AN ORDINANCE UNDER SECTIO 113 : COMPETITIVE BIDDING , OF THE
ENGLEWOOD HOME RLU CHARTER UNDER WHICH THE CITY COUNC[L OF
THE CITY OF E. GLEWOOD , COLORADO JS RAISING THE DOLLAR AMOUNT
OF COMPETITIVE BIDDl)IG FOR ENTERPRISE FUNDS .
WHEREAS , the City of Englewood's Home Rule Charter Section 113. provides
"Before the purchasing officer mnke& ny pu; .:haae of supplies , m a terials or
eq 'pment, in ceee of S10 ,000.00 , he shall give mple opportunity for sea!ed
competitive binding. wjth •uch general exceptjons H the Cg LQ ci l may pmcribe by
oaljnance . Co@cil a.hall not exempt any individual contract, purchaae or sale &om the
requirement of competitfre bidding. No officer, appointee or employee of the City eha1l
be financially interested. directly or indirectly, in the sale of any land, materials,
supplies, or services to the City , except in case of purchases s ubmitted r.o mmpetitive
bidding or not exceeding an aggregate of S100 .00 in any on.e year. The lowest and
beet bid shall be accepted or all bids will be rejected. If th.e lowest bid is not accepted
as being the best. such reiection must be approved b Council. Provisions in thia
Section shall not apply to professional or technical services, or services of regulated
public utilities. All invi tations to bid shall require bidde to meet the requirements of
State Statutes regarding preference of State products." (Emphasis added); and
WHEREAS , the Englewood City Council is adopting an ordinance pro,1ding for
general exceptions; and
WHEREAS, a s a general exception tbe thre11bold for competitive bidding for
Enterpriee Funds shall be rni ed to $50 ,000 ; and
WHEREAS. oompetitfre bidding for these items iB inefficient WJ.ce there is usually
only one supplier of these product.a :
OW , THEREFORE. BE IT ORDAINED BY THE CITY COU NCrL OF THE CITY OF
E GLEWOOD . COLORADO . AS FOLLOWS :
~-The City Council of the City of Englewood , Colorado baa re\!lewed and
hereby autbonzes raising the dollar amount to in exce of $50 ,000 for competitive
bidding is required purs uant to Section 113 , of t he Englewood Home Rule Charter for
Enterprise Funds.

materials for routine repairs 1n exce~s a1 S 10,000 (bu t not o er 550,000). Compeutive h1dding for these
items is memc1ent since there 1s usually onl one supplier of these products. Also, these funds are self
supported by the cha rges the, impo se for the ir products and serv,1ces.
