WHEREAS, Arapahoe County is a county organi ze d a nd existing pursu;rnt to the laws or
the State of Colorndo, and the Board of County Commissioners for Arap ahoe County have
design ate d its She r ill's Depa rtm ent as the Em ergency Res ponse Authority fo r Hazardous
Substance Inc idents pursuant lo Sections 29-22-102 (3) (b ) a nd 29-22-103 C.R.S.; and
WHER EAS, Arapahoe County has been designated the Local Emergency Pla nning
Committee for Arapahoe County, (excluding the City of Aurora) and is req ui red lo fulfill the
requi r emer,t; of th e Superfund Auth ori zat ion and R,nuth oriz ntio n Act of 1986 (SAR.A.

program for participating entities and will have nvnil nb le suppl em enta l hazardou s
response equipment nnd sup pl emental trained per~on ncl to operate this equipment in
Arapah oe County. This program is inLended to su p plement the ex~sl:ng hazardous
materials res ponse programs in Arapahoe County. Th is Agreement prov id es fo r the
appoin tm ent of one member fr om the Englewoo d S a fety Se rvices• Fi re Depa rtment to
the Arapa h oe County H aza rd ou s Mate r ials Boo rd.

employee of the Board.

by and between the following part ie s: COUNTY OF AR APAHO E, a bod y politic and corporate,
hereina fter referred to as "Count y." and the City of Englewood , a municipal corporation of the
State of Colorado , hereinafter referr ed to as "Fire Departme 11".
RECITALS
WHEREAS , ARAPAH OE COUNTY is a coun ty organized and existing pursuant to the laws
of the Stat e of Co lora do , and the Board of County Co mmi ssio ners for Arapahoe Cour.ty have
designated its Sherifrs Department as th e Emergency Response Authority for Hazardous
Substance Incidents pursuant to Sections 29-22-102 (3)(b) and 29 -22-103 of the Colorado Revised
Statutes; and,
WHEREAS, ARAPAHO E COUNTY has been designated the local Emergency Planning
Committee for Arapahoe County , (exc luding the City of Aurora) and is required to fulfill the
requirements of the ,uperfund Authorization and Reauthorization Act of 1986 (SAR.A. Title Ill);
and ,
WHEREAS , the City of Englewood is a duly organized municipal corporation existing under
A law of the State of Colorado and pursuant to the provisions of Section 29-22-102 (3)(a) has
-ignated Englewood Fire Department as the emergency response authority for hazardous
substance incidents occurring within the corporate limits of the City of Englewood ; and ,
WHEREAS , Section 29 -22-103 (3) Colorado Re vise d Statutes encourages mutual aid
agreements between emergency res ponse authorities for the purpose of utilizing equipr.,ent and in
order to safely handle hazardous substance inc idents : and,
WHEREAS . of Article XIV . Sect ion 18 (2) (a) of the Constitution of the State of Colorado
and Part 2 of Article I of Title 29 , C.R.S. enc ourage s and authori zes intergovernmental
agreements of this naturo : and .
WHEREAS , it is recogn ized that the hazardou s substance emergencies may arise in one or
tne ,ther of the jurisdictions of the parties of th is Agreement res ulting in greater demands than the
m.;npower , equipment , and expert is e of any one part y ca n handle . and that emergencies of such
intensi ty ma)' occur th at cannot be handled by the equ ipment of any one part y in whose jurisdiction
this emergoncy occurs : and,
HEREAS , the part ies are each authorized to respond to hazardous substance incidents
wit hin their jurisdictions ; and ,
WHEREAS , the parties desire to establis h an agree ment to rr0vide tor hazardous
substance incident re spons e wit h res pect to equ ipment and perso nnel to those spec ific ar eas as
id entified by the part ies ; and , -
WHEREAS, establishment of a ha za rd ous substance res ponse agreement will serve a
publi c purpose and promote the hea lth , sa fety , sec urity , and general we lfare of the inhabitan•s of
Arapahoe Cou nty and the State of Co lorado .
NOW, THEREFORE . in consi derat ion of the mu tu al covenan ts hereinafter contai ned , the
parties agree as follows :
I . PURPOSE

provides tor the appointment of one memb G, from Englewood Fire to the Arapahoe County
Hazardous Materials Board .
I I . DEFINITIONS
The following terms, as used in this agreement , shall have the meanings hereinatta
designated, unless the context specifically indicates otherwise or unless such meaning 1s excludw
by express provisions .

