ELE CTION A PROPOSED AMENDME IT TO ARTICLB X. PART IV, SECTIO 116 ,
OF THE ENGLEWOOD HOME RULE .
WHEREAS , the City Council of the Citv of Englewood de ire s to cha nge the Capital
Improvements 'lrocess to provide for~ mp et.uve b1dding in excess of $50,000 or as
prescribed by l '· ri:uu:e; and
WHEREAS, ~'1: requirement has not been adjusted in many years and is uo longer
relevant from a~., ncial or operational viewpoint; and
WHEREAS, competitive bidding at dus le,-el is inefficient because so much time is
being spent on preparing, reviewing and awarding bids for relatively small projede;
and
WHEREAS, the Englewood City Counol finds that such modification of the
Englewood Home Rule Charter would rve the public welfare ;
NOW , THEREFORE , BE rr ORDAINED BY THE CITY co CIL OF THE CITY OF
E:-IGLEWOOD, COLORADO, THAT.
Section 1 There is hereby aubmitted the registered electors of the City of
Englewood at the next scheduled murucipal election on ovember 6, 2001 a proposed
amendment to the Charter of the City of En lewood , as follo ws :

unless accep ed by resolution which shall declare the reason for
exception to the competitive bidding requirement.

appropriate marking upon paper ballots where used .
Si~ The proper officials of the City of Engl wood shall give notice of said next
ache-Juled municipal election, such notice shall be published in the manner and ~or the

~-Only if the question is approved by the 1,-gistered electors of the City of
Englewood shall the Section be amended and the Chan r, as amc nded, certified to the
Secretary of State.
~-For purposes of Sect.ion 1-11-203.5, C.RS., this Ord.inance shall serve
to set the title and content of the ballot issue set forth herein and the b llot title for
such question shall be the text of the question itself. Any petition to contest the form
or content of the ballot ti t le may be filed with the District Court and a copy served on
the City Clerk within five days after the title of the ballot question ia set by the City
Council on final read.mg of thiB Ord.inance .
~. If any section , paragraph, clause, or other portion of thiB Ordinance is for
any reason held to be invalid or L>nenforceable , the invalidity or unenforceability shall
n ot affect any of the remaining portions of this Ordinance.

The Council has discussed this issue at a number er i:d sessions, including one he ld a 21, 2001 where
staff was di rected to proceed with submitting this question to the vo ters . Al so, City Council passed
Ordinance 9, Series of :WO I changing the purchasing limits for the City's en terprise funds .
