AN ORDINANCE REPEALING TITLE 11, CHAPTERS 3(A), 3(8), 3(C), AND TITLE 12, CHAPTER
4; AND CREATING A NEW TITLE 11, CHAPTER 7, ENTITLED "CITY RIGHTS OF WAY.
PERMITS AND REQUIREMENTS", OF THE ENGLEWOOD MUNICIPAL CODE.
WHEREAS, obstructions and excavations in City rights of way disrupt and intsrfere with public
uae of the rights of way; and
WHEREAS, obstructions and excavations \II City rights of way result in loea of parkinc and Jou
of business to merchant,, and others whose plares of buslneea are in the vicinity of such obttructions
and. excavations; and
WHEREAS, it is desirable to adopt policieo and re,ulalions l.hich will enable the City al
Englewood to gain greater control over the diaruphon and interference with the pub.lie uae of public
streets and rights of way, in order to provide for tile health, aaf'ety and wellbeinc nf the City's -
l'eaidents and uaera of City streets; and
WHEREAS, significant public funds have been invested to acquire ,uiJd, maintain and repair
the streets within the City and cuts and excn1 •ations in the streets reduce the useful life of the
pavement infraatructure; and
WHEREAS, lisnificant public funds haft been invelted to place and mainWn landscaping
within public ri,ihta of way in the C_ity and cuts and excavationa in the public rishta of way cauae
damage to, and increase the costs of main~ that landscaping; and
WHEREAS, at the present time, the City does not ha'!e a detailed map or d•tsbaae indicating
the location, natv.re, or extent of the entire system underground utility and telecommunications
facilities; and
WHEREAS, t!,' ·1arious public an<! commercial utilitiaa w)w:h install, maintain, and operate
facilities under the City's streets sre constrained, from time to time, to make excavation cuta which
degrade the surfacos of these thoroughfares, thereby reducing their useful life; and
WHEREAS, operators of motor vehicles (private and commercial) pay addsd saaolino tuee to
compensate for the damage their vehicles caUM to City streets and roads. Part of thaee taxes are
used by the federal government (the federal highway •t, ust fund") for construction and maintenance
of interatst e and federal highways. The State of Colorado annually transfers revenue from gaaoline
taxes to the City for street maintonance. Public and oommercial utilities which degrade the etreets
,,. esently do not adequately pay for the long-term damage done to the roadway aurfaCO'd; an.!
WHEREAS, at the present time there is no formal mechanism nor legal requirement that public
and commercial utilities and telecommunicationa companiea coordinate roadway cute;

V'1uy Ordinance , (Council Bill No . 40) on first reading .
'COMMENDED ACTION
The Public Works Department recommends that Council approve on first reading the ordinance
repealing Tttle 11, Chapters 3(A), 3(8), and (3C), and Title 12, Chapter 4, and the creation of a new
Title 11, Chapter 7, entitled City Rights-of-Way-Permits and Requirements , of the Englewood
Mun icipal Code . And Public also requests that City Council set N?vember 6, 2000 as the de.le for )Ito
Public Hearing on th is matter.
BACKGROUNt',. At '~L-.,;,,3, AND ALTERNATIVES IDENTIRED
Public Works has ,:,;e~ ~11:crd ng this portion of the code since 1965. In 1996 , the federal
government manc,,:ad \hat there be no barriers of entry for telecommunication .:ompanies to
enter markets . As a 1 •suit, in certain areas of the country telecommunication service
providers have explodeci from one provider to fifty providers . The 1965 Code does not enable
staff to protect the public's investment in our street Improvements . When there were only
th ree major ,>rivate providers of services, using our rights-of-way to conduct business, th is
was not percei ved as being a problem . Any time a street cut is made , the service life of the
roadway surface is adversely affected . Colorado law allows municipalities to recover costs for
the use of rights-of-way , providing the charges are di,ectly related to the costs arising out of
the right-of-way usage . The Right-of-Way Comm ittee of the Greater Metro
Telecommun icatio,1; !'.:!:~,sortium (GMTC) has examined cost recov ery !,es used throughout
the country , and has recommended a Model Right-of-Way Ordinance . Staff has taken the
model ordin ance and several adjustments in order to deal with specttic issues and challenpes
that we face in our city as well r.s numerous changes in response to concerns that have been
raised by AT&T , Quest Communicat ions , Mcleod USA , and Xcel Energy .
The telecommunication and utility companies have numerous issues and objections with the
cost recovery fees proposed by the GMTC . The fee amounts will be addressed in a separate
resolution. Staff is recommending that the controve rsial fee elements be left out of the
resolution until the Colorado Supreme Court reeches Ii decltJon on the Quest
Commun ications and City of Denver case .
In June, City Council adopted on first reading the proposed City h,ghts-of-Way -Perml 1s and
Requirements Ordinance. ~ a result of ail the changes ll]~de, it is necessary to have
another public hearing on this proposed ordinl'nce . The letters and memos containing the
utility and telecommun ication service provider concerns that we have received are i.itached.
FINANCIAL IMPACT
The proposed Title 11, Chapter 7, creates the mechanism to charge fees to cover the costs
associated with private individuals and companies that use public right-of-way . The propoaed fees
are not being established al this time but the mechanism will be put into place with the adoption of
this ordinance. The cost for administration of this ord inance will increase, because this code requires
grea :.v communication and COOldination between the City and the telecommunica1fon and aer.ice
pro,,~rs . and detailed records of street histories must be factored into the proposed permit fees .

