WHEREAS, the parties have been notified by th e Denver Regional Council of Governments that matching funds will be made available from the lntermodal Surface Transportation and Effici ency Act for the development of a bicycl e trail along Big Dry Creek, a waterway which traverses land within the three parties' jurisdictions; and WHEREAS, the City of LiUl eton submitted an application for a bicycle trail connecting the South Pls.tte Trail with the Highline Canal Trail along Big Dry Creek and this alignment pa sses through Belleview Park and the ECIC (Cameron ) project in the City of Englewood ; and WHEREAS, the application was accepted and included in the Transportation Impro vement Plan : and WHEREAS , the Littleton , South Suburban Park s and Recreation District and Englewood have determined that it is in their mutual interests to pursue the preparation of a master plan for the deve lopment of this trail ; and WHEREAS, the parti es agree to retain the firm"' Urban Edges, Inc. to prepare the master plan for this trail ; NOW , THEREFORE, BE IT ORDAI NED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO , AS FOLLOWS: .5.edilm...l. The City Council of the Englewood, Colorado hereby approves the intergovernmental agreement between the City of Littleton, South Suburban Parks and Recreation Di s tric t and the City of Englewood such agreement shall provide fur the funding of the preparation of the Big Dry Creek Bicycle Trail Master Plan. ~-Terms of the Agreement ere generally as follows: A . Littleton shall act as the co ntracting agency for ser.ices with the firm of Urban Edges , Inc ., for their preparation of a master plan for the Big Dry Creek trail on th e basis of the proposal wh ich is attached to the Intergovernmental Agreement as Exhibit I. B. Littleton and Englewood agree to sha re equally in the monetary cost of preparing this ma ste r plan in th e amo unt ofS B,457.50 each . -1- C . Englewood shall remit an $8,457.50 check to Littleton, made payable to the order of Urban Edges, Inc., which cl ,eck shall be remitted to Urban Edp1, Inc., by • Littleton, upon the succe11ful completion of Urban Edges' Inc . contnct with Littleton or u otherwise provided by the terms of said contract. D. The amount of the contribution from each party shall not be exceeded unless an amendment to the Agreement is first executed by the parties. E . Upon receipt of the funda from Englewood, Little\on will, pursuant t.o its charter, ordinances, and any applicable federal or state laws ,ir regulations, contract with Urban Edges, Inc., to develop plans and graphics which shall be designed to serve their intended purposes. F . If the entire amount contributed by Englewood is not expended, then Litt leton shall refund the remaining amount to Englewood . G . South Suburban agrees to provide in-kind staff services to assist in the preparation or the master plan as described in the Agreement. H . Littleton agrees that in its contract with Urban Edges, Inc ., that Urban Edges , Inc., shall contractually hold the parties harmless from any and all liability resulting from any of its neg1igent acts, omission s, or willful misconduct in an y way related to its performance of the contract. I . Littleton agrees to con tr act for the provision of the described service, within one month of th e date of the Agree ment, and agrees that the contract shall provide for a ll work to be comp leted wi thin six month s of the date of the contract .&wm.a. This ordinance would also authorize the Mayor to sign the intergovernmental agreement. PRE'.'1005 COUNCL ACTION City Council previously authorized staff to support the City of Littleton in their Transportation Improvement Plan application to the Denver Regional Council of Governments for a bike trail along Big Dry Creek . City Council also agreed to provide match money when the project is funded . BACKGROUND With the implementation of the Intermodal Surface Transportation Efficiency Act, the Denver Regional Council of Governments accepted applications for allocation of Federal Funds under the Act . The City of Littleton submitted an application for a bicycle trail connecting the South Platte Trail with the Highline Canal Trail along Big Dry Creek. This alignment passes through Belleview Park and the ECIC (Cameron) project in Englewood . The application was accepted and included in the Transportation Improvement Plan . SIAFF ANALYSIS The staffs of Englewood, Littleton, and South Suburban have met to discuss the status of • this project: several times over the last few months . The staffs are in agreement that it is desirablr !lave a master plan prepared before funds are contractually committed to the cities . ·,.,e advantages of having a master plan prepared now include: Pr m1ed on Recycled Pa1M1 :; 1. 2. When nnds are made av,:tllal:,le, we can proceed with final design and construction quicJcly . This funding category was underfunded in 1993 creating a backlog of projects . Having I ct·mplete d master plan may enhance chances for future alloc.tions of funds . 3. If federal economic incentive programs include ISTEA, we may be in a better position to con p ete for newly availarle funds . A disadvantage to preparing a master plan now is that fund~ expendP.d will probably not be reimbursed or accepted as local match money for this project. Staffs of all thre. entities have reviewed a proposal prepared by Urb,,n Edges, Inc . and are in agreement they should be retained to prepare the master plan. The Cities of Englewood and Littleton will share the cost of the master plan and South Suburban will provide in-kind services . Littleton will contract with Urban Edges and be reimbursed through the proposed intergovernmental agreement. FINANOAL IMPACT • According to the agreement, Littleton and Englewood will F..hare equally the cost of preparing this master plan, in the amount of $8,457.50 each . If the entire amount contributed by Englewood is not expended, the remaining amount shall be refunded . Funds are available for this project in the currently approved 1993 Parks Division budget. •
