WHEREAS , the accumulation of snow and ice on public sidewalks constitutes a hazard t.o the travel ing public ; and WHEREAS, the removal of snow and ice from private property ont.o the City streets and alleys creates a hazard for traffic on those streets and alleys; and WHEREAS, the Ord inance , as currently written, creates a conflict in that it provide s stan dards for snow and ice remove] and the strictly prohibits such removal ; and WHEREAS, the pro poSt•d amendment should clarify the language and allow snow and ice remo va l from sidewalks abutting City streets, but still prohibit snow & ice from private si dewalks , driveways and perking lots from being r emoved ont.o City streets; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD , COLORADO , AS FOLLOWS : ~-Tha Engl ewood City Council hereby approves amending Title 11 , Chapter 3, Section 2, of the Englewood Municipal Code in order t.o clarify the existing ordinance regarding the r emo val of ice and snow. Title 11, Chapter 3, Section 2, shall r eed as follows : 11 -3-2 : REMOVAL OF ICE AND SNOW: A . It shell be un lawful for any owner, tenant, lessee or occupant of any lot, block or parcel of reel estate within the City, or for any agen t in charge of such property, to all ow any snow or ice to accumulate or remain upon any sidewalk conti guo us to sue~ property for longer than twelve (12) hours from the time of the la st acc retion of such snow or ice . It shall be unlawful for any person to remove or cause to be removed any snow or ic e from privately owned property within the City and place or cause t.o be placed such snow or ice upon any street or a11ey within the City. C . EXCEPTION -SNOW OR ICE ON SIDEWALKS ABUTTING CITY STREETS MAY BE PLACED IN THE CITY STREET. IF SUCH SNOW OR ICE IS REMOVED INTO THE TRAVELED PORTION OF ANY STREET, SUCH 3NOW AND ICE SHALL BE SPREAD OVER THE SURFACE OF SUCH STREET IN SU CH MANNER AS TO CAUSE THE LEAST INTERFE RENCE TO TRAFFIC AND DRAINAGE UPON SAID STREET. PREVIOUS COUNCIL ACTION Ordinance was written in 1962 and amended in 1980. BACKGROUND There has been conf"si on regard 'n g the word ing of Tit le 11-3-2 -Snow and Ice Removal as it is currently written. The original 1962 ord inance prohibited removal of snc .y and ice onto the City streets with no excr .ptions . The 1980 amendment attempted to allow snow and ice on public sidewalks to be p lacP.d onto the City streets if spread on the traveled portion, so that drainage and traffic is not ol:.structe<'. This proposed amendment should clarify the language and allow snow and ice remo val from sidewalks abutting City streets , but still prohibit snow and ice from privat<? sidewalks, driveways, and parking lots from being rerr.'lved onto City streets. STAFF ANALYSIS Publ ic Works agrees that the wording reflects current policy. The general restr iction is needed to preve nt people from plowing parking lots into the City street. • FINANCIAL IMPACT None.
