The City will be responsible for acqutrtng any additional rights of way required for the completion of the project. Incl uding any necessary construcuon easemtnts. C. In the event the projec t Involves modification of a ratlroad company's facil ities at a railroad grade crossing whereby the work ls t o be accomplished by railroad company fo rces. the City sh all make application to the Public Utilities Commission requ1r1ng tis order provtdtng for the 111stallat1on of the proposed Improvements. H. Th e State. or the Ctty with approval from the St ate . will be responsible for th e supervlslon of th e construction of the proj ect. The project will be subject to pertodlc Inspection by the FHWA. I. In the event that all or part of the work Is to be accomplished by force accou nt rathe r th an contract. the Ci ty will ens ure that al l work Is accomplished tn accordance with the pertinent State specUlcatlons as well as FHPM, Volul"le 6. GENERAL PROVISIONS A. The Local Agency will provide: l. PrelJJninary engineering, design services, preparation of construction plans, special .provisions and estimates in accordance with the State' l! ·.'itbadway and Bridge Design Manuals and Standard Specifications for Road and Bridge Construct~on . 2 . Des i gn work sheets used in de~_igning of the project. B. The Loc al Agency will c omply wi th the following: l. The Local Agenc y will pre pare construction plans in ac co rdanc,_ wi t h the req u irements o f Eng i neer i ng Se rvic es Sec tion 107, Preparati on of Co nstru c tio n Plans by Loc a l Age ncy, a tta che d he reto a nd made a pa rt hereo f. -4- 2 . The Loca l Agency wi ll be responsible fo i • the plans be i ng accurate and comp l ete . C. Th e Loc a l Agenc y wi l l comply with the applicable provi s ions of the State 's approved Action Plan, including a l l Fed e ra l direct i ves contai ned therein by reference. o . The Lo c al Agency may enter into a contract with a consulta nt t o do all or any portion of the proposed preliminary engi neer i ng and preparation of construction plans. In the e v ent that Federal-a i d funds provided hecein are to partic i pate in the cost of work to be done by a cons ulta nt, ~ t h e contract shal l comply with . the requirement ~ of FHP M, Vo l ume 1, Chapter 7 , Section 2, Administration of Negot i ated Co ntracts . The c o ntract with consultant aha E be preceded by an acceptable propusal and may not be executed or awarded -. until the selection of the consultant and the terms of th~ contract shall have been approved by the State and the Feder a l Hi ghwa y Adm i nistration (FHWA). The St a te wi ll affo rd th e Local Ag e ncy a mple opportunity t o r e vi ew the c o nstruc tion plans , s pecial provis ions a nd est imates, as -5- e changed and said plans shall be considered final when approved and accepted by the parties hereto. Th• State will provide final assembly of con1truction plans, ■pecial provisions, ~s t ilnates and contract doc uments. In the event a ll o part of the construction work is to be contracted , the State will establ i~h appropr i ate Disadvantaged ausiness Enterprise (DBE) goals for the construction contr~ct(s) a nd the State i n con j unction with the Local Agency will advertise the call for bide, and upon concurrence by the Local Agency, award the construction contract(s) to the h lowest responsible bidder (•)· · F. The Local Agency will be · responsible for acquiring any add itional rights of way required for the completion of the project, includin~ any necessary construction easements . Prior to this project being advertised for bide, the Loca l Agency wi ll certify in writing to th• State that all right of wa y has been acquired in accordanc.• with the applicable ... ·.;·_. State a 1,d Federal regulations, or t.tia:t no additional right of way is r equired. G. The State will be responsible for assuring that the Local Age ·.,cy has obta i ned proper clearance or approval from a ny ut i.l ity company which ;nay become involved in this project, by separa t e agreement t etween the Local Agency and the utility, if neces·sary. P·r !or t o this pn•ject being a dv e rti sed for ,b.ids , the Lo, ·el Agency will certify in wr it i ng t o t he State that a l l such clearances have bee n o bt a i ned . -6- H. In the event the project involves modification of a railroad company's facilities at a railroad grade cro ■■ing wher~by -· the work is to be accomplished by railroad company forces, the Local Agency ■hall make application to the Public Ut ilities Coffll!li ■s i on reque ■ting its order providing for the installation of the proposed improvements. The Local Age ncy shall allo este.blish contact vith the railroad company involved for the purpose of: 1 . Executing an ,1greement setting out what work is to be accomplished and the location( s ). thereof, and tha t the costs of the improvement '"shall be ~ligible for Fede ral participation. 