SERIES OF 1994 BY AUTHORITY COUNCILBILLNO. 17 INTRODUCED BY COUNCIL MEMBER HATHAWAY AN ORDINANCE AUTHORIZING A LEASE OF A PORTION OF THE CITY OF ENGLEWOOD 0S PUBLIC PARKJNG LOT ON THE NORTHEAST CORNER OF SOUTH BROADWAY AND EAST FLOYD AVENUE TO B & B CONOCO TO BE USED AS CUSTOMER PARKJNG. WHEREAS, the public parkinglo~wa s created in 1986 with th e realignme nt of Floyd Avenue; and WHEREAS, the public parking lot was constructed on Floyd Avenue right-of-way becAuse it was no longer needed for street purposes and the geometry of the lot did not allow for efficient use of the property; and WHEREAS, over the past years the primary users of the lot have been the U.S. Post Office and B & B Conoco ; and WHEREAS, upon concerns raised by the Engl ewood's Community Development Department as to the use of the public parking lot on the northeast comer of South Broadway and East Floyd Avenue, the Englewood City Council asked that parking be restricted to 2 hour parking; and WHEREAS , subsequent to Englewood City Council's ~ommendation to restrict parking to 2 hours in the public parking lot, B & B Con oco·• owner, Melvin Bedore requested to either lease or buy a portion of the public parking lot to provide add itional parking for his business; and WHEREAS, the Englewood Public Works Department determin ed that the publ ic parking lot could be re-configured to make optimum use of the property; and WHEREAS, a lease has been prepared with B & B Conoco and all costs of the impro vements to the parking lot will be borne by B & B Conoco along with the maintenance of the improvements; and WHEREAS, constru,~on costs of parking lot improvements is estimawd a '. $35,733 .42 and the Englewood Public Works Department estimate th 9t the parking lot improvements will be com 1 • •d by June 1, 1994; and WHEREAS, th e City's obli&'Btion will be lighting of the entire parking lot wh ich is estimated to be $40 .00 per month; \ NOW, THEREFORE, BE IT ORDAINED BY THE CITY couryc1L OF THE CITY OF E!'!GLBWOOD, COLORADO, AS FOLLOWS : .S.eililm..J .. Ellis -2- COUNOL COMMUNICATION Date April 4, 1994 INITIA TIO BY Agenda Item 11 d Department of Public Works Subject Lease a Portion of East Floyd Avenue Right-of-Way STAFF SOURCE Charles Esterly, Director of Public Works COUNCIL GOAL I A IS&IE/ ACTION PROPOSED Staff seeks Council approval of an Ordinance allowing for the lease of a portion of East Floyd Avenue right-of-way to Melvin L. and Shelly L. Bedore, owners of B & B Conoco, for expanded customer parking at their business. PREVIOUS COUNOL ACTION Responding to concerns about the use of the public parking lot on thl' northe::.s t comer of South Broadway and East Floyd Avenue, City Council asked that parking be resbicted to 2 hours. BACKGROUND Thfo parkinp; lot was created in 1986 with the realignment of Floyd Avenue. The lot was miLStructed upon Floyd Avenue right-of-way no longer required for street purposes. The geometry of the lot did not allow for efficient use of the property. Over the past years, the primary users of the lot were B & B Conoco and the Post Office south of Floyd Avenue. When concerns were e x pressed about the use of this public lot, it was suggested that a 2 hour parking restriction within the lot might solve perceived problems and abuses. Subsequent to Council 's recommendation to restrict parking in this lot, Melvin Bedore approached the Ci ty and requested to either lease or buy a portion of this lot to proVJde -additional parking for his business. Staff detiermined that the parking lot could be re-configured to make optimum use of the , property . While the new lot design consists of one less public parking space, it does create A up to an additional 17 parking spaces for Mr . Bedore. Also, with Mr . Bedore no longer W using the public spaces for his business parking, the net gain of public parking spaces is 14 spaces. STAFF ANALYSIS Leasing this property to Melvin L. and Shelly L. Bedore appears to be a positive solution for all partie; involved. B & B Conoco gets the additional adjacent parking that it needs. With B & B no longer usi ng the public lot, additional spaces are made available for use by other area businesses. H o pefully, it will not be necessary to place p arking r<?Strictions in this lot. Sta.ff will continue to monitor lot usage, and recommended restrictions in the future, if deemed necessary . FINANCIAL !Ml',\CT The cost of parking lot improvements is estimated at $35,733 .42 . Th e lease requires that all improvement costs be borne by the Bedores . We believe that the lot improvements can be completed by June 1, 1994. The lease rate is based upon $1.00 per square foot per year. The lease will generate $2 ,035.16 in 1994, and $3,388.60 per year in 1995, 1996, 1997, 1998, and 1999. It is renewable January 1, 2000, with the City's approval, for a three year period. TI1e lease requires that the tenant maintain the improvements. The City's only obligation is A for parking lot lighting. Public Service will install the necessary poles and lights. Our total W billing for lighting the entire lot will run about $40 .00 per month .
