NC. FOR USE OF THE ARAPAHOE RENTAL PROPERTY .
WHEREAS, the Englewood City Council authorized the purchase of the Arapahoe
Rental property by pasaage of Ordinance o. 60, Seriea of :woo ; and
WHEREAS, Ordinance o . 60, Series of 2000 permitted Arapahoe Rental to
continue their buainees operations; and
WHEREAS , Arapahoe Rental has aold ite operation to J & J Hendereon dba
Arapahoe Rental; and
WHEREAS . the approval of this Ordinance wi.ll p rmit Arapahoe Rental to remain
OD tbe premi a to continue their current buaineu operationa while the City amtinues
to plan for future development for this aite;

IT IS EXPRESSLY NDERSTOOD AND AGREED BETWEEN LANDLORD AND
TE 'ANT AS FOLLOWS :
6 . No assent, expres or implied , to any breach of any one or more of the agreements
hereof shall be deemed or taken to be a waiver of any succeeding or other breach.
7. If, after the expiration of this lease , t he Tenant shall remain in possession of the
premises and continue to pay rent witho ut a written agreement as to suc h
possession. then st ch tenancy shall be regarded as a man ►h-to-month tenancy, at a
monthly rental, pay ab!$ in advance, equivalent to the last mo n th's rent paid under
this lease, nd ubject to all the term s and conditions of this lease .
8. If the premjses are left vacant then the Landlord may retake possession of the aid
premises. The re shall be no penalty if the tenant vacates the premises prior to the
expiration of the lease term.

The Landlo rd acknowledges receipt of a deposit in the amount of -0-.
At the Landlo rd's option . it shall be deemed n breach of this lease if the Te nant
defaults (a) any other monetary obligation herein: or (b) in the performance of any
other term or condition of this lease .
In the event that the Landlord elects to declare a breach of this lease , the Landlord
shall ha,-e the right to give the Tenant three (3) day s wntten notice requiring
co mpliance with terms or provisions of the lease. or deliv ery of the posse ssion of the
premises. In the event any default remams uncorrected after three (3) days wntten
notice, the Landlord , at Landlord's option, may declare the term ended, reposs~ss
the premises, expel the Tenant and those claim mg through or under the Tenant and
remove the effects of the Tenant, aU without berng d emed guilty trespa s or of a
forcible entry and detainer and without preiud1ce to any tJ ther remedies to whicb. t he
Landlord may be entitled. If at any tim e this lease is terminated under this
paragraph. the Tenant agrees to peacefully surrender the premises to the Landlord
unmediately upon termination, and If the Teoa.nt remains in possession of the
premises. the Tenant s haU be deemed guilty of unlawful detention of the premises.
The Land.lord sha U be enti tled to recover from the Tenant all damages by reason of
the Tenan 's default, in cluding but no, limited to the co t to recover and repo seas
the premise s, the expenses of relettrng, neces ary renovauon a nd alteration
expenses, co mmis sions and the rent for he balance of the term of this lease.
ln the even t of any damage to the Premises, Tenant shall have no obligation to
repatr or replace the Premises elcept to the extent the cost of such repatr or
replacement of the Premises 1s covered by in urance or 1B reqlllttd to be cove red by
msurance under tlus Lease .

Tenant sh ,U not be deemed to be in default under this Lease excep upon (i) the
expiration of thirty (30) days after receipt of written notice (five (5) days in the event
of failure "BY money owed hereunder) m Landlord specifying the failure of
Tenant to perform its obligations under this Lease and (ii) the failure of Tenant,
prior to the expiration of said thirty (30) day period (o f five (5) d ays, as applicable),
to re ·r,, the fail ure to pay money owed) cannot be rectified with.in said thirty (30)
day period and Tenant 1s using good faith and bes t l'fforts to rect ify the specified
failure to perform , Tenant s hall not be deemed in default.
13. Both la ndlord and tenant shall have the right to terminate this Lease at any time
upon at least thirty (3 0) days prior written notice to the other party.
I~. Tenant shall have no obligation to make structural repairs to the Premises. e. ~ept
to the e,:tent damage to the structure of the Premises is caused by Tenant.
15 . In thP event of any dispute arising under the terms of this lease and in the ev it the
matter 1s t urn d over to an attorney, the party prevailing in such dispute eh J be
entitled, in addition to other damages or costs, to receive reasonable attorneys' fees
from the other party.
16. ln th event of a condemnation or other taking by any governmental agency , all
proceeds hall be paid to the Landlord hereunder, the Tenant waiving all right to any such payments.
l7 . Tenant shaJJ msure the premises for public liability and property damage in the sum
of One Million Dollars with the City of Englewood as an additional insured.

Ordinance o . 60, Series of 2000 authori zinB the purchase of the Arapahoe Rental property).

Staff recommends Council adopt a bill for an ordinance for the lease of the A rapahoe Rental
property to J & J Henderson, Inc .
BACKGROU ND, AN ALYSIS, AN O ALTE RNATIV ES ID ENTIFIED
The 19 79 Ci of Englewood 's Comprehens ive Plan i dentified th e Arap ah oe Rental property as a
ke y pa rcel for park acquisitions.
The City oi Englewood purchased the Home Lumber property (Ord . 60, Series 1995) in 1995. As
part o f the Master Pl an an d with th e purchase of the Arapahoe Re ntal p roperty, the Depa rtme nt o r
Parks & Recrea ti o n is ab le to pursue the future de velopment of an aquatic facility at this location.
The orl inal lease agreeme n t was be tween the City of Englewood and Donald Bowey, doing
bus;n ,> as Arapahoe Ren tal. Sin ce that time, D onald Bowey has sold his Arapa hoe Rental bus iness
to ) & J H enderson, Inc., D BA Ara pahoe Rental. The Hendersons will assume in terest i n the lease
agreement that M r. Bowey had with the City of Engle vood.
Per he lease agreement. th e tenant would be allo\,ed to remain on the premis es to con tinue
c urrent business operat ions un til September 30, :!001 . The enant, with approval from the City of
Englewc ,1 d. mav al so extend the lease for th ree (3) one (1) yea r periods while deve lopment plan s
for the site c ontinue.
Arapahoe Re nt al c urren tly has 2 re n tal sites (Coun . Line Rd . & Belleview Ave.). The Hend!!rsons
are looking to eventually consolida te their operations at the County Line Rd . site . However, until
that ti me. they w ill be cond ucting limited b us iness operation s out of the Belle vie w site . The leas e
will require them to mainta i n the property in good repair and i n a clean , orderly fashion.

tbe Business Lease for Arapahoe Rental to continue their use of the Arapahoe
Rental Property while future development plans for this site continue. A copy of the
"Business Lease" with the "Addendum To Business Lease• is marked as "Exhibit A•
and attached hereto .
~-The Mayor is hereby authorized to sign and ~ttest said Lease on behalf
of the City of Englewood.
