AN ORDINANCE AMENDING TITLE 5 , CHAP't'ER 3C, SECTION 3, OF THE
ENGLEWOOD MUNICIPAL CODE 1985, RELATI NG TO I NTOX ICATIN G BEVERAGES .
WHEREAS, due lo n request fo r a permit S)'St em to a ll ow the con sumpti on of al coholic
beve rages in certain City fnci 1iti es and after th e i nvesliga lion or an ad hoc committee who
in vestigated the possibility of the City issuing permits in City rccrenlion facilitie s , the
Englewood City Council a mended Titl e 5-3C -3,C , with th e pa ss age of Ord inan ce 29, Series of
1990: and
WHEREAS, prior lo th e passage of Ordinance 29, Seri es of 1990, th e Englewood Municipal
Code 1985, s lated that it was unlawful fo r an y person to have in hi s po ssess ion or under hi s
co ntrol in any public place nny intoxicating liqu or in any containe r of any kind or descriptio n
which is not s caled or on which th e seal is broken; and
WHEREAS , the City Cou nci l wishes lo reinstate the prior
NO W, THEREFORE , BE l'l' ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD , COLORADO , AS FOLLOWS :

At one time Englewood had an ordinance prohibiting consumption of alcohol
in public places which was repealed approximately one year ago and since that
time we have had numerous occasions to ci te for open containers.
One major problem area is the Gothic Theatre • during t• .e summer months we
found numerous violations of open container and we wert · powerless to enforce the
violations. Another p roblem area is the neighborhood adjacent to Belleview Park
• the participating teams know they c:m not drink in the park so they drink in
the street next to the park.
Englewood Police Officers are now using the State Statute pertaining to
"consumption" in public (12-47-128, I, h), but this Statute deals with
cons umption and we may run into a problem proving consumption without some
fo nn of che mical tes t or on-sight observati on. It should al so be noted that thi s
Sta tute does not apply to 3.2% beer.
It is r ecomm ended tha t the Ci ty Council pass an ord ina nc e prohibiting
consumption of alcohol in a public place ..
