AN ORDINANCE AMENDING TITLE 5, CHAPTER 3B, SECTION 10, OF THE
ENGLEWOOD MUNICIPAL CODE 1985, WITH THE ADDITION OF A NEW
SECTION 10, P&RTAINING TO OPTIONAL PREMISES LIQUOR LICENSE AND
OPTIONAL PREMISES WITH HOTEL AND RESTAURANT LIQUOR LICENSE IN
THE CITY OF NGLEWOOD, COLORADO AND RENUMBERING THE CURRENT
SECTION 10 TO SECTION 11.
WHEREAS, a new Occupation Tax for Optional Premiaes Liquor Licenaeo and
Optional Premiles with Ho~,1/Reataurant Lice·noe was approved at the November 2,
1999 General Municipal Electio">; and
WHEREAS , when such a license ia made 11vailable in a community, Colocado
Revised St.Rtutoa 12-47-310 (1), require, the 11,verning body of the municipality to
adopt, by ordinance, apecilic atandarda for the iaauance of Optional Premise• Liquor
Licenae■ or for Optional Premises with Hotel/Reataurant Liquor Licenaes;
NOW, THEREFORE , BE IT ORDAINED HY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD , COLORADO, AS FOLLOWS :

15-38-M 11: DEFINITIONS: Definitions not specifically enumerated herein ohall be
as defined in Title 12, Articles 46, 47 and 48, Colorado Revised Statutes.

A. WNDARj)S ADOPTED . THE FOLLOWING STANDARDS FOR THE
ISSUANCE OF OPTIONAL PREMISES LICENSES OR FOR OPTIONAL
PREMISES FOR A HOTEL AND RESTAURANT LICENSE ARE HEREBY
ADOPTED PURSUANT TO THE PROVISIONS OF SECTION 1~-•7-3W, C.R.S.
I. STANDARDS . THESE STANDARDS ADOPTED HE:lEiN SHALL BE
CONSIDERED IN ADDITION TO ALL O'f'HER STANDARDS
APPLICABLE TO THE ISSUANCE OF LICENSES UNDER THE
COLORADO LIQUOR CODE FOR OPTIONAL PREMISES LICENSE OR
FOR OPTIONAL PREMISES FOR A HOTEL AND RESTAURANT
LICENSE. THESE TWO TYPES OF LICENSES FOR OPTIONAL

PREMISES WILL COLLECTIVELY S·t REFERRED TO AS "OPTIONAL
PREMISES" IN THESE STAND, '.RD/; 1 :Nl.ESS OTHERWISE PROVIDED.
2. EJJOJBLE FACHJTIES . AN OPTIO N!,(, PREMISES MAY ONLY U
APPROVED WHEN THAT PREMIS LS !>l LOCATEb 0N OR ADJAOBNT
TO AN OUTDOOR SPORTS AND RECRKATIONAL FACIIJTY AS
DEFINED IN SECTION 12 -4 7-103(22)\a). THE TYPES OF OUTDOOR
SPORTS AND RECREATIONAL FACILITIES WHICH MAY BE
CONSIDERED FOR AN OU'T'OOOR PREMISES LICENSE INCLUDE
THE FOLLOWING :
a . COUNTRY CLUBS :
b. GOLF COURSES AND DRMNG RANGES ;
c. ICE SKATING ARENAS ;
d. MINI GOLF COURSE ;
e. SWIMMING POOLS; AND
f. OUTDOOR TENNIS COURTS AND CLUBS .
THERE ARE NO RESTRICTIONS ON THE MINIMUM SIZE OF THE
OUTDOOR SPORTS AND RECREATIONAL FACILITIES WHICH MAY
BE ELIGIBLE FOR THE APPROVAL OF AN OPTIONAL PREMISES
LICENSE . HOWEVER. THE ENGLEWOOD LIQUOR LlCENSINO
AUTHORITY MAY CONSIDER THE SIZE OF THE PARTICULAR
OU'l'DOOR SPORTS OR RECREATIONAL FACIIJTY IN
RELATIONSIDP TO THE NUMBER OF OPTIONAL PREMISES
REQUESTED FOR THE FACILITY, AND MAY DENY ANY OPTIONAL
PREMISES APPIJCATION IF THE IT CONSIDERS THE RELATED
FACILITY TO BE TOO SMALL TO REQUIRE AN OPTIONAL
PREMISES.
3. NUMBER OF OPT!ONAL PREMISES . THE ENGLEWOOD LlQUOR
LlCENSING AUTHORI'TY, IN ITS DISCRETION , MAY RESTRICT THE
NUMBER OF OPTIONAL PREMISES WHICH ANY ONE LICENSEE
MAY HAVE . ANY LlCENSEE REQUESTING APPROVAL OF MOM
THAN ONE OPTIONAL PREMISES SHALL :
a. EXPLAIN THE REASON FOR EACH OPTIONAL PREMISES
REQUESTED:
b . DEMONSTRATE HOW THE Ol'TIONAL PREMISES RELATE TO
EACH OTHER FROM AA OPEliATIONAL STANDPOINT ;
c. DEMONSTRATE TO THE SATISFACT•ON OF ENGLEWOOD

liability, either civil or criminal, which shall have been incurred under ■uch provision,
and each provision shall be treated and held as atill remaininc in force for the

COUNCIL GOAL AND PREVIOUS ACTION
Amend the Englewood Municipal Code 1985 to establish an Optional Premises License and
Opttonal Premises with Hote l/Restaurant License , as required by SIPie Statute .
BACKGROUND
A new Occupation Tax for Optional Premises Liquor Licenses and )ptional Premises with
HoteVRestaurant License was approved at the November 2, 1999 · ,enerel Municipal Eledlon,
when the voters approved Referred Ballot Question No . 2A. Wher such a license Is made
avallable In a community, §12-47•310 (1), Colorado Revised Slatu ,.,s, requires the govemlng
body of the municipality to adopt, by ordinance , specific standards lor the Issuance of Optional
Premises Liquor Licenses or for Opti onal Premises with HoteVResti1urant Liquor L.Jcenses .
RECOMMENDED ACTION
Council approval of a bHI for an ordinance establishing an Optional Premises Liquor License and
Optional Premises with HoteVRestaurant License In the City ol Englewood .
FINANCIAL IMPACT
Each Optional Premises Liquor License issued would pay $650.00 annually to the City of
Englewood . Each Optional Prem ises with HoteVRestaurant License would pay $100.00
annually to the City of Englewood.
