THE CITY OF ENGLEWOOD AT THE NEXT SCHEDULED MUNICIPAL

OF THE ENGLEWOOD HOME RULE CHARTER.
WHEREAS, the City Council of the City of Englewood deairea to change the
Competitive Bidding proceaa to provide for competitive bidding in exceaa of $25,000 or
llll prescribed by ordinance : and
WHEREAS, this requirement has not been adjUBted in many years and is no longer
relevant from a financial viewpoint; and
WHEREAS, -·petitive bidding at this level 18 ine fficient be uae 80 much time is
being spent on preparing, reviewing and awarding bida for relatively small purchases:

WHEREAS , the Englewood City Council find! that s uch modification of the
Englewood Home Rule Charter would serve the public welfare ;
OW, THEREFORE , BE IT ORDAINED BY '"HE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO , THAT:
Section 1 'F1.1,;r;; is hereby submitted to the regatered electors of the City of
Englewood at the next scheduled municipal election on November 6 , 2001 a propoeed
amendment to the Charter of the City of Engl.ewood , as follow !':

Before the purchasing officer makes any purchase of supplies, materials or
equipment. in excees of+J~I00:%$2 5 000 or as prescribed by ordinance. he shall
give ample opportunity for sealed com petitive b1dd.mg, with such general exceptions
as the Cou.nal may prescribe by ordinance . Counctl s hall not exempt any indivulual
contract. purchase or sale from the requirement of competitive bidding. o officer,
appointee or employee of th City sh U Le finano lly interested, d.u-eetly or
indirectly, in the sale of any land. materials, supplies, or services tq~he City, except
in case of purchases submitted to compet1t1ve bidchng or not e!'lce din an aggregate
of Sl00.00 m any one ·ear. The lowest and best bid s hall be accepted or all b,ds w1U
be rejected. If the lowe t bid ts not accep ted as being the best, s uch reiection mUBt

Council on final reading of this Ordinance .

The Council has discussed this issue at a number of study sessions , including one held May 21 , 2001 where
st;.if was directed t o proceed with submitting this question to the voters. Also, Ci Council passed
Ordinance 9, Series of 2001 . This ord inance 1s closely re l ated to this iss ue because it !lowed en t erprise
• funds to purchase supplies . equ ipm en t. etc up to S50.000 without competitive bids.
