WHEREAS , the City of Engl ewood acqu ired title to th e Easement prope rty by Deed reco rd ed
in Book 1838 at Page 410, reco rdtd wi th the Arapahoo County Cle rk a nd Jl pco,ders; and
WHEREAS , in the recorded Deed it. \11,, un ed that if the Ci ty fai led tom~~• use of the
Ea sement Property for public street , uu1:t;u and related purposes on or befo re \.M oi,v r 1, 1979,
then in such ev ent , title t.o the Eaiurnent. Property would revert lo Cl"'lv lo w Ltd 's prcdcce Hon
in t itle; and

A temporary, private and exclusive easement upon, ove r and across th e
Temp orary Ease ment Prop erty for use by Grantee, and its successors, assigns ,
ag ent.a , employe es, tenants, guest! and invites, fo r a mo to r vehic le park ing
area, driveway and relo t.ed pur poses, together with right to fen ce same, subject
to the tenns, co ndi tions and provisions h ereinafter set forth (lhe 'Temporary
Easement"). The Tempo r ary Ea sement shall remain in full fo r ce and effect
until such ti me as Gren to 1 dea irea t.o utiliz e said Temporary Ea seme nt ar ea for
road purposes, in which event, the Temporary Easement may be ter minated by
Grant.o r upon Ninety (90) days' prior written notice to Grantee. Upon
tennination of the Temporary Ease ment, Grnntee sh all relocate fence to lhe
East boundary or the Temporary Easement described.

and te r minate, end Grontor shall hold the Easement Property, a s the some may

matcrial s ar.d structures of Grnntee so abandoned, provided that Gran tee shall
hav e a reas onab le peri od of tim e after said aba nd onment in whic h to remove
any or all impr o\'ements and Appurte nan ces from th e Easem ent Property .
