AN ORDINANCE AUTHORIZING A C00PERATIVE FISHERIES PROJECT FUNDING
CONTRACT FOR CENTENNIAL LAKE BETWEEN THE CITY OF ENGLEWOOD,
COLORADO AND COLORADO DEPARTMENT OF NATURAL RESOURCES, DMSION
OF WILDLIFE.
WHEREAS, the purpose ofthia pn,ject ia to provide aneler acce11 to recenUy acquired
· South Shore of Centennial Lake; and
WHEREAS, the construction of one wood fiahinr pier with connecting concrete path
and uphalt trails to provide barrier-free acce11 to ahoreline; and
WHEREAS, the State hu authorized in the Law and Funds have been budreted,
appropriated and made available and a sufficient uncommitted balance thereof remain•
available for encumbering and subsequent payment under E~"11mbrance Number C in
Fund No . 4 · .. A(ency PBA, Appro~riation Code 609, Procram FISH, Function 0600, Object

WHE',l'..AS, the Fish and Wildlife Service of the U .S . Dep,:rtment oflnterior hw
made federal rrant funds available to th , State pursuant to the Federal Sportflahing
Restoration Act, P.L. 98-369, for the improvement of fisheries and recreational fishing
• opportunitiea in Colorado; and
•
WHEREAS, the State desires to make such funds available to the City nf Englewood
on a match basis for the purpose of improvini: fisheries and otherwise increuing
recreationnl fishing opportunities in Colorado aa part of its "Fishing is Fun in Colorado
Program ;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO , AS FOLLOWS:
~ The Contract with the State of Colorado Department of Natural R,aources
Division of Wildlife ia hereby accepted and approved by the Englewood City Council. The
Mayor ia authorized to execute and the City Clerk to attest and seal the Contract for and un
behalf of the City of Englewood, Colorado .
~-The Contrp.ct generally contains as follows :
A . The City of Englewood shall implement the recreational fishing project described
in the ContracL Prosecution of the Pn,ject shall be under the general supervision
of the State and the State may, at its discretion, require that a representative of the
State be present at the project location while won< ia being conducted. The City
designate• Chris Koi:ba, of Public Works as its agent to contact concerning all
matters of this Pn,ject.
B. The Contract provides for funding by • matching or cost aharing arrangement.
Generally, the City ia responsible for a minimum contribution of twenty-five
percent of the total Project coal No more than seventy-five percent of the total

1. The City ■hall operate and maintain for public ncreational lubing uae any
property and w:ilitie ■ acquired or developed under the Contrarl at ita
expense (unle11 otherwi ■e provided for by the Contract) for the uMful lift or
the property a1.1d racilitl11 specified in the Contract. Said property and
facilitie1 ■hall be maintained in a reuonable State or repair and ■hall be
open for u ■e by the gennal public at all reuonable hour■ of the day and lime
ol'the year as required by ita intended uae. In the event the property or
facility is not operated and maintained for public recreation, the City will
reimbune the State 100% of the remaining amortized value of su,:h facility.
'.!'be "remaining amortized value" i1 defined for the purpose or the Contract
u ·~e total funda paid to the City punuant to the Contract, multiplied by the
pe1-centage which the remaining portion or the useful lift comprise• or the
total useful life 1pecified in the Contract.
2. The City shall not at any tirr.e convert any properl,' ir facilities acquired or
developed pursuant to the Contract to other than public recreational fishing
use without the prior written appNVal al' the State. In the event the property or
facility i ■ converted, the City will ~imburM the State the current fair
marltet value of the property or facility. In the event the property or facility