Any outside agency that ass ists at the scene of a hazardous mat erials incident that provides
supporting services not within the responsibility or capab ility of the Arapahoe County Hazardous
Materials Response Team . Su ch servi ces would include , but are not limited to road cl c,sures and
detours, technical advice , sampling and moni tor ipg ca pab ili ties, clean-up, ott-loading , disposal ,
and other supportive tasks as requested by the Inci de nt Co mmand er.
B) BOARD
The Hazardous Materials Board will be made up of Fire Chiels , Directors and the Sheritt of
Ar apahoe County , (or the ir designees) who execute th is agree,11 .;n t or si milar agreement. Tho se
me mber s who execute such an agreement are referred to ho,rein as me mbers .
C) CLEAN-UP
Incident scene acti vities directed toward the removal of haz ardous mater ials , and all
co ntaminated debris , including but no t limi ted to dirt , wat er, road surfaces , containers, vehicles ,
con tamin ated articles , and ex tingu is hing too ls and materials, an d returning the sce ne to as near
as normal as it existed prior to the incident. Clean-up is NOT the function of the Arapahoe County
Hazardo us Material s Response Team , but oversee ;ng and observi ng clean-up operations woulA
be the re spo nsi bility of the Incident Comm ander. Technical guida nce for clean-up ca n be giv en bW

Comma nder . If the circumstances are such tha t the Ha zar dous Materials Response Team
Commander fee ls that a hazardous mater:a ls incide ,,t is of such a magnitude or character that ii is
beyond the training and/o ; capa bility of the team , the y may del ay or abort any further actions
dea ling with the inci dent. The Hazardous Materials Response Team Commander will usually
function in the OPER ATIONS portion of the Inc ident Command System .

A system of command and Cl)ntrol designed to assure the smooth implementation of
immediate and continued operational proce dures unt il the incident has been contained or abated .
The Incident Command System used will be the National Fire Academy Incident Command Systera
which has been adopted by the fire protection distr icts as the Colorado Incide nt Command Systew
and will be followed by the Arapahoe County Sheriffs Department.

U) GEOGRAPHIC REGIONS
I The County shall be divided into region al response ar eas . These areas will be defined as
unsdlct ional boundarie s of the area served by the Fire District / Department. Each Fire Distr ict /
epartment shall agree to provide as many tea m members as may be ne cessary to properly handle
the hazardo us materials incident. In those regional res ponse areas where insufficient manpower
exists at the levels of tra i,1ing requ ire d by OS HA stan dards , the Inc ident Commander may request
assistance from th e closest regional r es ponse area where adequately trained personnel are
available to handle th e incident.

111. ESTABLISHMENT
A) GE~ERAL
Th e parties hereby establish an entity to be known as the Arapahoe County Hazardous
Materials Board , wh ich shall be re sponsibl e for the organ ized administration and operation of the
Arapahoe County Hazardous Materials Respon se program as descri bed below . While personnel
assigned to Fire DepartmenVDistricts will pro vi de the primary support for the hazardous materials
response program , nothing in this Ag reement will preclude police and sheriff's personnel from
.cipating as a m ;er of the Hazardous Materials Response Team .

