AN ORD!NANCE APPROVING THE CONTRACT BETWEEN THE ENGLEWOOD
DEPARTMENT OF SAFETY SERVICF.S FOR LAW ENFORCEMENT ASSISTANCE
FUNDS AND THE COLO RADO DEPARTMENT OF TRANSPORTATION, OFFICE OF
TRANSPORTATION SAFETY FOR FUNDING A LAW ENFORCEMENT ASSISTANCE
FUND (LEAF) PROGRAM IN THE CITY OF ENGLEWOOD, COLORADO .
WHEREAS, the Englewood Department of Safety Services, hu submitted an application to
the Colorado Department of Highways, Division of Highway Safety, for funding to conduct a
program under the Law Enforcement As sistance Fund (LEAF) for the prevention of drunken
driving and the enforcement of laws pertaining to the driving under the influence of alcohol
or other drugs which has been approved by the State; and
WHEREAS, the LEAF Contract, aquires the City of Englew ood to provi de matching fu nds
in the amoun t of $35,000; and
WHE REAS, auth ority exists in the law and funds have been budgeted, a ppropriated and
otherwise mad e available and a sufficient un encumbered balance thereof remains
available for p ay men t : and
WHEREAS, LEAF has been established to provide funds to aid in the prevention of
drunken driving and the enforcem e nt of laws pertaining to driving under the influence of
alcoho l and drugs 'n'lthin its jurisdiction ; and
WHEREAS , th e Depanment of Safety Services has established a qualified program
consistent with current State Highway Safety rules to coo rdinate efforts to prevent drunken
driving and to enforce laws pertaining to driving under the influence of nlco hol and drugs
wilhin its j urisdiction; and
WHEREAS, pursuant to Sections 43 -4-401 through 404, C.R S., the State is authorized to
allocate LEAF funds by co ntract to local authorities (citie s and co untjes) to benefit the health
and safety of per so n s in Col orado by the impl ementation of local programs developed by the
local authorities fo r drunken dri vi ng prevention and law enforr · ment improvem ents; and
WHEREAS, the Englewood Department of Safety Services has available the technical
ability to properl y perform the proj ect as described in the Application and to address the LEAF
objectives of the Legislature:
NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO, AS FOLLOWS:
~ The Contract between the City of EneJewood Department or Safety Services and
the Colorado Department of Transportation, Office of 1'ranaportation Safety i1 hereby
approved. The Contract is attached hereto aa " E1hibit A".
&diim.l. The Mayor and City Clerk are hereby authorized to sign and attest, rupectively,
the sai d Contract for and on behalf of the City Coun cil and th e City of Engl ewood, Colorado.

CONTRACT
THIS CONTRACT, Made this ___ day of _____ _, 199_, by and between the State of
Colorado , for the use and benefrt of the Colorado Department of Transportation , Office of Transportat ion
Safety , 4201 East Arl<ansas Avenue, Denver, Colorado 80222 (hereinafter referred to as "the State") and
the C ity of Englewood, for the Englewood Police Department, 3615 S. Elati Street, Englewood, CO .

VVHEREAS , authority ex ists in the Law and Funds have been budgeted , appropriated and otherwise
made ava ilable dnd a suffici ent unencumbered balance thereof remains available for poyment in Fund
Number 403 , Appropriation Code 304 , Contract Encumbrance Number 9584 , and GBL Number

VVHEREAS , required approval, clearance and coordination has been accompli shed from and with
appropriate agencies ; and
VVHEREAS , the Legis lature has created the Law Enforcement Assistance Fund (LEAF) for th e
~event ion of drunken driving (43-4-401 through 43-4-404, CRS , replacement ed ition): and
VVHEREAS , LEAF has been established to provide funds to aid in the prevention of drunken driv ing
an d the en forcement of laws perta ining to driving under the influence of alcohol and dn: ;; and
WHEREAS, pursuant to §43-4-404 , C.R.S ., the State is authorized to allocate LEAF funds by
con tract to local authorities (cities and counties) to benefit the health and safety of persons in Colorado
by the imp lementation of lo cal pr ... pms developed by the local authorities for drunken driving prevention
and law en forcement improvements; and
WHEREAS , the Contractor has submitted a LEAF project f'J nding Application , which has been
a p p roved by the State ; and
WHE REA S, the Contra ctor has established a qu2 !if!ed program , cons istent with current State
Highway Saf ety rules at 2CCR 6 02-1, to coord inate efforts to pr;,,vent drunken driving and to enforce laws
pertain ing to driving unde r the influence of alcohol and drugs wrihin its jurisdiction; and
WHEREAS , ,he Contractor has available the techn ical ability to properly perform the project as
describe d in th e Approved Application and to address the LEAF objectives of the Legislat:Jre ; and
WH EREAS , th is Contract is executed by the State under authority of 29-1 -2 03 , 43-1-106, 43-4-402
a nd 403 , and 24-42-103 CRS , and by the Contractor under sections 29-1-203 and 30-11-101 , 31 -15-101
.CRS or home rule charter, as applicable , and the attached res olution .

