice system capacity, complement the existing transportation network , and provide high-capital transportation facilities where devel opment actions sup port the effi ci ent use of those fac ilities . Discussions about north Englewood began aga in whe n RTD proposed the Ligh t Rail Train Ma intenance Facility lor the Gene ral Iron Works site. Council res ponded to the proposal with a re quest that they consider other locations . RTD prov ided a White Paper on their site selection proce ss descri bing the 20 s:tf's wh ich were considered . Council and RTD met to discuss a compromi se that cou ld meet City and RTD needs. ATD sponsored a design charette that included Council and staff representativ es and developed a con sensus on a proposal that would enable RTD to deve lop the ir fac il ity on the north portion or the General Iron Wor1cs site and allow the so uth part of the site to be r eveloped with hou sing and commercial mixed uses . In 1999, Counci l approved a Santa Fe/P latte River Corridor Study that initiated strategic review o f open space , busin ess and land use opportunities in the Co rri dor. While the study is ongoing, it has included some significant m ilestones . A Great Outdoor Colorado (GOCO) planning grant was submitted, a business assessment was completed as was an environmental assessment of the General Iron Wor1cs site . That study concluded that multi-family resid ential land uses could occur on the historically industrial property with pr per remed iation, and that the costs of remediatlo n were re asonable for the use. A Transit Overlay Zone District has been dratted to permit transit supportive land uses in the influence area around li gh t rail stations. The new Zone District will be reviewed by the Plan nin g and Zon ing Com mi ssion in Janu ary and is exp ected to proceed to Council in February . Another milestone was the analys is of the location as a potential light ra il station . Results of that stu dy support bu ildi ng a station in conjunction with other transit supportive redevelopment. The Englewood Urban Renewal Authority advertised in the Engl ewood He ral d Publ ic Notices and mailed copies of the notice of th e December 18, 2000 to own ers and occu pants of property in the affected area th irty days in advance of the hearing as required by state statute . Staff has rec eived three phone calls and two walk in vists regarding the Survey and Plan . FIN ANCIAL IMPACT: The Plan lists all Urban Renewal ac tivities permined by state statute in cluding: land acquisition; rel ocation ol in dividuals. famili es and business concerns: p roperty management; demolition and clearance ol oxisting improvements ; land disposition , redevelo pm ent and rehabilitation ; • negotiation ol coop !ion ag reem ents with public bcdies; provisions lor fin ancing the project • incl ud ing the use of tax allocation fina ncing ; an:l o the r undertakings and activities as may be req uired to implement the plan in accordance with the A ct.