The parties hereto agree the Board shall be empowered to develop , maintain , repair,
control , and regulate a hazardous substance response program . The principle purpose of the
program is to pro vi de, supplemental hazardous materials response equipment and trained
personne l to operate the equ ipment throughout Arapahoe County . The program shall be provided
in addition to , and not in place of , any already existir.,i equipment and manpower owned by the
County or owned by the cities , or s~ ~ci al districts within the County.
The Board sha ll select the members by the use of an Operations Committee whi ch shall be
co mprised of, but not limited to , mem bers of the Hazardous Materials Response Team ,
designee(s) f:om ea ch fi re department /distr ic t who are designated as the Hazardous Materials
SARA Title Ill Co mpliance Officer(s). The Operation s Committee shall advise the Board on all
operational matters , equi pm en t requirements , and other ma tters related to operations of the
Hazardous Materials Response Veh icle . In ad ditio n the Op er at ions Co mmittee will advise the
Trai ni ng Com mittee ol specific hazard tra ini ng that may be needed . The Chairpersons for these
Co mm ittee s will be ap po inted by the Board .
Th e parti es hereto agree that the Board shall administer the operati on al needs of the vehicle ,
but the operations of the vehi cle at each sce ne shall be un der the dire ction of the Incident
-mman,der.

The Ha zardo us Materia ls Emergency Response Team shall exist solely for the purpose of
training, education , coo rd ination , and rapid deployment of qualified personnel in the event of a
hazardous materials Incident. Such team shall not alter or affect the designation of any emergencA
response authority , and any members of such t.eam shall at all limes rema in as employees of thei'9'
res pec tive emplo ye rs .
To the extent rn asonably poss ible, the entity requesting assistance shall have two ('.) or
more personnel present at the location of any ha za rdous materials incident before reque sting the
Hazardl"us Materia ls Re spo nse Vehicle and ad ditio nal autho ri ty team members .
I V . LIABILITY AND INSURANCE
The Board and its officers , d irectors and members shall be indemn ified pursuant to the
provisions of the Governmental Immunity Act (Part 10 of Articl e 24 C.R .S .). The Board may
purchase insurance to pro vi de coverage for the Board and its officers , directors and members
against any suit or action which may be brought against said Board or its officers , directors or
members involving or pertaining to any of their acts or duties performed or omitted in good faith for
the Board .
The parties to th is agreement acknowledge that the provisions of Section 29-5-108 C.R .S.
concerning liability of a requesting jurisdiction and Section 29-5 -109 C .R.S . concerning worker's
compensation coverage shall apply to those situations when personnel assistance is requested iA
response to a hazardous material i ncident. The members shall provide appropriate liabilit9
insurance protection and work er's compensation cove rage as determined by the legislative
authority of the jurisdiction .
V HAZARDOUS MATERIALS BOARD
The go verni ng body for the Boa rd shall consi sc of the Chief Officer or des ignee of each
municipality, Fire Department and Fire Protection District which part ici pates in the Board and one
member from the Arapahoe County She ri ff's Departm1mt who sh a!I function as the Chairperson of
the Board .
VI RESPONSE AND BILLING PROCEDURE
The parties to the Agree ment concur that the member fire de oart ments/d istricts wi ll provid1.
th e primary personnel support for the Ha zardou s Materials Resp<',1se Program, an d in no event
~hall a member be deemed an employee of the Board .
Nevertheless, time and material co sts related to a specific incident may be reimbursed to the
Board o r the spec ific agency(s) incurring the expen se. Su ch costs incl ud e, but are not limited to-
salary , fuel , laboratory testing , packa ging , shipping , and equ ipment replacement.

The Board will establish a co ntingency fund which will be 10% of the preceding year's actua l
-nditures , or $5 ,000 .00 , wh ic hever is greater. The monies for said fund will be genera ted from
w eimbursement rece ived from responding to hazardous materials incide nt s wi th in the response
areas . Said co ntingency fund s shall be utilized to defray the costs of unanticipated operating
expenses .
V 111 . FINANCIAL MATTERS
A) EUNDS...MANAGEMEN T
The Board agree s that the vari ous mon ies paid by the members of the Board , and any
moni es generated by the Board itse lf , shall be placed into a desig nated fund and any expenses
incurred by reason of operation shall be paid from such fund .
All monie s belonging to the Board or designated for use by the Board shall be deposited in
the name and to the credit of th e Bo ard with such depositories as the Board shall from time to time
designate .
The Board agrees that no disbursements shall be made from funds of the Board except by
check, nor until a verified claim fo r services or commodities actually rendered or delivered has
bee n first submitted and approved for payment by the Boa rd in writing .