NOW THEREFORE, it ii hereby agreed as follows:
1. The Contractor's Approved LEAF Application, the LEAF Contract Management Manual dated
August 1, 1992 and LEAF Application Guidelines dated July, 1992, the State Highway Safety Rules at_. ·
2CCR 602-1 , and Attachments A, Band Care incorporated herein by this reference as !Arms anew
conditions of this co:itract. The Contractor acknowledges that it has received copins of the LEAF
Cont'"ad Management Manual, the Application Guidelines. and the State Highway Safety Rules. The
Contractor shall comply with all terms and conditions of this Contract. In the event of a conflict between
the terms of this Contract and the terms of the incorporated materials, the following priority shall be used
to resolve such conflict:
A State Highway Safety Rules; then
B: LEAF Contract ManagemEjnl Manul!I and Guidelines; then
C. This Contract; then
0 . Attachments A, B, C, in that order, then
E. Approved Application .
2 . The Contractor shall carry av the program and shall perform the activities which are specifically
described in the Approved App licauon and are generally described in Attachment A (collectively, ''he
project'1.
3 . The Contractor shall submit quarterly reports to the State detailing the performance of th ;s
Contract according to the reporting criteria described in Attachment B.
4 . Project Funding Provisions. The total budget amount authorized by this '::ontract for the actual
costs of the project work is $60,000, as described in Attachment C. The State and the Contractor •
sha ll participate in Iha payment of this total budget amount, as prov id ed he rein.

The State shall use LEAF fun ds exclusively to pay for 42% of the actual costs incurred by the
Contractor for the project work up to the State's maximum share amount of $25,000 (42% of
$60,000). Provided, however, that the State's maximum share shall not exceed the anIount of
$25,000 for any reason , including ii the Contractor voluntarily pays more than the minimum match
amount requ ired of the Contractor under this contract, unless this contract is supplemented in writing
to that effect prior to the incurring of any cost in excess of the total budget amount.·
The Cnntractor shall pro~·icie a minimum match share of $35,000 (58% of $60,000), either in
payment of oct ual costs incurre<.I for the project work or in the performance of in-1:ind se~ices on the
proJ ect, whi~h reimbursement t:-c directly related to the enforcement of laws perta ining to driving
under the influence of alcohol or other drugs.

It is anticipated that Iha Contractor may voluntarily provide either payment of actual .:oltl or in-kind
services excaading its minimum match requirement in order to establish the project on a permanent
basis, provided that it is expressly understood that any such voluntary payment or servieas shall not
eaease the State's maximum share Wlder this contract.
In addttion, if the Contractor fails to provide Iha total amount of its minimum match share the State's
obligation to pay its percentage share shall be reduced in direct proportion to the extent of such
failure , so that the State's obligation will be reduced $42 for each $58 (42%-58%) the Contractor fails
to provide . Jpon notice from the State, the Contractor shall repay the State any amount that was
paid by the State and that a subsequent ~udit determines the Contractor exceeded the State's
percentage of obligation under this contact.
If the Contractor incurs project costs which exceed the Attachment C budget amount wtthout
first obtaining an approval in that amount by written contract amendment, the Contractor shall be
solely responsible for the payment of such excess costs.
The State share of the total budget amount will be provided solely from LEAF funds . Any obligation
of the State under this Contract is cont ingent both upon LEAF funds being available for th is Contract
and upon the Contractor providing its min imum share.
The State will pay the Contractor for the State's share of actual costs incurred on a monthly or
quarterly basis, subject to prior review and approval by the State of wo!k performance and pursuant
to payment procedures conta in ed in the LEAF Contract Manual. The Contractor shall maintain an
ttemized accounting of all bilhngs and other records to support all costs charged to the Contract and
,;hall present same to the State upon request.

The obligation of the Contractor for all or any part of the payment obligations set out herein shall
only extend to mon ies duly and la wfully appropriated for the purpose of this Contract by the
Governing Body of the Contractor. The Contractor hereby represents and warrants that the monies
to pay tor the Contractor's obligations described herein have already been legally appropriated by the
Governing Body for the purpose of this Contract.
5 . The effective date of this contract shall be the date the Controller of tha State of Colorado
approves this contract , or such later date specified .herein. The Contract shall begin January 1, 1995,
and shall terminaie on December 31 , 1995 .
6 . The Contractor agrees that any subcontracts entered in to by the Contractor under th is Contract
must meet all applicable State and Federal requir.ements and must be approved by the Office of
Transportat ion Safety prior to execution by the Contractor .

