WHEREAS, pursuant to Article Ill, Section 20, of the Englewood Home Rule Charter, the four Council Districts establi shed shall be contiguous and compact and have approJcima t ely the sa me number of registered voters and population ; and WHEREAS, every four years, Council sh all make such divisions, changes and con so lidations to carry out the intent of Article Ill of the Home Rule Charter; and WHEREAS , the Election Commission of the City of Englewood has found that a variance in population in exces s or their permissible limits exists in certain Council Districts as heretofore establi shed by City Council And that changes must be made in the District boundaries; NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD , COLORADO, AS FOLLOWS : Sl:!:l.iluLl. Crow, City Clerk/Election Commission Member The Election Commission seeks Council support for a bill for an ordinance establishing legal boundaries for Englewood 's Council District s. PREVIOUS COUNCD. ACTION Resolution No. 60 , Series of 1991 , was adopted by City Council on February 19, 1991. This resolution offi cially postponed Council reapportionment until 1990 census data were available and redistri cti ng by State and Cotinty was complete . City Council met with the El ection Commission on December 14, 1992, at which time the Election Commission present ed its recommendation wit h regard to reapportionment and esti'.blishment of Ci ty Council Distri cts . BACKGROUND The Englewood City Ho me Rule Charter and certain case law require that on a periodic basis the population and number of registered voters be reviewed in an effort to equalize each of the City of Eng lewood's fou r Council Districts . The guidelines stipulate that population should not vary in each district more than 5% from the total population di vid ed by th e number of districts , and that the nu mb er of registered voters should vary no more than 15% between the highest ar.d lowest Council District . The Election Commission is charged with reviewi ng and recommending reapportionment to City Council. The Election Commission reviewed all data prepared by the Departme nt of Rnancial Services based on the 1990 Census and th e records of Arapahoe County Election Office . Several options were reviewed with only one option meeting all necessary aiteria. At Council's study session on December 14, 1992, the Election Commission presented the options with 11 slrong recommendation for adoption of Option No . 1 , the only option that meets the aiteri11 previously outlined . That option in the form of Council Bill No . 2 Is now being presented for Council's consideration and approval . If approved, the second reading Is scheduled for February 1, 1993, and the ordinance will be in effect 30 days after publication . The Charter requires that reapportionment be in place six months prior to the November 2 , 1993 regular municipal election. STAFF ANALYSIS The Director of Financial Services and the City Clerk have worked closely with the Election Commission in identifying various options for redistricting . The option recommended by the Election Commission !Peets aiteria set forth in the Cit).I Charter and complies with population requirements est ablish ~-d by case law . The City Attorney concurs in this recommendation . FlNANCIAL IMPACT There is no financial impact foreseen as a result of this recommendation .
