HomeMy WebLinkAbout2001 Ordinance No. 051• • • ORDINANCE N0.€1_ SERIES OF 2001 BY AUTHORITY COUNCIL BILL NO. 65 INTRODUCED BY COUNCIL MEMBER WOLOSYN AN ORDINANCE AUTHORIZJNO THE TRANSFER OF PROPERTY KNOWN AS THE FORMER CITY HALL FROM THE CITY OF ENGLEWOOD, COLORADO TO THE ENGLEWOOD ENVIRONMENTAL FOUNDATION . WHEREAS, the City of Englewood leaaed the former City Hall building located at 3400 South Elati from C.A. Norgren Company in November, 1964; and WHEREAS. the City purchaF0 -' ~a» l rope,-ty located at 3400 South Elati in Auguat. 1968 and paid the Promissory Note in lull in July 1997; and WHEREAS, the City moved into th., Englewood Civic Cent.er in June of 2000; and WHEREAS. the Englewood Environmental Foundation wae formed to luaen the burdens of go vernment; eerve as the City'a desiriiee to receive title and hold title during the perfo=ance of environmental remediation of the property; prot.ect City from potential liability which might be imposed on the own.er of property ariaing out of environmental contamination; allow environmental contra.ctora, property menagen,, land URe planners, and others to be retained without going tluougb public bidding procesaes; permit the land URe planning process to proceed while allowing the City to limit its direct involvement to the parformance of its normal land use review and approval fUJ1rtion and to shelter the City from financial responsibility relating to the development and operation of the prop,·rty: and WHEREAS, the City desires to transfer the descnbed property to the Englewood Environmental FoUJ1dation to allow environmental cleanup; and WHEREAS. the Englewood Environmental Foundation will accept the property by paying ten dollars ($1 0.00) and will aeaume all risks and liability for the environmental Liability and will d .emolish the City Hall stTucture and abate all envu-onmental hazards on the property; and WHEREAS, the propoeed property transfer will .J ve s ubstantial financial and environmental liability from the City and allow for a coordinated redeveloriment of thia property; and WHEREAS, this transfer will place the property under the protective umbrella of the Foundation and rewove the City &om any potential Jiobility associated with the redevelopment of the site: and WHEREAS. the total eite consists of approximately 2 .2a acres south of the Parkway and 1.1 acres north of the Parkway; and WHEREAS. only the portion south of the parkway Will ,, u-ansferred at this time; and -I. 10 b ii WHEREAS , ri1hta-<>f-way for roacb and aewe1'8 , utility eaeementa and other development iuuea are still bein1 coordinated. thOM detaila and futlU't! tranafera and reatrictiona an anticipated in the near future ; and WHEREAS, the tranaCer olthi■ property together with the property it ia anticipatinc to be tranmrred in the future will create a new development site; and WHEREAS. the estimated value of the total demolished site, clean a .nd ready for development ia between S1,325,000 and $1.415,000 based upon zecent sppraieal data; and WHEREAS. the City wiahee to transfer the property to the Englewood Emr.ronmenial Foundation eo that the EEF may prepare the site for new development; NOW, THEREFORE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD. COLORADO, THAT: ~.