2. Obtaining the railroad'■ detailed estimate of the cost 3. of the work. Establishing future maintenance responsibilities for the proposed installation. 4. Prescribing future use or dispositions of the proposed !.m provements in the event o _~ ~andonment or elimination of the grade crossing . S . Establishing future repair and/or replacement responsibilities in the event. of accident,;.'. destruction or damage to the installation. r : The State or-the Local Agency wit h approval from the State will be respo;s·ibl e for the supervision of the construct io n of the project. The supervised wo rk will consist o f but no t be limited to fie ld and office engineering , inspection a nd material testing, and traffic control . The project will be -7- subject to periodic inspection by the FHWA, In the event the Local Agency has engaged a consultant for the design of a major structure, the Local Agency/consultant contract shall contain the following: 1 . Upon advertisement for the project for construction, the consultant shall make available services as requested by the State to assi•t the State in the evaluation of construction and the resolution of c:onstruction problems that may arise during the construction of the project. 'i: 2. The consultant shall rev iew the ·construction contractor's shop drawing for confor111ance with the contact documents and complia~ce with the provisions of the State Department of Highways publication, "Standard Specifications for Road and Bridge Construction", i n connection with this work. J. Traffic control shall be as prcrddad in the construction plans. Such plans shall be approved by the Local Agency . K. In the event that all or part of the work is to be accomplished by force account rathe~ than contract as specified in paragraph E hereinabove, the Local Agency will ensure that all work is ac c omplished in accordance with the pertinent State ~pacifications as well as FHPM, Volume 6 , Cha p te r 4, Section l,' Subs e c tion 14 , Co n t ra c t and Force Ac cou nt . Wor k will no rma lly be based up on es t ima t ed q u an tit ies and f i rm un it pr ices agreed to between the Loc a l Age nc y , the St ate a nd t he FHWA i n advance of the wo rk, as -8 - -· Subsection 6, paragraph 12 .b . Such agreed un i t prices sha ll prov i ded for in FHPM , Volume 6, Chapter 4 , Section 1, c o n s t i tute a commitment a o to the value of t he work bas e d on a ct ual cos t s o f labor, equipme n t rental, materials suppl i e s and supervision necessary to complete the uork , Where a c t u~l cos t s are used, eligibility of costs items shall be e v aluated for compliance with Federal Procur~ment Regulation~ Part 1-15. Rental rate• for publi~ly owned equipment wi l l be the second ahift rental rate per hour as esta b l i shed in t he State 's Construction _!quipment Ren t a l R::te Schedule dated Ma y 1 , 198'6 or subsequent revisions thereof . All force account work shall have prior approv a l o f the FHWA and shall not be ini tiated until the State has i ssued a written notice to proceed . The Local Agency sha ll , dur i ng all phases of the work, permit duly authorized age nts anrl employees of the State and the FHWA to inspect the proj ect and to ins pect, rev iew and audit the project recor d s. ..... :·· L . The Local Agency shall ma i ntain all books, docu:11ents, papers, acco unti ng r e cords ~nd other e v idence partaining t o c o s t s i ncurred and to make s uch ma~erials available fo r inspectio n a t a l l reas onable ti.me s d u ring the contrac t period an d f or 3 years from t he d ate o f fina l payme nt t o t he Local Age ncy . T::e State wil l administer the Local Agency and Federal -aid fun ds for this project in accordance with the follow i ng provisions : l . Cos ts inc urred by the Local Agency 2. The Local Agency wil l prepare and 1ubmit monthly charges for costs incurred relative to the project . The Local Agency will prepare project charge ■ in accordance wi :h t he State 's standard policies and procedures . The State will reimburse the Local Agency for the Federal-aid share of the p r oject charge ■ follow i ng the ., State's review and approv.,l of ,·uch char9H , Charges incurred by the Local Agency prior to the data of FHWA authori zation for the project _will not be charged to the project . Costs incurred by the State a . The State will prepare monthly •■ti.mates of all incurred costs relative to .the project. The State's monthly billings for the t:;J~l A9ency ■hare will be based on actual. cos ta . As funds are expanded during the course of th~ work, the State will bill the Local Agency monthly for tba Local Agency ■hare of suc h expenditures . Upon completion of the work to be performed under th i s contract and ac c eptanc e there for by t he State , FHWA and the Local Agency; t he si~~e will s ub mit a final recapitulJ tion of the pro j ect cos