AN ORDINANCE AMENDING TITLE 11, CHAPTER I, SECTION l, SUBSECTJON B, OF
THE ENGLEWOOD MUNICIPAL CODE BY ADDING A NF.W SUBSECTION
RELATING TO THE PARKING OF VEHI CLES WITH EXPIRED LICENSE PLATES .
WHEREAS , citizens of this city aro fr ustrated and endangered by abandon ed vehicl es
wh ic h are parked but not legally able to ue moved until after receiving the first citation :
and
WHEREAS , the owner of vehicles parked with expired license plates ca n not now be
charged with any offense : and
WHEREAS, the health , safety and welfare of the City would be protec ted ifit had an
ordinan ce making it illegal to park a mo to r vehicle o• Englewood streets with expired
plates:
NOW , THEREFORE, BE IT ORDAJNED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO, AS FOLLOWS:

amended by adding a new Subsection 11, which •mends Article X, Section 10 of the Mod el
Traffic Code by adding Section 10-10 as follow s:
11-1-1 B. 11 : PARKING VEHICLES WITH EXPIRED REGISTRATION : IN
ADDITION TO THE EXISTING PROVISIONS OF SECTION LO , OF ARTICLE X
OF THE MODEL TRAFFIC CODE THE FOLLOWING PROVISION IS HEREBY
ADOPTED :
Section. 10-10: IT IS UNLAWFUL FOR ANY PERSON TO PARK OR STAND
ANY MOTOR VEHICLE OR TRAJLER UPON ANY STREET OR UPON ANY
PRIVATE PROPERTY AVAJLABLE FOR PUBLIC USE IN THIS CITY THAT
DOES NOT HA VE CURRENT VALID VEHICLE LICENSE PLATES AND
VEHICLE REGISTRATION IN CONFORMITY WITH THE LAWS OF THE
STATE OF PLATE ISSUANCE .

STAFF ANALYSIS
Tills amendment to the Municipal Code wtll result In Improved and more effi cient
enforcement of abandoned vehicles by Police Officers and Code Enforcement Offic ers .
BACKGROUND
Th e purpose of this Ordlnance Is to put an end t o the ongoing "cat and mouse" game
Involving the removal of abandoned vehicles which are unlicensed or with expired
IJC L!,se pla tes . Abandoned vehicles are removed by the City If, after being tagged ,
they are not move d for a period of seventy two hours. While vehlcles whlch are
unlicensed or have expired plates may not be operated on public rights-of-way , a
citation can only be Issued for th1s violation If It ts witnessed by a Police Offi cer. With
abandoned ve hicles thls rarely h a ppens. In addition, the citation Is Issued to the
op erator of the vehlcle. whlch may not be the owner.
Abandoned v~hlcle citations, on the other hand, are Issued to the owner of the A
vehJcle. ThJs ts where the compllcatlon artses. Without the proposed amendment , W
owners of unllcensed vehlcles simply move the vehlcle within the seventy-two hour
per1od because the chances ofbetng observed by Pollce ts very small and as a result
the process must start all over agatn . ThJs amendment wtl1 enable Pollce Officers as
well as Code Enforcement Officers to have these vehicles more quickly removed from
the streets of the City.
FINANCIAL
There are no financial Impacts on the City as a result of the enactment of this
Ordinance .