SUBJECT: Right of Way Ordinance Issues and Changes

We have bad several meetings with various representatives from Qwest Qmunuoications,
EcclEnergy , AT & T in August to discuss the issues and concerns that they bad with the p,oposed
Right of Way Ordinance. As a mrult of these meetings, we took another look at the onlinancc and
made significant changes in an attempt to workwitb the parties that are most irupacted.
The changes are summarized below :
The following words were being used in the ordinaoce, so the followjng definitions were added ;

Service Connections -was added in order to create a permit exemption for service provider.
In addition, we m,:xlified the following definitions to address specific service provider concerns :
Emergency-was modified to include a "interruption of services" provision.
Swplus Ducts or i:onduits definition was modified to extend the number of years that
companies could resrrve surplus ducts fur future use.

• !n Section D, we changed the wording to make the permitting the developer's responsibility
instead of the permittec's .
• In Section F, we created a "routine maintenance" exemption, whereby permi ttecs can maintain
their facilities , proy;ding they can do the wodc without bothering others.
l 1-7-5: Permit APpllcadoi.-Permlt Contents.
• In Section A. I .j, we tried to make clear that the companies that are not required to provide
separate perform, cc bonds, a,..., not required to provide iterniz.ed cost estimates.
• In Section A.3, we tried to be more llcxiblc to allow City pennits to be issued with the provision
that if other permits were required, then we would just need to see evidence that they bad been
applied for instead of requiring these permits to be obtained prior to our issuance.
• In Section A.6, we changed our requirements to merely requiring "a signed statement" instead of
''providing evidence" that permittet".. were in compliance on previous pennits issued .
• In Sec tion A.9, we relaxed the wo•.ding to indicate that the permittee is only responsible for what
is actually known.
• In Section B, we made it a requiicmeut to update pennits only in cases where "material" changes
oc~urred .
11-7-6: Pennlt Fee:
• In Section B, we added a statcmem to make it clear that degradation fees were only going to be
charged where ''material disturbance" of the right of way OCCUJTed.
11-7-8: Insurance and lndemnllkadon:
• In S~1ionA.1, we used the wording sugge&led by AT&T that was moreconcbe than our original
submittal .
• In Section C. l, we changed the wording to make it clear that permittee& did not have to indemnify
the city when we caused damages due to our ''negligent or intentional acts".
• In Section C.3, we changed the wording to make the permittee responsible to cover ''reasonable"
expenses instead of"actual" expenses when the City bad to deti:nd itself in third party actions .
• In Section C.4, we changed the wordhg so that permittecs are not responsible for holding the City
bannless in cases where the City officers, employees, or agents are negligen~ instead of"gross
negligent".
11-7-10: Performance Warnoty/Guaran~e:
• In Section D, we made it a requirement that the City notify permittees in writing of needed repairs
during the warranty period.
• In addition , we added Section Etha! now exempts pennittees from warranty responsibilities when
their work subsequently gets distumed by others.
11-7-14: Traffic Control:
• In Section G, we provided permittees an exemption from having to get traffic control plans
reviewed and approved by the City when doing routine maintenance.
11 -7-15: General Rigbll of Way Use and Construcdon:
• In Section B, we modified the minimal clearance requirements to just water and sewer facilities
instead for all "public infrastructure".
• In Section C. I, we made it a requirement that undergrotmding be done at ''no cost to the City"
instead of at the ''perrnittee's expense", since the permittee may be able to recover these costs
from other parties .
• In Section C.3, we changed the wording to treat the Ci1y like other service providers when we ask
perrrJttees to allow us to cccupy the same trench or bore for non.City ducts and conduits.
11-7-17: Mlnlmlzlng the Impacts of Work In the Rlpts of Way:
• In Section C, we added routine maintenance to the list of exemptions to perntit service providers
to work on their facilities during non-peak hours.
• In Section D, we changed the wording to require perntittees to "use their best efforts" to eliminate
tracking of mud and debris onto streets and sidewalks instead of "forbidding" mud and debris to
be tracked .
• In Section E, we made a simi lar change to "best efforts" with respect to protection of trees and
landscapmg.
11-7-19: Construction and Restoration Standards for newly Constructed or Overlayed Street,:
• We added a Section E, that allowed exemptions in certain cases for non-emergency operations to
cut new or resurfaced roads in order to provide services.
11-7-20: Relocation of Facilities:
• We removed the "sole cost and expense" wording to read instead "at no cost to the City", to allow
perntittees to seek reimbursements elsewhC1?..
11-7-21: Abandonment and Removal of Facilities ;
• In Section C, we created the mecharJ sm f<.,-ahandoning facilities in place.
11-7-22: Emergency Procedures:
• We relaxed the notification requirements in order to recognize that in certain instances it is not
necessary to notify the City of emergency rq>airs.
