Ell is -2- Date May 16, 1994 INITIATED BY STAFF SOURCE COUNCIL GOAL COUNOL COMMUNICATION Agenda Item 11 b Subject Rezoning Request filed by Tim Shipley, d/b/a Colorado Homes Department '>f Community Development Lee Merkel, Director of Community Development Housing ISSUE/ ACTION PROPOSED -Staff seeks Council consideration of a bill for an ordinance approving the rezoning of 3652- 3698 South Huron Street and 3651-3699 South Galapago Street from 1-1 (Light Industrial) to R-2 (Medium Density Residence). Council is also requested to schedule a date for Public Hearing to consider the rezoning request filed by Mr. Tim Shipley. PREVIOUS PLANNING COMMISSION ACTION The Planning & Zoning Commission held a Public Hearing on May 3, 1994, and recom- mended the approval of the rezoning to City Council. PREVIOUS COUNCIL ACTION None. BACKGROUND Tne subj ect block is bound by West Jefferson Avenue on the north, South Galapago Street on the east, West Ken yon Av"nue on the south, and South Huron Street on the west. This block has been zoned for industrial purposes since at least 1955, w as formerly developed w i th greenhouses, but has been vacant for many years . Several years ago, the City staff - suggested the possibl e rezoning of a portion of the Light Industrial area south of U.S. 285 to B-2 , Business, rather than the 1-1, Light bdustry. At that time, property owners in the area were adamantly opposed to any form of "down zoning" because of a perceived loss of property values. Since tha t ti me, there have been several discussions between members of the staff and Mr. John Hollberg, one of the property owners, on development potentials for A this block. The large majority of these discussions have centered on some type of residen-• tial development. Mr. Tim Shipley, the applicant, has an option to purchase the entire block contingent upon the rezoning from 1-1, Light Industry to R-2, Medium Density Resi- dence. PROS AND CONS OF OPTIONS REVIEWED The rezoning of the property to R-2 , Medium Density Residence, will allow development to a maximum of 14.5 units per acre . The proposal is a mixed residential development of 18 units on 2.4 acres . If the rezoning is not approved, the applicant will not pick up his option to purchase and develop the block, which has been vacant for a good number of years. This block has been of concern to code enforcement personnel because of trash and debris which is dumped on the site. STAFF ANALYSIS The proposed rezoning and development is in compliance with the Generalized Land Use Plan in the Compreh1!nSive Plan. The rezoning and proposed development will be compati- ble with existing surrounding zoning and land use, and the development will prove benefi- cial to the City . A block that has long been v acant and an attraction for dumping unwanted A branches and other trash and debris will be developed with U single-family homes and two • three-unit townhomes. FINANCIAL IMPACT New homes will add to the tax base of the City, and there will be the permit and use tax fees to be paid 1:.,y the contractor over the period of construction.