7 . •I Tl[ffljnatjgn Que to LO§• of fyndjng. The parties her9lo expressly racognize that the
Contraclor is to be paid, reimbursed, or oth91Wise compenseted solely with certain funds provided to
the State for the purpose of contracting for the services provided for herein. Therefore, the Con-
tractor expressly understands and agrees that all its rights, demands and claims to compensation
arising under this Contract are contingent upon rece ipt of such funds by the State In the event that •
such funds or any part thereof are not received by the Slate, the State or Contrac,.;r may immediately
terminate this Contract.
b) Terminatjon tor Cause. If, through any cause , either party sh~II fail to fulfill in a timely and
proper manner the obligations under this Contract, or if either party shall violate any of the covenants ,
agreements or stipulations of this Contract, the non-breaching party shall thereupon have the right to
terminate this Contract for cause by giving written notice to the breaching party such termination and
specifying the effective date thereof, at least th irty (30) days before the effective date of such
termination . In that event, all finished or unfinished documents, data, studies , surveys , drawings,
maps, models, photographs, and reports of other material prepared by the Contractor under this
Contract shall, at the option of the State , becom e ns property, and the Contractor shall be entitled to
receive just and equnab le compensation for any satisfactory work completed on such documents and
other materials .
Notwithstanding the above, t~.a breaching party shall not be relieved of liability to the
norH>reaching party for any damages sustained by the no~eaching party by virtue of a breach of
the Contract by the breaching party, and the State may withhold any payments to the Contractor for
the purpose of setoff until such time as the exact ar,,ount of damages due the State from the
Contractor is de termined, if the Contractor is a breaching party.
c) Termjnation for Conyenjence . Either party may terminate this Contract at any time that it •
determines that the purpose of the distribution of monies under the Contract would no longer be
served by completion of the Project. Such party shall effect such termination by giving written notice
of termination to the other party and specifying the effective date thereof, at least twenty (20) days
before the effective date of such termination .
8 . The Contractor shall adopt a resolution substantially in the form presented by the Slate, which
approves this Contract , obligates the necessary local monies to pay for ns share of costs or in-kind
services and au thorizes a signatory to execute this Contract . A copy of such resolution shall be
attached to and made a part of this Contract .
9 . The Contracto( shall perform its duties hereunder as an independent contractor and not as an
employee . Neithe r the Contractor nor any agent or employee of the Contractor shall be deemed to
be an agent or employee oi the Slate. The Contractor shall pay, when due, all required employment
taxes and compensation (and show proof of such insurance) and unemployment compensation
insurance in the amounts required by law , and shall be solely responsible for the acts of the
Contractor, its employees and agents .
10. The Special Provisions are attached hereto and hereby made a part hereof as terms and
condit ions of this contract.

Prov ide officers throughout the term of this contract to perform
overtime DUI enforcement activity within the City of Englewood
as stated in the Approved Application .
Conduct at least three sobriety checkpoints or saturation patrols during 1995.
This can ~ in cooperation with a nearby agency or soley by the
Englewood Police Departmen t.
Ma ke all reasonable efforts to increase the DUI alcohol and drug related arrests 4I
within the City of Englewood by 20% from the 1994 level.

ISSUE/ACTION PROPOSED
S,aff seeks Council suppo rt for a bill for an ordinance app ro vi ng the law Enforcement
Assistan ce Fund (LEAF) contract l -31 -95, enabling the City of Englewood to enter into a contract
with the Colorado State Department of Transportat ion which grants the city money to be used
by the Department of Safety Services for DUI detection ~n d enforcement.
PREVIOUS COUNCIL ACTION
Council has approved the city 's part ici.,ation in previous years (1991 , 1992, and 1993).
BACKGROUND
The proposed ordinance would allow the Department of Safety Services to accept LEAF grant
money for use in the detection and apprehension of DUI drivers within the City of Englewood.
The Englewood Police, in accordance with state motor vehicle laws , and with the preservation
of life and -property in mind, actively investigates DUI violations with the intent of removing
drunken drivers from the City's streets . Acceptance of LEAF grant money enables the
department to enhance its DUI enforcement efforts by allowing the department to pay for and
ded icate more officers and equipment to this apprehension effort.
At the present time, apprehension efforts are dependant on officers attempting to detect the DUI
driver between assignments . LEAF grant money would allow the department to hire officers, on
an overtime basis, specifically to detect and apprehend DUI drivers .
STAFF ANALYSIS
The passage of this ordinance should have no long-range i mpact on other City departments . •
The ordinance is a requirement of the grant proces,.
FINANCIA : IMPACT
No financial impact to the City would occur. Local agency match funding required by the grant
would consist of exist ing "in kind " previou sly budgeted resources.
