AN ORDINANCE AMENDING TITLE 8, CHAPTER 28, OF THE ENGLEWOOD
MUNICIPAL CODE 1985 , PERTAINING TO THE MECHAHICAL CODF: OF THE
CITY OF ENGLEWOOD , COLORADO .
WHEREAS, the City of Englewood haa used the Uniform Mechanical {'.ode aa a
model conetruction code since 1970; and
WHEREAS, this Code is updated periodically to keep pace with changinr
conetruction technology; and
WHEREAS, the City of Englewood Division of Building and .:lafety ataffhaa
thorougbly n,viewed the 1997 Edition of the Uniform Mechanical Code and
recommends adoption thereof subject to certain exceptiona, modification1 and
amendment;
NOW , THEREFORE , BE IT ORDAINED RY THE CITY COUNCIL OF THE CITY OF·
ENGLEWOOD, COLORADO , AS FOLLOWS:

• There is hereby adopted, by reference thereto, the Uniform Mechanical Code,-HKM-

B. Section 115.2 shall be replaced with the following:
115 .2 Permit Fees. The fee for each permit shall be as set forth in
Table No. 1-A of the-.lill Uniform Building Code .
C. Section 115.3 shall be replaced with the following :
115 .3 Plan Rc,iew Fees. When submittal document,, are required by
section 113.2, a plan review fee shall be paid. The plan ntview fee for

D. Section 115.3.2 Shall hf. ,eplaced with the following:
115.3.2 Incomplete or Chanced Plana. When plans are incomplete or
chanced so aa to require additional plan review, an additional plan
review fee shall be charged at the rate shown in Table No. 1-A of. the
¼99+ .lfil Uniform Building Code.
E. Section 116.6.3 The firat paragraph shall be replaced with the following :
116.6.3 How Obtained. To obta\n reinapection, the applicant shall file
an application therefor in writing upon a form furnished for that
purpose and pay the reinapection fee in accordance with Table No. 1-A

declares that this Ordinance is promulgated under the general police power of the
City o( Englewood, that it is promulgated for the health, safety, and welfare of the
public, and that this Ordinance is neceaaary for the preservation of health and aa!ety
and for the protection of public convenience and welfare. The City Council further
determines that the Ordinance bears a rational relation to the proper legisla\ive
object sought to i>< obtained.

Ordinance or the application thereof to any person or circumstances shall for any
reason be adjudged by • court of competent jurisdiction invalid, such judgment shall

provision or the Code or the City or Englewood by this Ordinance shall not ralease,
extinguish, alter, m,,dify, or change in whole or in part any penalty, forfeiture , or
liability , either civil or criminal, which shall have been incurred under such provision,
and ench provision sball be treated and held as still remaining in force for the
purposes cf sustairjng any and a.U proper actions, suit.6, proceedings, and
pf'Olecutiona for the enforcement tfthe penalty, forfeiture, or lli.b ility, as well as for
the purpose of sustaining any judgiuent, decree , or order which can or may be

COUNCIL GOAL AND PREVIOUS COUNCIL ACTION
The 1994 sanes of Uniform Codes were adopted by Council and become effective on January
22, 1994. These codes included the Uniform Building Code, Uniform Plumbing Code, Unllorm
Mechanical Code, uniform Fire Code, Uniform Code for the Abatement of Dangerous
Buildings and the 1993 National Electrical Code.
RECOMMENDED ACTION
The Building Division of the Department of Safety Services recommends the adoption, by
ordinance , of the 1997 series of Uniform Codes Including t~" • n99 National Electrical Code .
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
The 1997 series of Un;form Codes provide regulatory guidelines that reflect the most recent
technological advancements and safety factors for residential and commercial proper'i•1s in the
City . These cndes are the recognized standards for lhi.5 part of the country and conti· ,~ lo
serve this community well .
