J/.:,_ SERIES OF 2000 BY AUTHORITY COUNCIL BILL NO. 49 INTRODUCB:D BY COUNCIL MEMBER BRADSHAW AN ORDINANCE AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT ENTITLED "18111 JUDICIAL DISTRICT JUVENILE ASSESSMENT CENTER INTERAGENCY AGREEMENT' AUTHORIZING ALLAGENCIF.S PARTICIPATING IN THE JUVENILE ASSESSMENT CENTER TO PROVIDE AND SHARE INFORMATION WITH EACH OTHER CONCERNING JUVENILES WHO PARTICIPATE IN THE ASSESSMENT AND INTERVENTION PROCESSB:S CONDUCTED BY THE JUVENILE ASSESSMENT CENTER. WHEREAS, the Juvenile ANeument Cent.er waa created as one 10lution to the problems of fralJDlentation of juvenile aervices, lack of ce ntrali7.ed information on juveniles' contactl with law enforcement and other ju, :le justice agencies, and the lack of altarnativea to referring j"venilea into the juv J ,.tice syatam by the liq of delinquency petitiona ; and WHEREAS, the mwion of the 18,. Judicial District Juvenile Asaea,,ment Cent.er is to provide• coordina!ed , multi-agency , single entry site which contributes to the safety of youth , fai.,ilies and community throUih early intervention, comprehensive asaesament and improved acce11 to appropriate services ; and WHEREAS , all information received by an authorized recipient shall be kept confidential by the recipient and ahall not be further released except to other authorized recipients: and WHEREAS, the Juvenile Aaaesament Center will aasist law enforcement and the juvenile juetice syatem by maintaining a centralized databaae of law enforcement contacts , school disciplinary actions and referrsls into intervention services, in order to improve deciaion malting regarding the need for arrest, incarceration, community services and legal consequences for the juvenile■; and WHEREAS , the Juvenile Aaaesament Center will further auiat law u forcement by providing centralized booking and temporary care of juveniles until their pare uta are able to take custody of them , so that officer s can more quickly return to their dutiea; and WHEREAS , the goals of the Juvenile Asaeasment Center are to coordinate and centralize the collection of aase88ment and background information ra1arding juvenile offenders , eliminate the duplication of the information collectec by individual agenciea, provide integrated, detailed assessments of juveniles and their families , reduce involvement of juveniles in the juvenile juatice aystem , improve deciaion-making concerning arrest, incarce ration , intervention and consequences and provide more timely and appropriate re ferrals of juveniles for services ; and -1- WHEREAS, then, is a need for the District Attorney'• Office, nll police a1encie1 within the 18" Judicial District, the Probation Department, the Department■ or Human Services, the Division of Youth Correction, the Senate Bill 94 Procram•, public mental health agenciea and the school diatricto to provide anrl ibare with each other pertinent information concerning juveniles who participate in the aaeeaoment and intervention proceaoe• conducted by the Juvenile AsaeBBment Center; and WHEREAS, the Colorado Children's Code, Section 19-1-304, C.R.S .. limita thoee persona and agencies that are allowed acc.ess to juvenile delinquency records without court order; and WHEREAS, access to achoo! ffi:Orda without court order ia limited by both 20 U.S .C. Section 1232(g)(a)(l)(A) and Section 24-72-204, C.R.S.; and WHEREAS, thia limited aa:eao of information inhibita decisions which will beat serve the intereata of the juvenile and the community; and WHEREAS, the City ofEngle.,ood participated in the development and implementation of the 18" Judici.!l District'• Juvenile Assessment Center Projact along with approximately forty public and private, agencies, including law enforcement, achoola , human oervicee, mental health agenciea, the District Attomey'a office, probation, the Division of Youth Corrections and munici pal and county governmt!nta to provid e an effective , coordinated interventi on for juvenile who are at risk for involvement or who are involved in the juvenile justice system ; and WHEREAS, thia project is a multi-agency collaboration which would not enat without the strong support and guidance from the variouo participating agenciH; and WHEREAS, interagency agreement for the release of information has been reviewed and approved by Chief Judge K,mneth Stuart and the 18" JudicW District Management Team ; and WHEREAS, the interagency agreement will be signed by all participating agencies demonstrating their continued commitment to the Juvenile Assesament Center; NOW , THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: Swilm..l. RECOMMENDED ACTION • Approve an ordinance authorizing an Intergovernmental agreement with the 18" Judicial District authorizing all agencies participating in the Juvenile Assessment Center to provid11 and share Information with each other concerning juveniles who participate In the assessmem and intervention processes conducted t,y the Center. • BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED By virtue of on-going interaction with the 18" Judicial District regarding the Assessment Center, the City of Englewood has become a primary participant In the procea~. This ordinance re- affirms our commitment to the Center. FINANCIAL IMPACT None with passage of th is ordinance, outside of normal Safety Services operational costs . The City previously transferred a federally awarded grant of approximately $25,000 to the 18" Judicial District for initial operating costs of the Center.
