B) BOARD The Hazardous Materials Board will be made up of Fire Chiels , Directors and the Sheritt of Ar apahoe County , (or the ir designees) who execute th is agree,11 .;n t or si milar agreement. In those regional res ponse areas where insufficient manpower exists at the levels of tra i,1ing requ ire d by OS HA stan dards , the Inc ident Commander may request assistance from th e closest regional r es ponse area where adequately trained personnel are available to handle th e incident. ESTABLISHMENT A) GE~ERAL Th e parties hereby establish an entity to be known as the Arapahoe County Hazardous Materials Board , wh ich shall be re sponsibl e for the organ ized administration and operation of the Arapahoe County Hazardous Materials Respon se program as descri bed below . While personnel assigned to Fire DepartmenVDistricts will pro vi de the primary support for the hazardous materials response program , nothing in this Ag reement will preclude police and sheriff's personnel from .cipating as a m ;er of the Hazardous Materials Response Team . • E.O.WER&._MID.JlUIIES.fil .. IliE..BQAB D The parties hereto agree the Board shall be empowered to develop , maintain , repair, control , and regulate a hazardous substance response program . The principle purpose of the program is to pro vi de, supplemental hazardous materials response equipment and trained personne l to operate the equ ipment throughout Arapahoe County . The program shall be provided in addition to , and not in place of , any already existir.,i equipment and manpower owned by the County or owned by the cities , or s~ ~ci al districts within the County. The Board sha ll select the members by the use of an Operations Committee whi ch shall be co mprised of, but not limited to , mem bers of the Hazardous Materials Response Team , designee(s) f:om ea ch fi re department /distr ic t who are designated as the Hazardous Materials SARA Title Ill Co mpliance Officer(s). The Operation s Committee shall advise the Board on all operational matters , equi pm en t requirements , and other ma tters related to operations of the Hazardous Materials Response Veh icle . In ad ditio n the Op er at ions Co mmittee will advise the Trai ni ng Com mittee ol specific hazard tra ini ng that may be needed . The Chairpersons for these Co mm ittee s will be ap po inted by the Board . Th e parti es hereto agree that the Board shall administer the operati on al needs of the vehicle , but the operations of the vehi cle at each sce ne shall be un der the dire ction of the Incident -mman,der. 5 The Ha zardo us Materia ls Emergency Response Team shall exist solely for the purpose of training, education , coo rd ination , and rapid deployment of qualified personnel in the event of a hazardous materials Incident. Such team shall not alter or affect the designation of any emergencA response authority , and any members of such t.eam shall at all limes rema in as employees of thei'9' res pec tive emplo ye rs . To the extent rn asonably poss ible, the entity requesting assistance shall have two ('.) or more personnel present at the location of any ha za rdous materials incident before reque sting the Hazardl"us Materia ls Re spo nse Vehicle and ad ditio nal autho ri ty team members . I V . LIABILITY AND INSURANCE The Board and its officers , d irectors and members shall be indemn ified pursuant to the provisions of the Governmental Immunity Act (Part 10 of Articl e 24 C.R .S .). The Board may purchase insurance to pro vi de coverage for the Board and its officers , directors and members against any suit or action which may be brought against said Board or its officers , directors or members involving or pertaining to any of their acts or duties performed or omitted in good faith for the Board . The parties to th is agreement acknowledge that the provisions of Section 29-5-108 C.R .S. concerning liability of a requesting jurisdiction and Section 29-5 -109 C .R.S . concerning worker's compensation coverage shall apply to those situations when personnel assistance is requested iA response to a hazardous material i ncident. The members shall provide appropriate liabilit9 insurance protection and work er's compensation cove rage as determined by the legislative authority of the jurisdiction . V HAZARDOUS MATERIALS BOARD The go verni ng body for the Boa rd shall consi sc of the Chief Officer or des ignee of each municipality, Fire Department and Fire Protection District which part ici pates in the Board and one member from the Arapahoe County She ri ff's Departm1mt who sh a!I function as the Chairperson of the Board . VI RESPONSE AND BILLING PROCEDURE The parties to the Agree ment concur that the member fire de oart ments/d istricts wi ll provid1. th e primary personnel support for the Ha zardou s Materials Resp<',1se Program, an d in no event ~hall a member be deemed an employee of the Board . Nevertheless, time and material co sts related to a specific incident may be reimbursed to the Board o r the spec ific agency(s) incurring the expen se. Su ch costs incl ud e, but are not limited to- salary , fuel , laboratory testing , packa ging , shipping , and equ ipment replacement. 6 The Board will establish a co ntingency fund which will be 10% of the preceding year's actua l -nditures , or $5 ,000 .00 , wh ic hever is greater. The monies for said fund will be genera ted from w eimbursement rece ived from responding to hazardous materials incide nt s wi th in the response areas . Said co ntingency fund s shall be utilized to defray the costs of unanticipated operating expenses . V 111 . FINANCIAL MATTERS A) EUNDS...MANAGEMEN T The Board agree s that the vari ous mon ies paid by the members of the Board , and any moni es generated by the Board itse lf , shall be placed into a desig nated fund and any expenses incurred by reason of operation shall be paid from such fund . All monie s belonging to the Board or designated for use by the Board shall be deposited in the name and to the credit of th e Bo ard with such depositories as the Board shall from time to time designate . The Board agrees that no disbursements shall be made from funds of the Board except by check, nor until a verified claim fo r services or commodities actually rendered or delivered has bee n first submitted and approved for payment by the Boa rd in writing .
