SERIES OF 1993 BY AUTHORITY COUNCIL EILL NO . 20 INTRODUCED BY COUNCIL MEMBER BULLOCK AN ORDINANCE ESTABUSHING USER FEES FOR TITLE 12, CHAPI'ER 5, OF THE ENGLEWOOD MUNICIPAL CODE 1985 KNOWN AS STORM WATER UTILITY. WHEREAS, The 1987 , amendments to foe Federal Clean Water Act required municipalities to obtain NPDES permits for the di scharge of storm water; and WHEJI~, in addition to obtaining NPDES permilA, citie ■ and counties are also required by the regulations to eliminate non-storm water discharce• into 1tonn water 1y1tem1, reduce municipal pollution discharces, and set priorities to control individual storm water pollution; and WHEREAS, Federal legi slation mandating storm water discharge permits, along with an opportunity to consolidate all the City storm water functions within a single area with its own funding source provided the opportunity for the creation of a Storm Water Enterprise Fund; and WHEREAS, with the creation of the Storm Water Enterprise Fund by the passage ofan ordinance creating Title 12-5-2 : Storm Water Utility, which also established User Fees for such Utility; and WHEREI\S, it is necessary to set the User Fees for the Storm Water Utility; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: ~-The Englewood City Council hereby gives approval for establishment of the following Storm Water Users fees : Single Family Residential: Flat Rate Charge of$6.80 per year to be billed quarterly with the Water and Sewer Billing. All other classes of customers will be billed $0.00226 per square foot of impervious area within their property boundarios with a minimum annual b,11;ng of $6.80 to be billed quarterly with the Water and ·sewer Billing. BACKGROUND The Stormwater Enterprise Fund was approved as C:ouncil Bill No . 13, which is scheduled for a public hearing and second reading on this ae,i:n da . The establishment of the Stormwater User Fees will provide the revenue necessary to carry out the functions of the Stormwater Enterprise Fund. The Stormwater User Fees are based on the impervious area of each property within the City. Because the vast majority of residential properties in the City have s1mili.: iota! and impervious areas, residential properties will be assessed a flat rate. Ali other classes of properties will be assessed fees based on the actual impe1vious area of the property. . STAFF ANALYSIS The initial year budget has been estimated at $120,850. This includes the costs of system maintenance and operation, NPDES permitting, and assessing the system infrastructure. Future budget amounts will be determined in part on the results of this infrastructure assessment, and Federal and State NPDES permit requirements. The charges made by the Stormwater Enterprise Fund will be reviewed by City Council each year as pa rt of the City 's budget preparation prob<.!ss. FINANCIAL IMPACT The Storm Water User Fees are pruposed as follows : Single Familr, Residential properties will be assessed a Flat Rate Charge of $6 .80 per year, to be billed quarterly with the Water and Sewer Billing.