ts to the Local Agency and H r.Js l billing for the ba lance due of i ts share of pa rtic ipations -10 - costs plus all non-participating costs . Upon receipt of each bill from the State, the Local Agency will remit to the State that amount billed. Should the Local Agency fail to pay monies due the State within JO days of demand or within s uc h other period as may be agreed between the partie ■ he reto , the Local Agency agrees that at the request of t he State, the State Treasurer may withhold an equal amount from future apportionments due the Local Agency from th~ Highway Users Tax Fund and to pay such funds directly "i:o the State. Interim funds, until ·the State is reimbursed, shall be payable from State Highway Supple~entary Fund (2001 ). All funds expended by the State for the performance of~ any work under this contract or relative to the administration of t~is contract shall be charged t o this project . b . Upon execution of this cdrit~act the State is authorized, in its discretion, _to perform any necessary administrative support se.t"Vices pursuant to this contract . These nrvices may be performed prior to and in preparation for any conditions or re~u i rements of t hi s c ontract , including prior FHWA a p pro;a i o f proj e ct work. Con trac t or und erstands a nd agrees that t he Stat e ma y perform such servic es , a nd tha t paym ent f or such servi ces s hall be at no c o st t o t he Stat e , but ~hal l be a s -ll - t1I provided herein. At the request of contractor, the State shall also provide other assistance pursuant to this contract as may be agreed in writing . In the avant that federal aid project funds remain available for payment, contractor understands and agrees the costs of any such •ervices and assistance shall be paid to ~he State from project funds at the applicable rate. However, in the event that such funding is not made available or is withdrawn for this contract, or if the contractor ,. terminates this contract pr.ior to project approval or completion for any reason, than all actual incurred costs of such ••rvica• and a•sistance provided by the State •hall be the •ole expense of the contractor . Contractor •hall pay the State for all such costs withi~ 30 days of receipt of written notice from the State raqua•ting same. N. It is understood and agreed by the '·pi;ties hereto that the total cost of the work •tated harainbefora i• the best estimate avai l able based on the design data as approved at the time of executio n of this contract, and that such cost is sub j ec t to revision , B~reaable to the parties prior t o bid and award. The Loe~• Agency has the option to accept or reject the proposal of the l ow bidder for 'w?rk on whic h c ompet i t i ve bids have been receiv ed . The Lo c al Agency must declare the accepta nce or rejection at the aw ard confer e nc e or wit h in 3 wo r king days after sa i d biis are public ly -12- opened, whichever occurs later. H . 285 STAFF SOURCE Charles Esterly, Director of Public Works ISSUE/ AC11ON PROPOSED We re'-luest that City Council adopt two bills for ordinances appr,-,tng contracts with the Colorado Department of Transportation for Projects HOS 0006(64) and HOS A>oo6(65), which Include traffic signal Improvements on State Highway 285 at Huron, 9,a1apago, Elati, Cherokee, Logan, Cl.lrkson, and Downing Streets. PREVIOUS COUNCIL AC11ON Passage of Ordinance 90 -6 3 on November 19, 1990, approvtng $57,000 as match!.ng funds for the Federal s afety grant as part of the 1991 Public Improvement Fund. STAFF ANALYSIS These contracts provide funding to upgrade th~ traffic s tgnals from ove1 head span wir e to mast arms, brtng traffic signal Indications to State specifications , remove overhead wtrtng, and Install handicap ramps at sevt:n Intersections on State Highway 285 (Hampden and J efferson Avenues). The Colorado Department of Transportation and the City of Englewood will coordinate the projects . The Federal Agency will provide 90% and the City of Englewood will provide 10% of the partlclpattng funds . The City will provide all non -participating funds (estlmated at 2%). BACKGROUND The City of Englewood Engtneenng Division performed a detailed traffic accident study of the S .H. 285 corrtdor . Based on the study results , Federal Safety Grant e unds wer e granted In 1990 to Implement the necessary Improvements . FINANCIAL The total coat Is $459,512; $9,512 oftncl1rect costs are not eligible for Federal participation, and $450,000 Is . The Federal share IS 90% of $450,000, or $405,000. The City share l, 10% of $450,000, or 845,000, plus tncl1rect costs of 89,512 and our estimated conttngency of $2,488. Total cost to the City Is : 10% of S450,000 Jncl1rect costs Estimated contingency TOTAL $45,000 9,512 2 ,488 $157,000 Funding was previously approved In 1990, and $57,000 Is available and budgeted for this project In the Pubic Improvement Fund.
