WHEREAS , the City of Englewood , on behalf of the ~;nglewood Deparlm nl of Sofety
Services, Police Division, has submitted an application to the Stale of Colce,do Department of
Transportation, for fed eral funding to conduct a traffic safety project; a nci
WHEREAS, the match i · .g lunds for this project are included within th e Department of
Safety Services Budget; ar1~
WHEREAS, the Stale of Colorado require, the City to formally approve the Englewood
Dei,a rtment of Public Safety (402) Contract ti.tween the City and the Dep artment of

~-The Englewood Department of Public Safety (4 02) Contract generally contains the
following :
1. The City of Englewood shall carry out the program, conduct all the activities and
provide the services dell<ribed in the Scope of Work attached t.o the Contract as
At tachment A, to achieve a 10% reduction ill cruhes at target locations.
2. In the performance of the work, the City of Englewood •hall comply with ell
applicable administrative procedures and r.ot\tract requiremenls co ntair1ed in the
October I, 1990 Colorado Highway Safe,y Contract Man agement Manual.
3. The City of Enclewood shall submit periodic and final reporl.a to the State accordit,g to
t'ne requirements of the Contract Manual.
4. 'th e Contractor shall comply with the budget for thia contract aa set forth in Page 3 of
Attachment A. The City of Englewood sha I be solely responsibl e for all cost s
in.:urred in exc ess of this budge t amoun t.
5. The total estim ated program cos ts shall be $36 1,593 . Subject lo the co nd itio ns of thi s
contract, th e S tale and the Ci ty of En glewood shall participate in provi d ing this
amount as follows :

High way Sa fety Act, Title 23, U.:;,c . Section 402, for the purposes hereof.
7. The term o· •his Conh'ecl sh all begin on the effective date end shell terminate 011
September ou, 1992. 'Th e ti!",-lh•e dote of this Contract shall be the date lhe required
signature approval of the Slate Controll er is obtained on this Cont ract, os evidenced
by the dale first appearing abeve . The City of Englewood agrees that any contrac t
work performed or costs incurred prior to the effective dale shell no t be compensated
under the terms of this Contrecl
8. The Ci ty of En glewood agrees that any subcontract entered in to under thi s Contract
shell meet ell applicable stale end federal r equire ments and must be a pproved by the
Director, Office e of Transportation Safety, prior to exec ution. The City of Englewood
sholl not assign this Cone 'act without prior written approval of the State.
9. a) Terminolion Due to Loss of Funding. The parties hereto expressly recogn ize the
City of Englewood is to be paid , reimbursed, or otherwise compensated sol ely with
fed eral fund s provided to the Stale for the purpose of contracting for th e services
provided for herein. Th erefore, the City of Engl ewood expressly understand s end
agrees all its rights, de mand s and claims to com pensation arisi ng under thi s
Contract ere contingent upon receipt of s uch fund s by the State. In the event such
funds or any pert thereof are not received by the State, th e Slate may immed iately
termina te or amend thi s Co ntract .
b) Termjnntjon for Cause. If, for any cause, the City of Englewood shall foil to
ful fill in a timely an d proper manner its obligations un der this Contract, or if lhe
City of Englewood shell vio late any of the covenants, agreements or s tipulation s
of this Contract , the Stele shall thereu pon have th e right to terminate this Contra ct
fo r cause by giving written notice to th e City of Engl ewood of such termination
and specifying th e effect ive dole th ereof, at least 30 da ys before th e effec tive dale of
suc h terminnLion . In th at event , all fini shed or unfin is hed documents, dnl n,
studi es, surveys, drawings, map s, models , photograph s nnd repo rts or olh e r
material prepared by th e Ci ty of Eng lewoo d unde r thi s Co ntract shall, ol the op tion
of the State, ~come ,ts prope rty , and lhe City of Englew ood shall be entitl ed lo
rec eive just and equi table co mp ensation fo r nny sa ti sfac tory work co mplelect on
suc h docu men ts nnd oth er mnl erinls .

Notwithstanding the above, the City of Englewood shall not be reli eve d of li &bili ty to
tho St.at.a for any damages ■u st.aincd by the St.ate by liability to the St.ate for nny
dnmage, sustained by the St.at.a by virtue of a breach of the Contract by the City of
Englewood, and the St.ate may withhold any payments to the City of Englewood for the
purpose of setoff until such time as the exact amount of damages due the St.at.a from the
City of Englewood is determined.
c) Terminntioo Coe Conveoieos:e The State may terminate this Contract at any
time the St.ate determines the purposes of the di stribution of monies under the
Contract would no longer be served by completion of the ProjecL The St.ate shall
effect such termination by giving written notice of termination to the City of
Englewood and s peci fying the effectiv e date thereof, at least 20 days before the
effective dat e or uu•h termin ation .
10. The Special Provision, attached to the Contract are made a part thereof.

