AN ORDINANCE ADOPTING ELECTION PROCEDURE FOR NOVEMBER 1993
ELECTION WITHIN THE CITY OF ENGLEWOOD.
WHEREAS, the City Charter for the City or Englewood authorizes the Englewood City
Council to adopt by ordinance election procedures in the City or Englewood that are not
incon sistent with the Charter and the State Constitution ; and
WHEREAS, the Englewood Election Commission has reviewed in gTeal detail the
Englewoo d Charter, the election laws or the State of Colorado and Taxpayers Bill or Righ ts
adopted by the voters or the State or Colorado in November 1992; and
WHEREAS, the Home Rllle Charter or the City or Englewood a\lthorizes City Coun cil
to adopt election la ws by refere nce ; and
WHEREAS, the City Council , on recomm en dation or the Englewood Election
Commi ssion , desi res to a dopt those provisions or the U niform El ection Code or 199 2 that are
no l inconsistent with the Engl ewood Hom e Rule Chaner; and
WHEREAS , by adoption or the Un ifo rm El ection Code or 1992, the City will be able to
pa rtic ipate in lhe coord inated electio n ""~th Arapahoe County as desi red by the voters and se t
fo rth in the Taxpay ers Bill or Righ ts· ,nd
WHEREAS, that particip ating in the coordinated election will result in the use of a mail
ballot and re duc e confusion by not having competing polling pl aces.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CIT Y
OF ENGLEWOOD , COLORADO, AS FOLLOWS :
City Council or the City of Engle wc,.d hereby adopts as election orocedure, for the 1993
munici pal election within the City or Englewood, the provisions or the Uniform Election Cod e
or 1992, al so known as C.R.S. 1·1·101 el seq, as amended , that are not incons istent with the
Engl ew ood Home Rule Charter.

l$UE/ ACTION PROPOSED
The Election Commission seeks Council approval of a bill for an ordinance adopting the
Uniform Election Code of 1992 .
• PREVIOUS COUNCL ACTION
•
City Council met with the Englewood Election Commission on June 14. 1993, and discussed
the recommendation of the Commission to adopt the Ur..tform Electi ci n Code of 1992 . The
adoption of this Code would be· needed in order tor the City of Englewood to be able to
participate in a coordinat.ed election to be crnducted by the Arapahoe County Clerk and
Recorder on NovemberJ, 1993 .
BACKGROUND
Because of recent State legislation, and as a result of the "TABOR" Amendment approved by
the voters in 1992, coordinated elections are to be conducted throughout the State by
County Clerks. Arapahoe County has advised the City of Englewood it will be utilizing a
Mail-in Ballot for the November~ 1993 election . The County has the capability of
coordinating this election and of including the City of Englewood .
Th.« r::iection Commission unanimously agrees that it is in the best interest of the electors of
Englewood to conduct future elections jointly with the other political entities within the
County. In order to participate in the 1993 coordinated election, it is essential for the City
of Englewood to adopt the provisions of the Uniform Election Code of 1992 that are not
inconsistent with the Englewood Home Rule Charter .

The Election Commission has met with the City Attorney, the Director of Financial Services, •
and the City Cle r k. Staff concurs with the Commission's recommendation, with the
understanding that the Englewood Home Rule Charter provisions supersede any conflicting
provisions of the Uniform l:lection Code.
FINANCIAL IMPACT
Financial data will be available at the time an intergovernmental agreement is proposed
between the City and Ar~pahoe County. The amount budgeted for the 1993 regular
municipal election is $8,500; the anticipated costs for the mail-in election are expected to be
at least $16,000 .
