AN ORDINANCE AMENDING TITLE 5 , CHAP'l'ER 2B, SECTION 8, PARAGRAPH C, OF
THE ENGLE~VOO D MUNICIPAL CODE 1985, ALWWING AMUSEMENT CENTERS OR
ARCADES TO TRANSFER LOCATIONS BY FILING AN APPROPRIATE APPLICATION
AND PAYING A LICENSE TRANSFER FEE.
WHEREAS, under the existing Title 5-2-B-8C, a business would have to file for a new
lic ense and pay all applicable fees ; and
WHEREAS, with this amendment the City will maintain control of the amusement
centers and arcades by ensuring the information provided in the application for transfer
co mpl ies with all applicable Code restrictions prior I<> approving the transfer;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNGIL OF THE CITY OF
ENGLEWOO D, COLORADO, AS FOLLOWS :
~-The Englewood City Council hereby approves the amendment to Title 5,
Chapter 2B, Section 8, Paragraph C, of the Englewood Municipal Code which shall read as
follows:

THIS SECTION SHALL BE TRANSFERABLE TO ANY OTHER WCATION
IN THE CITY WITHOUT MAKING AN APPLICATION FOR TRANSFER
AND PAYING THE APPLICABLE TKANSFER FEE.
In th e eve nt of transfer of own ership of the business at the sam e location for
whi..:h a license or tax rec eipt is issued pursuant to th e terms of this Articl e, a
license may be transferred to the new O\l.1'l er of the business; provided , however,
that application therefor stating the same information as required by 5-28-4 is
fi rst pr ese nted to th e Director of Fin anc ial Services for approval or tli!appro,al
DENIAL. Approval or di•appro, el DENIAL of such transfer shall be upon the
same terms as approval or di,opp,o,al DENIAL of a license under the term; of
this Article .

-Staff requests Council approval of the attached ordinance amending the Amusements
Li censes Provisions of the City 's Miscellaneous Licensing regulations .

BACKGROUND
The changes included in the attached ordinance were developed by the Fina,.1cial Services
Staff and the City Attom~y . The intent of the changes is to allow amusement centers or
arcades to transfer locations by filing an appropriate application and paying a license
transfer fee . The license transfer application and fee are addressed in Chapter 1 of Title 5
(Ge neral License Provisions). The fee is $25. Without this change, a business would ha ve
to file for a new license and pay all applicable fees .
STAFF ANALYSIS
Staff believes the proposed change will benefit amusement center and arcade li cense holde rs
by allowing them to transfer locations without the added expense of a new license. The
City will m•.1intain con . .:,1 of amusement centers and arcades by ensuring the information
Aprovided in the application for transfer complies with all applicable Code restrictions prior
-to appro,·ing the transfer.