WHEPE AS, this contract is executed by the State under authority of
"ect i vns 4 3 -5-401 and 24-42-101 , C .R.S., as amended , and is executed
ty the Contractor under authority of Section 29-1-203, C.R.S., ~s
ame nded, and as authorized by the formal resolution attached hereto as
~ttachment C; and
WHEREAS, the Contractor warrants it has taken all necessary steps
to e nsure the individual Contractor signatory below has the authority
to s ign chis Contract.
NO\~ THEREFORE, it is hereby agreed as follows:
1. The Contractor shall car ry out the program, condu.ct all the

:ca ched he reto as Attachm ent A and detailed in Attachment A. This

ref erenc e .
2. In the performance of the work, the Contractor s~all comply

C on tra ct Management Manual, hereinafter referred to as the Contract

con tractor s hare. The contractor may increase the contractor share
witt:out fu r th .?r s tate approval. This increase shall have no i i,,pac~ en

6. Tt:e State shall r e imburse the Contractor for the
accompli s hr:-.e nt of this Contract exclusively from funds made availabl e
for th is car.tract under the Highway Safety Act, Title 23, u.s .c.
Sec tion 402. Such re imbursement shall be only as provided in the A
Co ntract ltanual. Such r eimbursement shall be contingent upon the W

In 1990, the Englewood Departmeht ot Safety Service ■, Police
Division impleme nted a traffic unit staffed by seven
officers and one sergeant, Th>s unit was part ~ally funded
by a highway safety grant which provided a patrol vehicle,
c omputer, limited radar equipment and other miscellaneo.s
ca pitol items , As a r 0 sult, the traffic unit provided
specialized and selective traffic enforcement 366 days per
year on an average of twenty hours per day, Even though th e
grant funding has expired, the Divi ■ion continues to fulfil l
it's commitment to traffic enforce ■ent and safety by
maintaining the traffic unit and function ■ at the ori1inal
level,
Additionally, another grant was i ■ple ■ented in 1990 which
provided for a part time traffic safety education o f ficer
and assoc iated equipment and ■uppliea, Due to budgetary
approval problems, this 1rant is Just 1etting underway,
Also in 1990 the d iv ision is operstinl a LBAF grant designed
to im prov e overall DUI enforceP.ent, At thi ■ time, the LEAF
grant has been extr emely ■uccessful in attaining it's
objectives,
The Police Division wishes to provide the coaaunity with a
fully integrated and comprehensive traffic safety and
enforcc~ent program, which encompa ■••• all of the followin1:
1 . "Routine " enforcement techniquea.
2, Special and selective enfo rcement techniques relating to
normal traff ic as well as DUI enforcement.

Th e Divis io,1 would match these funds by continuing to staf f
the traf fic un i t at it's current level of sev e n police
officers a nd one sergeant at an e st imated cost in personal
se rvices of $408, 00~. The division would also continue to
supply gasoline and JP.a i ntenanu c osts, office supply costs
etc.
Justification:
The addit i on of a full time police officer would allow the
c ont i nuat i on o f a previoun grant which provided for part
time e duca tion programs, with t he added ass ign e d
responsibility for that of fic er to ac t as a traffic analyst
a nd liaison with the Traffic engineer and other private
g roups . The traffic safety officer/analyst would operate
part time in both cap c ities a11d analyze traffic problems
s pecifically as they affect the community and plan,
c oordinate a nd help i mple ■ent selective enforcement
a ctivities and projects and education programs wi th spe c ific
strategic goals and object ives designed to reduce accide nts .

e ngineering department . The addition of another personal
computer would allow the maintenance of the traffic bureau's
c urrent fun c tions and also provide the ·traffic education
analy s t the computer time and capabilities required o! the
position . Additional hardware for the current computer
wo uld allow it to interface with the new computer.
The division currently owns three radar detection devices,
only one of which is relatively new. The remaining units do
not represent the latest in speed d e tection technology and
also with use are declining in their range and
effectiveness. The traffic bureau'• s chedule .,t this time
provides for up to five officers workin• ■imultaneously
during peak traffic times, and the addition of four radar
units would allow for the replacement of the old unit ■ and
provide more speed enforcement opportunity during the peak
ti ■es .

Goals and performance statement:
The tra ffic safety education officer will conduct an average
of two s afety education presentations per week during the
grant year. These programs will be directed at schools,
formal or i nformal civic groups, and other groups who may
require special traffic safety education needs, (Senior
ci tizens, handicapped persons),
The traffic analyst will, with the assistance of the city
traffic engineer identify locations, violation ■ and traffic
patterns which historically create or enhance the number or
severity of accidents, and coordinat e educational,
en&ineering or selective enfor.cement solution ■ in an effort
to reduce the frequency or severity of accidents at the
targeted locations,
The traffic bureau will conduct special enforcement projects
as i dent i f ied by the analyst i n an effort to reduce the
fr eque ncy or sev er ity of ac cidents, but specifically will
co ndu ct selective enforc ement projects aimed at :
Pedestrian safety, seat bel t awareness, b icyclist safety,
speed e n forceme nt, and traffic relating to school
ac t ivities.

traffic enforcement statistics, both in terms of enforcement
increases overall and increases in specifically targeted
