AN ORDINANCE Al !ENDING TITLE b, CHAPTER 20, OF THE ENGLEWOOD
MUNICIPAL CODE 1985, PERTAINING TO THE PLUMBING CODE OF TlIB Cl'l'Y
OF ENGLEWOOD , COLORADO.
WHEREAS , the City of Englewood baa used the U!liform Plumbing Code as a
model oonstruction oode since 1970; and
WHEREAS, this Code is updated periodically to keep pace with cbangina-
construction technology; and
WHEREAS, the City of Englewood Division of Building and Safety lltaff baa
thoro111bly reviewed the 1997 Edition of the Uniform Plumbing Cede and recommends
adoption thereof subject to certain excepl.ions, modifications and amendment;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD , COLORADO , AS FOL!.OWS:
~-The City Council of the City of Englewood, Colorado hereby amends
Title 8, Chapter 20, of the Englewood Municipal Code 1985, to read as follows:

8-20-1: CODE ADOPTED:
There is berehy adopted, by reference thereto, the Uniform Plumbing Code,-¼9H

The Clerk shall maintain a copy of the Code which will be avoilab1e for irun,ection
during regular business hours

8-2C-2: SPECIFIC MODIFICATIONS TO ADOPTED CODE :

A. Section 103.4.1 Shall be replaced with the foll owing:
103.4.1 Permit Fees. The fee for erch permit shall be as set forth in
Table No. 1-A of the-¼994 lfill1 Unifonn Building Code .
B. Section 103.4.2 shall be replaced with the following :
103 .4.2 Plan Review Feea, When submittal documents are required by
section 103.2.2, a plan review fee shall be paid. The plan review fee for
plwnbing worl: shall be equal to 65 psrcent of the total plumbing
pennit fee as set forth in Table No . 1-A of the-¼994 lJ!91 Uniform

C. Section 103 .5.6, The fourth paragraph shall be replaced with the following:

an o.r:,licatioo therefor in writing upon a form furnished for that

declares that this Ordinance is promulgated under the general police power of the
City of Englewood, that it is promulgated for the health, safety, and welfare of the
public, and th•~ this Ordinance is necessary for the preservation of health and safety
and for the ~rotectiorl ofpl!._ll_lic oonvenience and welfare . The City Council further
determines Utot the 0rdinanl!e bears a rational relation to the proper legislative
objoct sought to be obtained.
~ Seyerabjlity If any clause , sentence, paragraph, or part of tltja
Ordinance or the application thereof to any pereon or ciitumstances shall for any
reason be adjudged by a court of competent jurisdiction invalid, such judgment shall
not affect, impair or invalidate the remsinde, of this Ordinance or it application to
other persons or circumstances.

repealed to the extent of such inconsistency or oonflict .

eningw.sh, alter, modify, or change in whole or in part any penalty, forfeiture, or
liability, either civil or criminal, which shall have been incurred under such proviaion,
and each proviaion shall be treated and held •• still remaining in force for the
purposes of sustaining any and all proper actions, suits, proceedings, and
prosecutions fc.-the enforcement of the penalty, forfeiture, or liability, as well as for
the purpose o( sustaining any judgment, decree, or order which can or may be
rendered, entered, or made in such actions, suits, proceedings , or prosecutions.
~-Choice of Code. Any party who hes a pending application, where the
permit application and final site plan have been submitted to the City before the
date of final adoption of this Ordinance, shall make an election to proceed under
either the current Code or the 1997 Code but not a combination thereof.
~ ~ The Penalty Provision of E.M.C. Section 1-4-1 shall apply to
each and every violation of this Ordinance.

COUNCIL GOAL AND PREVIOUS COUNCIL ACTION
The 1994 series of Uniform Codes were adopted by Council and become effective on January
22 , 1994 . These codes Included the Uniform Building Code , Uniform Plumbing Code , Uniform
Mechanical Code , Uniform Fire Code , Uniform Code for the Abatement of Dangerous
Buildings and the 1993 National Electrtcal C'lde .
RECOMMENDED ACTION
The Building Division of the DepartmJnt ~f Safety Seivlcei. recommends the adoption, by
ordinance, of the 1997 series of Uniform Codes including the 1999 National Electrical Code .
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
The 1997 sertes of Uniform Codes provide regulatory guidelines that reflect the most recent
technological advancements and safety factors for residential and commercial properties in the
City . These codes are the recognized standards for this part of the country and continue to
serve this community well.
