WHEREAs, the City of Englewood Safety ervice Department applied for funding under the VALE Grants Program to be used for funding the Victim/Witness Program in the Englewood Municipal Court; and WHEREAS , the City of Englewood has preVJously applied and been granted VALE Grants for tbe years 1990 through 2000; and WHEREAS , the Vicum/Witness Program in the Engle wood Municipal Court has served the victims of dom es tic violence since 1990; NOW, THEREFORE , BE IT ORDAI ED BY THE CITY COUNCIL OF THE CITY OF E GLEWOOD , COLORADO, AS FOLLOWS: &wim.l . (2) The contents o f the grant applicat ion will become contractual obligations of the gra nt rec ipient and ar e incorporated into this contract as if fully set forth herein . (3 ) The grant rec ipient is required to submit Financ ial Reports quarterlv: October 3 1 , 200 1 and Ja nuary 31 . 2002 for funding for 2001. The report due on January 31 . 20 02 shall be he year -end report, The VALE Board will provide Financ ial Report ing Forms. Grant re ci pients are required to use these forms . • Englewood Department of Safety Services 01-43 (4 ) The gra nt rec ipient is required to submit a Program Report C"n January 31, 2002 , which addresses any special condit;::,ns that are listed ir this contract. The VALE Board will provicle Program Rep orting Fe,~ms. Grant rec ipients are required to use these forms . (6) Special condit io ns for the award which have been stipulated between the VALE Board and the grant rec ip ient are as follows : None (7) Any equipment purchased with VALE funds must remain with the grant recipient . Equipment must be used for the purpose designated , the grant applicat ion . An\' use by others or transfer of ownership must be reported to the VALE Boa rd , in writing , prior to the occurrence of such use or tra11sfer . The Board may approve such use or transfer or may request return of the equipment. (8) fu!y change in the use of grant funds shall be approved by ''1e VALE Board. The request for such change sha ll be in writing. Approval of the ✓AL E Board shall be obtained pr ior to any s~·ch use. (9) Amendm ent o any o her terms of th is contract shall have prior approval of the Board. Requests for ame ndment shall be in v.riting . (10) The gran t recip ient shall submit w ritt~n notification by Decemb ar 1, 200 1 to the VALE Board if he grant rec ipient will ha ve an y rema in in g funds ;it .he end of the grant period . Englewood Dep artment of Safety Serv ices 01-43 All unused funds shall be returned to the VALE Board unless the grant recipient makes a request in writing for use of the funds beyon d the grant period and such request has been approved by the VALE Board. Such requests shall inc lude : The amount of remaining funds How the fund will be used When t he f und will be expended Why th e fu,,d we re not expended. Such request must be rece:ved on or CE:!fo re December 1, 2001 . Upon rece i pt of the request, the VALE Board shall decide whether to grant or deny the request without further presentat ion or hearing. t 1 1) The grant recipient agrees tha'C all funds received under this grant shall be expended solely for he purposes stated above and that any funds not so expended, inc luding funds lost or div erted to other purposes, shall be repaid to the VALE fund. • (12) The grant r<}cipient ag re es to comply with the letter and spirit of the Colorado Anti-discrimination Act of 1957, as amended, and other applicab le law respecting discrimination and unfair employment practices (C.R.S. Sec. 24-34-402) and required by Executive Order , Equal Opportunity and Affi. mative Action, date April 16 , 1975. !1 3) Non-compliance with any portic,n of this co ntract may result in· Withhol ding of funds The grant recipient returning money to th e VALE fun ci Other action as deemed necessary by the members of the VALE Eoard Any combination of the abo ve.
