AN ORDINANCE APPROVING THE ACCEPTANCE OF '!WO EASEMENTS
LOCATED AT 4601 SOUTH SANTA FE GRANTED TO THB CITY AS PART OF A
MINOR SUB DIVISION BY DUGGAN PROPER'1'IES L.L.C.
WHEREAS, in order to facilitate a mim · s ubdivision of the Duggar. t · operties
located at Santa ,e Drive and Union Avem in the City Jf Englewood , Colorado tbe
Owner granted an acceBB easement for City ingress and egreBB to tbe subject property
and tbe property to the West oftbe subject property; and
WHEREAS, The Owner extended the sewel' line and granted the accompanymg
sewer line easement as a part o( the requirements for the minor aubd.iviaion; and
WHEREAS, the acceptance of tbese easement& will eru,ure C:ity ac:ce88 fo ,·
emer~ency and utility purp01es ;
NOW , THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO, AS FOLLOWS:

460 1 South Santa Fe from Duggan Properties L.L.C. to tbe City of Englewood,
Colorado, attached hereto 88 "Exhibits A an~. B" are hereby accepted and approved by
the En flewood City Council.
~-The Mayor is authorized to execute and the City Clerk to attest and oeal
the easem ents for and on behalf of the City of Englewood, Colorado

GRANT OF ACCESS EASEMENT
• THIS GRANT of access easement (this "Gnnt") is made this~" day ofFebruaiy, 2000,
by D1111111 Properties L.L.C. ("Grantor") whose address is 5942 Kline Street, Littleton, Colorado
80127 in favor of the CITY OF ENGLEWOOD, COLORADO, ("Gr111tee ") whose address is
3400 South Elati Street, Englewood, Colorado 80110 .
The parties covenant and agree as follows:
I. Easement Property . The "Easement Property" shall inean the real property
located in the County of Arapahoe, State of Colorado, more particularly described on Exhibit A,
consisting of i pages, attached hereto and incorporated herein by reference .
2. Consideration. As consid eration for this Grant, Grantee has paid Granter the sum
of One dollar(~ 1.00) and other good and val uable consideration, the receipt of which is hereb y
acknowledged by Granter.
3. Grant of Access Easement. Grantor hereb y grants to Grantee, its succ essors and
assigns, a perpetual , nonexclus ive easement (the" Access Easement") over, across and through
the Easement Property for the purpose ,,f ingress and egress and general access to the Easement
Property and the Property immediately to the West of the Easement Property.

S. No Improvements . Gra.~tor covenants and agrees not to construct, erect, place or
plan any "Improvements," as hereinafter defined , on the Easement Property without obtaining the
prior written consent of Grantee . "Improvements" shall mean any structure, building , planting,
trees or shrubbery other than lawns , commerc ial landscap ing , and other existing fearures on the
Easement Property, including , but not limited to , pavi ng , drainage ways, retaining walls, speed
bumps etc . Gr,111tee shall have the right to remove, without any liability to Granter, any
improvements constructed, erected, placed or planted on the Easement Property without
Grantee's having obtained the prior written consent of Gran tor .
6. Subjacent and Lateral Support . Grantor covenan ts and agrees that Grantee sh all
have the right of subjacent and lateral support on the Easement Property to whatever extent is
necessary or desirable for the full , complete and undisrurbed enjoyment of the rights granted to
Grantee under this Grant.

7. Rights ofGrantor. Grantor rucrves the llt11 right to the undistwbed ownership, •
use, and occup111Cy of the l:iasement Property insofar as said ownership, use, and OCCIIJ)IIICY is
con5i:ttent with and does not impair the rights r-anted to Grantee in this Grant
8. Abandonment. In the event that Grantee shall abandon the rights granted to it
under this Grant, all right, title and interest hereunder of Grantee sha;! cease and terminate, and
Granter shall hold Easement Property, as the same may then be, free from the rights of Grantee
so abandoned and shall own all materials and structures of Grantee so abandoned, provided that
Grantee shall have a reasonable period of time after said abandonment in which to remove any or
all Lines and Appurtenances fiom the Easement Property. In the event that Easement is
abandoned by Grantee, Grantor shall have the right, at its sole option , to require Grantee to
remove or neutralize any improvements constructed in the Easement by Grantee.
9. Warranty of Title . Grantor wamnts and represents that Grantor is the fee simple
owner of the Easement Property and that Gnin t,,r h'\S full right, title and authority, that this Grant
is effective to grant and convey to Grantee th e Access Easement, and that this Grant of an
easement is superior to all other grants . Granter farther covenants and agrees to indemnify,
defend and hold Grantee harmless from and against any adverse claim to the title o, :he
Easement Property by all and every pc.TSOn or persons lawfully claiming or to clain , the whole or
any pan thereof.
I 0. Binding Effect. This Grant shall extend to and be binding upon the heirs,
personal representatives, successors and assigns of the respectiv~ parties hereto . The terms,
covenants, agreements and conditions in this Grant shall be construed as covenants running with
the land .

THIS GRANT of sewer line easemeni (this "Grant") is made this~• day ofFebruuy,

Colorado 80127 in favor of the CITY OF ENGLEWOOD, COLORADO, ("Grantee") whose
address is 3400 South Elati Street, Englewood, Colorado 80110 .

2. Consideration. As consideration for this Grant, Grantee has paid Grantor the sum

acknowledged by Granter.

or other control systems, cables, wires and connections .
• Access. Grantee shall have the perpetual, none xcl usive right ofin i,-ess ~na egress
in, to, over, through and across the Easement Property for any purpose necessary or desirable for
the full enjoyment of the rights granted to Grantee under th is Grant.
5. Restoration. Grantee agrees .hat after the construction, maintenance, repair,
replacement, or enlargement if any for the Lines and Appurtenances, Grantee shall restore the
surface of the Easement Property as nearly as reasonably possible to the grade and condition it
was immediately prior to said construction, maintenance, repair, replacement, or enlargement,
except as ma~· be necessary to accommodate the Lines and Appurtenances. Grantee agrees to
restore and repair any improvements ofGrantor on the Easement P.-operty which are damaged,
modified or altered by Grantee during said construction, maintenance, repair, replacement or
enlargement. Grantee further agrees to replace any topsoil removed from any cultivated or
agricultural -u-eas on the Easement Property and to remove any excess earth ruulting from said
construction, maintenance, repair, replacement or enlargement, at Grantee's sole cost and
expense.

RECOMMENDED ACTION:
Th r.t the dedication of the 30-foot sanitary sewer easement and the emerge ncy vehicle acces s
easement for the Duggan 's Subdivision.
BACKGROUND AND ANALYSIS:
Duggan's Subdivision is a resubdivision of two parcels located at the southwest comer of South
Sama Fe Dr iv e and West Union Avenue. The purpose of the resubdivision was for the
realignment of the property line between the two existing parcels to facilitate the sale of the
northern parcel, Lot I. As a result these two new easements were required. The 30 foo wide
sanitary sewer easement was required due to the extension of the public sewer main so that each
new lot would have separate sewer service . The Water and Sewer Board approved this easement
on January 11 , 2000. The emergency vehicle access easement was required by the Fire Mar.;hal
to maintain the historic emergency access to an adjacent parcel .
FINANCIAL IMPACT:
There are no negative financial impacts to the City associated with the
casement ded ications .
