AN ORDINANCE AMENDING TITLE 7, CHAPTER 6F, SECT IONS 3 A, 4, 5, AND 9 C, OF
THE ENG LEWOOD MU NICIPAL CODE 1985, WHICH INC REASES THE AMOUNT OF
MONETARY JURISDICTIO N.
WHEREAS , th e Co lorado legi slatu re increase d the mi sdemeanor monetary
j ur isdiction fr om less than three hundred dollars lo less than four hundred dollars on
certain offtnses invo]vi ng prop!rt.y : and
WHEREAS , those offens es in the amount of fou r hundred doll a r s or mor e ar e fel oni es
and bey ond t he Municipal Court's jurisdiction; and
WHERE AS, it enh ances th e health , welfar e, and safety of the citizens of Englewood lo
ra ise the monetary jurisdictional limits on th e offenses of shoplifting, petty theft., pri ce
switch ing, and fra ud by check ordinan~es;
NOW , THE REFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO, AS FOL JWS:

follows :
7-6F-3 : SHOPLIFTING:
A. Offense Stated . It shall be unlawful for an y person lo ·.vi llfully obtain unpurchaaed
goods, wares or merc handi se ow ned or held by and offered or displaye d for sale by any
store or other mercanti le est.a bUs hm ent with an intent to avoid paymen t., which good s,

The City Attorney's Office seeks Council approval for a Bill for an Ordlnance
Increasing the l1rnlt on property value misdemeanors . ThJs proposed ordlnance will
bring Englewood's current legis lation on thJs Issue Into agreement wtth recently
passed State legJsl ation .

None.
BACKGROUND
h, t11 e last State Legislative session . the l1rnlt on property val u e misdemeanors was
r aise d fro m S300 to $400. In ot11er words . the theft of an Item valued at more than
S400 would be considered a felony : an Item less t11an S400 would be considered a
misdemeanor. Since Englewood 's MunJclpal Court can hear misdemeanors , but not
felonJ es . any Engl ewood office r Involved In a t11eft of tills nature wo uld have t o trave l
to Arapal1oe Co unty Court to testify.
STAFF ANALYSIS
Our r ec or ds s how t h a t for the fir s t sLx m onths of 1992 . 269 thefts of thJs n ature
occurred (an average of 38 per montl1 ): during tll e first six months of 1991 , 4 I 8
thefts oc curred (an average of 60 per montl1 ). In Co unty Court cases wher e an
office r 's testimony Is n ec essary. a substantial amount of Ills /h er time Is spe nt
walling to t estify .
Currently In MunJclpal Cow· . wr. place the officers "on call " to testify. Thls means
that an offJccr can co ntinue wtth r egular patrol and only nee ds to appear ln court A
when hJs/her t estimony ls necessary. W
Without this proposed ordinance change, offJ cer s would need tc, travel to Arapal10 e
Co unty Court to testify In theft cases over S300. Our offi ce rs would s pend a
substantial amount of time traveUng and waJting to testify. ThJ s ts tln1e our offi ce rs
could be on patrol tn Englewoo d tf tl1e cases were heard In Mun.t ctpal Court.
nNANCIAL
We anticipate a modest beneficial financial Impact as a r es ult of tills orc!Jn ance . It
would mean better use of our officers· ttme , t11ereby decreasing t11 e cost for officers to enforce Englewood 's laws .
