Wanush, Director of Community Development ISSUE/ A.CflON PROPOSED Adopt a bill for an ordinance granting Trident Properttes Ltd. the rtght to use -municipal right of way for an entrance sign. PREVIOUS COUNCIL A.CflON None . STAFF ANALYSIS The sign for the entrance to Home Club and the former Buyer's Club (now Office Depot) buildings has been In existence since 1988 and Is now being redesigned to accommodate the Offi ce Depot lease . The stgn ts located In public right of way In the median of In ca Way and h as n ever been formally ap proved by City Council . The Colorado Department o' Transportation (CDoT) must also penntt this sign . The opening of Office Depot provides us with an opportunity to establish a formal agreement for the u se of the public right of way whJch s hould b e In effec t , to require the appropri ate hold hannless provision and to also process the appropriate penntt fro m the State Department of Transportation . When the lack of a penntt and co ntract was brought to our attenl.lon earlier thJs year , staff knew of the lease negotiation and decided to wait until the new party was Id entifi ed to draft an agreement so that the process would not have to take place twi ce within a few months' period of time. Trident Properti es Ltd .. the own er of the properties will.:~ the lead on the contract with the City of Englewood and the pennlt with the state. The City Attorney has " drafted an agreement between the City and Trident Properties whJch Is very slrnJlar to the one between the Urban Renewal Authority and the City for the Phar Mor Plaza sign. The URA will not be a party to thJs agreement. The hold harmless clause used In the Phar Mor/URA agreement was reviewed and approved by the Colorado Attorney General's Office for Its adequacy. The proposed sign will be 6'2" by 12 ' and will be 20' hlgh. The "old" stgn or existing sign ts 4'9" by 10'6" and Is 18' high. The square footage will Increase from 49.9 sf to 73 .2 sf If approved . In contrast, the Phar Mor stgn Is nearly 120 sf. and Is 16.5' hlgh. The new sign Is designed to be accommodated by the existing steel pole and structure whJch will not be changed. The sign color will be blue and whJte for the Entrance portion and re · and whJte for the store ldentlllcatlons . The sign Is In conformance with the state requlrClil!cnts for outdoor advertising signs whJch 11rnlts the sign to no more than two advertisers. BACKGR~UND Staff has reviewed the request and the sign dimensions and recommends approval of a stgn at thJs lo cation within the parameters of the request. There Is a need for traffic on Hampden (285) to Identify the tum for the Englewood Marketpla ce whJch Is why the sign was pennttted by the City In 1988 . Obviously Offic e Depot Is anxious to be able to begtn construction on the new sign face for their January opening, and we are endeavoring to expedite this contract s o that they can commence with the changes .
