WHEREAS , the original intergovernmental agreement to cooperate in the development of the transit improve ments with the Commercial Redevelopme nt Project was aigne d by both part ies on January 6 , 1997; and WHEREAS, the intergovernmental agreeme nt was amended on July 19, 1999. to provide . in part, for additional parking s paces and funding therefore; and WHEREAS. the Englewood City Council approved the Second Amendment to Agreement for CityCenter Englewood t-y the puaage of Ordinance No. 64. Series 2000; and WHEREAS. the passage of this Ordinance would amend the agreement to provide for the construction of a a plash curb behind the back of the existing curb between the face of the existir:.g buaway and tbe retaining wall for the Enslewood Light Rail Stztion : the construction of a sidewalk between the Oxford Street Light Rail Train Station and Mansfield Street; and the installation of additional b icycle lockers and benches at the Englewood Light Rail Train Station; end WHEREAS , RTD will pay for the cost of the construction of the aplasb curb ; the bicycle lockers and the benches a t the Englewood Light Rail T r ain Station, aa well au the coat of the col18truction of the sidewalk at the Oxford Street Light Rail Train Station; NOW , THEREFORE , BE IT ORDAJNED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO . This Third Amendment to the above-referenced Agreement is to provide foT the ccnatruction of:, splash curb behind the back of the existm(I curb between the face of the existing buaway and the retainmii wall for the Englewood LRT Station. The purpose of the splash curb i.a to provide a planting area wherein the City of Endewood will provide landscapin11 muerial between the splash curb and the face of the retaining wall. This Amendment will also provide for the construction of a sidewalk at the Oxford Street LRT Station and the installa tion of certain amenities at the Englewood LRT $:ation. L Section Two o f the Agreement is amended br the addition of t he following: (]<) Construction of a splas h curb as an upgrade along the section of the busway immediately to the east of the resa.ining wall for the Englewood LRT Station as depicted on Exhibit A attached. RTD will pa y to the City the cost of the construction for the splash curb wluch will be constructed by tbe City contractor for 693 lineal feet of s plas h c urb at a cost of $32.80 per lineal feM !l&l.for a total of $22 .731.00. The City shall be s olely responsible for the construction of the splash curb and a ny rela ted activities associated ,.-ith the construction o f the s pla&h curb as shown on Exhibit A. (I) Construction of a six foot wide sidewalk from t he Oxfor d Street Station north to :Vlansfield on the wes t s ide of W indemere Street. approximately 850 linear feet. The City shall be s olely respons ib le for the des ii?l and construction of the sidewalk and any r elate d activities ass ociated wi th the construction of the sidewalk. On July 19, 1999, a first amendment to this in tergovernmental agreement was approved inc reasing financial participation by RTD i n the project A second amendatory agreement was approved in July 2000 authorizing reimbursement to the Environmental Foundation for i nstallatio n of fencing at CityCenter Englewood on behalf of RTD RECOMMENDED ACTION Staff recommends council approval of a Bill for an Ordinance to approve a third amendment to the IGA for reimbursement in the amou nt of $26,000 to the City of Englewood an d $37,193 to the Englewood En ironmental Foundation for work performed by the City and EEF on behalf of RTD . BACKGOUND Last October the Englewood En ironmental Foundation, sought and received informal approval from RTD to construct a spl as h curb along the west side of the curb a gutter adjacent to the Englewood Light Rail Station. The splash c urb will allow vegatation to be planted against the retaining wall at the station. RTD has agreed to reimburse EEF for the actual costs of thi s c onstruction, 522 ,73 1, in lieu o f paying for painting of the reta ining wall. W ith the agreem ent of RTD , the Englewood Environmental Foundation has purchased and installed sixteen b icycle lockers adjacent to the Ligh t Rail station at a cost of S 11,480 at the request of RTD. This cost will be reimbursed by RTD . The En glewood En vi ronmental Foundation has, at the request of RTD . installed three additional bus b e nc hes adjacent to RTD bus st o ps at City Center Englewood at a cos t of $2982 . RTD will reimburse this cos t. All o f thi s work, which is now ~ompleted, has been pa id by EEF through the CityCenter pro ject budget and RTD is prepared to reimburse the Ci ty pending approval o f the amendatory agreem ent. In discussions with RTD earlier this year, It was determined that a sidewa lk extension along the west side of Windemere Street w as desirable for the safety o f RTD use rs of the O xford Light Rail Station. The City designed and willadminister this extension and RTD has agreed to pa y the cost of construction totalling S 26,000. The City has c ontracted for completion of this work, whid, will be completed this year. FINANCIAL IMPACT The Engle w ood Environmental Foundation will be reimbursed $37, 193 for worf< completed at OtyCenter Englewood and the City of Englewood will be reimbursed S26,000 for the worf< to be completed adjacent to the Oxford Station.
