AN ORDINANCE AUTHORIZI NG AN INTERGOVERNMENTAL AGREEMENT
ENTITLED "U.S . DEPART NT OF THE INTERI OR U.S. GEOLOGICAL SUR VEY
JOfNT FUND! G AGRE EMENT FOR WATER RESOURCES INVESTI GATIONS."
WH .!:REAS, the City Council of the City of Engle wood approved a J oint Funding
Agreement between t he U.S. Geological Survey by th e passage of Ordinance No. 20,
Series of 1996. Ordinance N:i . 87, Series of 1997 , and Ordinance No. 5, Series of 1999;
and
WHEREAS, a stream flow gage located at Union Avenue and the South Platte
Riv er, is operated and maintained by the U.S. Geological Survey and hae been in
ope r atio n since 1990; and
WHEREAS , the Englewood City Council authorized a "Joint Funding Agreement
For Water resources Investigations" in 1996 wlDch provi d for funding for this project
and allowed for renewals by mutual agreP.m ent; &id
WHEREAS , the data provided by the gaging s tation is required by the State Water
Comm.isaioner in order to make releases from Chatfield Reservoir during low flow
situations in which ins uffici ent water is available to meet pumping demand, at Union
Avenue Pump Station : and
WHEREAS , the Englewood Utilities De partment shares in the annual oost nf
ope r ating a.nd m aintaining the 6tation on a 50 /50 basis , with the U.S.G.S.; and
WHEREAS , this Ordinance will renew the "Joint Funding Agreement For Water
Resources Investigations" with the Englewood Utilities Department and authorizes
new joint funding for the period of October l , 2000 through September 30, 2001; and
WHEREAS, the cost of the Littleton/Engl ewood Wastewater Treatment Plant Joint
Funding Agreeme nt, including the gauge and monitor is SlB,820: and
WHEREAS, the U.S .G.S. contribution is Sl7,:J80 unde r this Agreement;
OW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLE WOOD , COLORADO , AS FOLLOWS :

1. The parties helflto agree tha l subject to the availability of apprapriaticns and in accordance wlth th eir respective authorities
there shall be ma1 ntalned In cooperation operation and maintenance of the strumHow and water quality statlonll on
the South Platte River, here inafter called the program
2. The following amounts shal l be contributed to cover all of the cost of the necassary field and analytical work directly
relat1,,:I to this prog ram .
(a) $17,380.00 by the party of the first part during ,he period
October 1, 2000 to September JO, 2001

authorize d representatives. The methods emp loyed in the fi eld and office shall be those adopted by the party of the
firs t part to in sure the required standards of accuracy subject to mod ifi cation by mutual agreement .
6 . During the course of this program. all field and analytical work of either party pe rta in ing to this program shall be open
to the in spec tio n of the other party. and if th e work is not being carried on in a mutually satis ,'actory manner, either party
may term inate this agreement upon 60 days written notice to the oth er party.
7. The or iginal ecords resulting from this pro gram will be deposited in the office of origin of those records. Upon reques t.
copies of the origi nal records will be prov ided to th e office of the other party.
8 . The maps. reco rds or reports resulting from th is program shall be made available to the public as pro mptly as possible .
Th e maps , records or reports normally will be published by the party of the first part. Howev er. the party of the second
part rese rves the right to publish the re sults of this program and. if already publ ished by th e pa rty of the first part shall.
