HomeMy WebLinkAbout1993 Ordinance No. 015ORDINANCE NO ,)., SERIES OF 1993 BY AUTHORITY COUNCIL BILL NO. 11 INTRODUCED BY COUNCIL MEMBER BULWCK AN ORDINANCE APPROVING AN AMENDMENT TO THE AGREEMENT FOR DEVELOPMENT, MAINTENANCE AND CONVEYANCE OF REAL PROPERTY KNOWN AS CENTENNIAL PARK BETWEEN ARAPAHOE COUNTY AND TH E CITY OF ENGLEWOOD, COLORADO . WHEREAS, an Agreement for Dev elopme nt, Maintenance and Conveyance of R,al Property was entered into on February 19, 1980 by the Board of County Commiaaioners of Arapahoe County and the City of Englewood; and WHEREAS, the Agreement set forth that the County would convey the property described in the Agree ment to the City of Englewood for park and recreational purposes aft.er the County had completed e,traction of sand and gravel from the subject property; and WHEREAS, Arapahoe County has obtained a permit from the Mined Land Reclamation Board , fo r the sand and gravel extracti on operation of the subject property; however, the County has not received approval of a water augmentation plan, nor approval of a grave l pit well permit from the Office of the State Engineer; and WHEREAS , the County has completed ex traction of the sand and gravel and the City is .desir~ of comple ·nc the reclamatio n of th e subject property in order to comple e the improvements fo r the City's adjacent Centennial Park facility; and WHEREAS , the City is willing to accept the responsibility for ol>taining appro ls from th e Office of the State En gineer for the water augmentation plan, and for th, ;:rave l pit well permit a nd app roval from the Mined Land Reclamation Board for the County's reclamation activities; NOW , THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD , COLORADO , AS FOLLOWS : ~-The City Co un cil of the City ofEnglewood, Colorado give s •~proval to enter into the Amendme nt To Agreement For A Development, Maintenance ar.d C,,nveyan ce of Real Property known as Centennial Park "'i th the County Commissioners of Arapahoe County, Colorado . The Amendm ent to Agreement contains the following: I. The County anrl the Ci ty agree to amend the pro visions of Paragraph 8 of the Agr ee ment to read as follows : Th e County shall convey, by Quit Claim Deed, all its right , title and interest in and to the Subj ect Premise s to the City ~hout any reversionary interest rema ining wilh Arapahoe County. The County sh all convey, by Quit Claim Deed, its reversionary interest to the City for that property iden t ified in the Deed recorded in Book 1887 at Page 496 currently own ed by the City. -1 - 2 . BAO«lROC.ND ,A,t\er entering into the February 19, 1980 agreement, Arapahoe County diligently continued to m ine sand and gravel. Subsequently, the County Gravel Pit became subject to additional conditions related to their Mined Land Reclamation Permit. One of these conditions requires make-up water to replace water surface evaporation . In discussions with Arapahoe County, it became apparent that Englewood was in a better position to address water issues than was Arapahoe County. STAFF ANALYSIS The amended agreement transfers the rema',ning Arapahoe County Gravel Pit property to the City of Englewood for unrestricted use by the City. In exchange, the City agrees to take over the responsibilities associated with the Mined Land Reclamation Permit that includes reclaiming the property and submitting an augmentation plan to the State Engineer. fftllll'l(W. While no specific dollar figures have been developed, the City has been antlclpetlng developing tm land as a park since 1980. The flexibility to use all of the land and all of the lake surface for recreational and non-recreational uses offsets the cost of Implementing ar, augmentation plan to make up evaporation losses. The Utilities Department believes the value of this potential storage space m ore than offsets the value of water committed to make up evaporation losses.
