This matter came b efore the City Planning and Zoning Commission on November 19, 1991, in the City Council Chambe rs of the Engle- wood City Hall upon the r equest of the City of Englewood to con- sider an amendment to the R-2, R-2-C and R-4 Zone District regu- lati on to permit the u se of the rear twenty-five f eet o f certain properties for commercial off-street parking. Tes t imony both i n favor and in opposition to the proposed amend- ments was r eceived. The Commission received the Notice of Publ ic Hearing and the Staff Report, wh ich we re incorporated i nto and made a part of the record of the Public Hea ring. After c onsider- ing t he statements o f the witnesse s and re viewing the necessary documents, t he mem bers of the City Pla n ~ing a nd Zo ning Commission made t h e following findings a nd r:c c lu si,,ns. FI ND I NG:; ')F FACT 1. THAT th e Public He a ring l.'as i n itidted by the Ci ty o f Englewood to consider am end men t s to the R-2, R-2 -C and R-4 Zo n e District r e g ulation as they relate to off-street parking for c om-me r cial purpo ses . 2. THAT the no ice of the Public Hearing was published i n the Englel.'ood Herald, thP officia l City newspaper, on November 7, 1991. J. THAT Mr. Harold J. Stitt, Neighborhood Services l,dmin- istrator, testified that th e ame ndm e nt s \O the R-2 and R-2-C are proposed to add ress the nP.rd for additl ona l parking for South Broadway business and f o r c c o protection of the adjacent residen- tial neighborhoods. 4. THAT the following co nd ition s a re i mposed as a part of developing the r e ar tw e nty -five feet of property for off-street commer cial parking i n th e R-2 and R-2-C Zone Districts: a . Th e parking area must be screened from the res- idential portion of t h e lot by a six foot opaque fence. Side yard fences must als o be provided to screen adjacent property. These fences shall also be six feet i n he ight, e ,:.:ept within ten feet of the rear property line the fence cannot exceed 42 inches i n height. b. The parking area must be o { a hard s urface to prevent the movement of dirt and debris from the parking area onto public right-of-way. c. Parking stops must be placed in the parking area to prevent damage to the fence by vehicles. d. Provisions must be made for the collection of trash pe ~ City ordinance . e. The final design of the parking area must be approved by the Director of Commun i ty De ve lopment or the appro- priate designee. f. No storage of vehicl es is perm :tted and the lot is to be used solely for the park ing cf employees and customers. g. No veh icl e i n excess of 7,00( pounds ma y be parked i n the parking area. h. THAT Conni e Fortner, 4542 South Acoma s tate d that her concern was the effec t th is ame ndmen t might have on property val - ues . 8 . THAT Pete Quiring 4524 South Acom a stated his concern regarding limiting the use of the rear twenty -five feet to parki ng only. 9. THAT the propcsed amendments had been present to the pu b l ic through a series of public meetings. CONCLUSIONS l. THAT proper notice was published in the Englewood Herald, the official City newsp &per, on Nov e mber 7, 1991. 2. THAT the proposed amendme nt were considered by the Planning and Zoning Commission at a Public Hearing on November 19, 1991. 3 THAT testimony was received from the public and in the form of the Staff Report which was made a part of the record. 4. THAT the Planning and Zoning Commission inserted the following language to proposed conditions 1. and 9.: 1. The parking area must be screened from the res- idential portion of the lot by a six foot opaque fence. Side yard fences mu •at ,1lso be provided to s c reen adjacent property. DECISION THEREFORE, it is t.h<> decision of the Planning and Zo ning Commi ssion that the propt3ed a me ndm ent s to the R-2, R-2-C and R-4 Zone Distric t regulations be approved and referred to City Coun- cil with a fa vorable re com mend ation. This decision was reached upon a vot e on a mot ion made at the meeting of the City Planning a nd Zoni ng Commissio n on Novem- ber 19, 1991, by Mr. Draper, seconded by Mr . Glynn, which mo tion states : The Plann ing Co mmission recomme nd to City Council the Englewood Mun icipal Cod e (Comprehensive Zoning Ordinance) be amended by addi ng two new sections , Section 16.4-5n(5 ) and Sec- tion 16.4-6M(5), to read as foll ow s: Parking Area. When a n R-2 Medium Density Residence District or R-2-C Medium Density Residence District abuts or i s 3djacent to a B-2 Bus iness District, the portion of the l ot adj a- cent to the Business District may be used as a parking area by any commercial establi s hment to a depth of t we nty -five feet (25 ) if the following condition a re met: 1. The proposed amendment In cludes nine condi ti ons that mUBt be met before the parking area can be developed. At present, the R-4 Zone District allows commercial p arking lots as a u se by ri gh t. To develop such a parking lot, 24,000 square feet of lot area Is r equired . Th e proposed amendment to the R-4 Zone Distric t would r e duce the r equired lot area to 12 ,000 square fe et . ThJs proposed r eduction wo uld make It easier to ass emble pr.i p erty for such a parking lot. BACKGROUND The Issue of off-street parking for South Broadway bus inesses was a ddressed In the l 970's with the amendment of the R-4 regulations to allow for the d evelopment of commercial parking Iota. However , to date this parking provision has not teen widely utlllzed . Clearly, another means of addressing this parking problem was n ee ded. Staff undrrtook a study of the problem and determined that the proposed amendments would be the most workable . The staff d e termined that while parking Is not a problem for every business, there are problem areas. Tne propoaed amendment would allow business owners to negotiate with resh1entlal property owners on a case by case balllll without having t negottate for the entire property In the case of the R-2 and R-2-C areas. Furthermore this amendment has the least - tmpact on the residential character of South Acoma Street and South Lincoln Street, while offering a reaaonable solution to the parking problem. The Plan ning Commlsslon held a Publlc Heartng on the proposed amendments on Novemb-!r 19, 1991 , at which time they we re a pproved .