i1 destroyed while under authority of the City prior to the end ofit■ uaeful •
life, the City will reimbur■e the Stele 100% of the remainin1 amortized
value or such facility.
3 . The City shall operate and maintain, or cause to be operated and
maintained, any property and facilities acquired or develop, d punu!'Jlt to
the Contract in compliance with all applicable federal, Stat, and local laws
or regulations. Although the State moy cooperate with the C.icy in securing
any necessary licenses or permita required for the prosecution or the Project
or ita continued operation under the Contract, the City shell be responsible
for obtaining all such required lic,nses and permits from federal, State
and local govemmenta and special district&,
4 . The City shall upon request by the State or the U.S. Fish and Wildlife
Service make available for inspection all property and facilitiea acquired
or developed punuant to the Contract.
5 . The City shall promptly complete and submit any and all report, or request&
for information to the Coordinator at times specified by the Coordinator.
6. The City shall maintain a complete aet of books, documents, papers and
records for the Project herein under any generally accepted accounting
system which satisfies federal requirements, to include receipts or other
proof or payment for all acquisitions or materials and aervices . Said items
shall be retained by the City for a pe,iod or at leut 3 yeara from the end or the
Project period and shall be available at any reaaonable time for inspection
by duly authorized federal or State representatives.

a . An opinion on compliance with federal law, and regulation a.
b . A Schedule of Grant Activity.
c . An opinion on the Schedule of Grant Activity.
d . Deec:ription of the controls relevant lo thi1 foderal proeram that were
evaluated by the auditor. The information must be included in the
overall internal control opinion for the City.
e. Submiuion of the audit report and management letter comments aa
soon u they are available each fiscal year during the life of the
Contract, to the Controller, Department of Natural Resoun:es.
8 . The City ahall require that all facilitiea deaij:ned under tha Contract
comply with the "American Standard Specifications for Makin& Buildings
and Facilities Asaeuable to, and Uuble by, tho Phy1ically Hanc:icapped."
The City shall conduct inspections to ensure compliance will these
specifications regardle11 of whether the work i1 being performed by the City
or by subcontract.
D. Any modification of the Project or any e,tension of the Project period shall
require the prio· written approval of the State in the form of a written amendment
e,ecuted by the parties. Any request for e,tension of the Project period and
juatificatior therefore shall be submitted in writing to the Coordinator at laaat 15
days prior lo the expiratio11 o~the Project period.
E. The parties to the Contr11ct intend that the relationship between them contemplated
hereunder is that of employer-independent Contractor. No agent, employee, or
servant of the City shall be or shall be deemed to be an employee, agent, or servant
of the State. The City will be solely and entirely reaponaible for its acts and acts of
its agents, employees, servants, and subcontractors during the performance of the
Contract.
F . All the terms, conditions and covenants of the Contract ah all be binding upon and
inure to the benefit of the parties hereto, their successors and assigns.
G . Th• Contract may not be assi1,ied without the written consent of the State.
H . The State's obligations under the Contract are contingent upon t he continuing
availability of federal fun~· for the purposes intended.
I. The City affirms that the signatory of the Contract is l,gally authorized to bind the
City and that he/she will e,ecute the Contract. with :.1 , 1:,e by -laws of the
organization, or if a political subdivision then b)' ·.he! t:"oveming charter.

Staff seeks Council support for a bill for an ordinance authorizing a Cooperative Fisheries
Project Funding Contract with the Colorado Department of Natunl R~our=, Division of
Wildlife . The proposed contract would provi de the funding necessary to allow angler
access to the recentl y acquired South Shore of Centennial Lake.
PREVIOUS COUNCIL ACTION
Council approved fund s in the 1994 budget that are the basis for Englewood match dollars.
BACKGROUND
The Parks and Recreation Commission recommended thi s project to City Council in 1993.
The project was discussed during the 1994 budget cycle and matching funds were allocated .
On September 8, 1993 , staff presented the City's proposal to "Fishing is Fun," administered
by the Divi si on of Wildlife.
PROS AND CONS OF OPTIONS F.EVlEWED
A deci s.;on not to accep t this contract results in the loss of $43 ,075 .00 in grant monies .
Acceptance of th e grant requ: res a match of $21,300.00 .
