AN ORDINANCE AUTHORIZING A CITY DITCH ENCROACHMENT PERMIT AND
A GRANT OF CITY DITCH CROSSlNG LICE SE TO HCA -Heald, One LLC , dba
SWEDISH MEDrCAL CENTER.
WHEREAS, the Englewood City Council approved the Swedi.eh Medical Planned
Oevelopm!lnt in 1989 with additional amendments approved in 1989 , 1990, 1992 and
1993; and
WHEREAS , Swedish Medical Center filed an application for Planned Development
Amendment 5, to the Swedi.eh Medical Center Planned Development; and
WBERFAS, the proposed Planned Development Amendment 5, coneiate of an
addition of approxilllately 21,000 square feet of surgical and 'tical care aupport area;
nd
WHEREAS, the proposed Pla11Ded DevelapmentAmendment 5, affect& the main
entrance to the hoap1tal which ia located at 501 East Hampden Avenue; alld
WHEREAS, the Englewood Planning and Zoning Commi6eion held a Publi c Hearing
on January 9, 2001 , reviewed tbe Planned Development Amendment 5 and
recommended approval; and
WHEREAS, the Swedish Medical Center Planned Development Amendment No. 5,
plan provides for a seoond story which overhangs the City Ditch Right-Of-Way and
which is eupported by a ::olumn which would en.c:roach sixteen square feet into the City
Ditch lu&ht•Of-Way; :..nd
WHEREAS, the proposed overhang and column will not matei J affect the
operation of this portion of the City Ditch; and
WHEREAS, the Englewood Water and Sewer Board recommended approval of the
City Ditch Encroachment Permit and the Grant of City Ditch Crossing License to
Swedish Medical Center at the February 13, 200 l , meeting;
OW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
E GLEWOOD, COLORADO, AS FOLLOWS :

Prcperty including, bu t not limited to, planting and mmmi.ng gTUS and/or bushes ,

to consa-uct any permanent structures or enc:roac.h upon the Encro:ichment Property lll

licenses and/or grants, recorded or unrecorded, a.nd it shall be the Permitee's sole
responsibility to determine the existence of said alf!'eements. licenses or grant.I or
conflicting uses or installations.
7 Access to the parcel by City personnel must be maintained by Pennitee Car inspection
and U1aintenance.
8 . Upon abandonment of any right or privilege herein granted , including the destru.ctio

Swedish Medical Center e pansion . The ove rhang viii be approx imately 21' above the City Ditch
easemen t and would not in terfere w ith Ci Ditch opera tions and repairs. The Encroachment Pe rm it is for
the supporting co'umn necessary for cons truc.tion th at requires 16 square feet within the City Ditch rig ht-of-
vav .
